The petition sRould be verified by the oath of the complainant, to the effect that the facts stated in the petition upon her own knowledge are true, and that the matters and things therein stated upon information and be- let, she believes to be true. in looking through the evidence in this case, 1 find ne proof of the marriage of the parties. It as stated im the petition that the parties were married in Phi Iphia, Pa., and that a copy of the marriage certificate is filed with the clerk of this court; but the petition does not purport to be verified by oath, and if it were, 1 do not think would or ought to dispense with proof of marriage. 1 learn. however, that the petition was in verifled, but the jurat was omitted to be added by the clerk of the court. in abmost every tribunal having jurisdiction of the subject of divor it bas been beld that preof of the marriage was an indispensable pre-requisite to granting a divorce from the bonds of matrimony. The act of Congress on this subject, hastily and crudely drawn, as it manifestly 1s, centains, however, the wise and salvtary provision + “no judgment for a divorce shall be rendered on defauit without proof. nor sball any admission contained in the smswer be taken as proof of the facts charged. but the same shall in all cases be proved by other evidenc The marriage contract ha: been regarded as of so great solemnity ia ali civilized countries that its dissolution has not usually been de- creed for slight and trivial causes. It ts not averred in the petition that the Sune was not filed im collusion with the de- feadant. If it were, a Court of Equity would purn both parties from its Perec. The ules of pleading im cases of divorce, very }roperiy, from eonsiderations of public policy, bear little or no analogy to those in ordin ry cowl actions.
