Akai as DRAPLY ASSAULT anv BATTERY—A Man | Sradbedt ond Out.—Early yesterday moramg the police of the Second Ward were called apon to quiet gdistarbence at the house of Lizzte Mc. or k, 00 13tB street, south of Pennsylvania Svenue. and upon en ering found a man named Jobo Olaicy terribly Incerated and stabbed in the body, arms, and head, with blood poar- ing frown bis wounds. Upon in airy they as- certained (bat the person co! with inflict- ing the wounds was @ man named Edward Neason, a watchman at the East Ospitol bar- Tacks. The officers secured as many of the witnesses as possible, and made arrangements ‘for the speedy apprehension uf Neason. About noon officer Frazier bim on Pennsyl- yania avenue, near loth and D streets, walking briskly toward the tol. There was no dis- guise as to bis clothing, but he had shaved of his moustache, which was not sufficient to de- cvtve the officer, who knew him ata distance by bis peculiar waik. Last night Justice Mer- sell gave the prisoner a hearing at the Central Guardhouse. testified that Saturday Lizgve McCormick night the accused came in late with Emma Ber- pard, one of the girls boarding at the house, and Emma hed been drinking. Knowing that the girl was disposed to be noisy when intox. icated, witness told her not to drink any more. Sbe went out again, and Ciancy and English, and som: heir friends, came to tbe house. When Emma returned she WSs disposed fo be unruly, and began to flirt with Clancy. Witness told Neason he had better take ber to her room and pacify her. Neason replied that he was “ going to do som thing bad to-night.” Neason went away, and sfter awbile Clancy took the girl Emma te her room. Sunday morning early she was aroused by one of the girls, who came to her room and said ~ Al-ts killing Clancy,” and heid up the handle of a pitcher broken and covered with blood. Witmess gotup and ran to the room, and ssw the weunded man standing in a pool of bleod, and the blood pouring from his wounds. Asked Emma Bernard why she did not give the alarm, and sbe said she was so excited «be conld not batlos. Witness did not see snything of the fight. Witness said that after Neasou left that night the doors were all fastened, and no one let him in. He forced his way in by getting over a low back building to a window, by which he got into the p: leading to the room in which the gir’ lept. Fanny Wilson testified that she was in bed in be room when Clancy and Emm: Bernard came to tbe room. Fell asleep soon after. Was awakeaed by Neason in the room standing cy, holding a pitcher in his hand, ung, “You s—n of ab—h! yon are bed with my woman.” Saw him strike several times with the pitcher. Did not see any knife. Dr James Phillips testified that Sunday morn- ing be was called to 450 13th street, io see a Wounced man. Saw there a man with some en or 8 dozen punctures upon bis body. They looked &s if they might have been inflicted with a ciasp knife. The wounds are not necessarily fatal, but one of them would probably have caused mstant death, but for the fact that the instrument came in contact with a rib. ©. W Frazier, policeman, testified that he arrested Neason on the avenue, near LD and loth streets. Neason asked what it was for. and if the officer had a warrant. Frazier re- that he (Neason) knew well enough was for, and that the warrant was all ‘ m then remarked that he wanted Witness told him that he ney up, and he was well enough ked what he did it t ‘ancy served him a scaly trick. He (Nesson) bad caught him in bed witb his (N."s) woman. John English testified to his being at Lizzie McCormick’s with Clancey and others. Heard some remarks sbout Emma being drunk, and the probability of trouble in consequence. Was several times approached by Emma, who wanted him to go to her room; bat he pushed her away from him. He was asked to stay there. as trouble was feared, and he consented. In the night he was awakened by some one eslling out “Al is up stairs killing Clancey !” After some difficulty im finding his clothes, Witness ran up stairs and saw Clancey stand- ing im the floor, and agirl with a towel drying up the blood. Saw but twe wounds, a gash in the forehead and another in the arm, and start- ed for a doctor. Upon his return, Clancey was Standing in a pool of bleod. He remarked te Witness, “ This was never intended for me; it ‘was meant for you,” meaning English. The girl who was attending him confirmed it by saying, “ Yes, it was meant for you.” Emma Bernard testified that she was in bed ‘with Fanny Wilson and Clancy; was awakened trom ber sleep by Neason and Clancy fighting. Saw Neason sirke Clancy with a pitcher They bad been fighting before she awoke. The evidence of this witness amounted to but little, she accounting for it by saying she was awakened suddenly and was confused. Justice Morsell committed Neason to jail for court. Emma Kernard, who had boen in ens- tody all day, was released upon the payment of acorporation fine ef $3, im: for her Misconduct at night. Dr. Phillips probably alluded to the se- verest wounds when setting them down at tenor adozen. Mr. Morgan, counsel for plaintiff, proposed to read in evidence the original process of the magistrate, with the endorsement thereon, to the effect that judgment bad been rendered for a ific amount. r. Norris, counsel for defendant, objected on the ground that the original entry of sueh judgments in the docket of the magistrate was the best evidence, and must therefore be pro- duced, or proof be made of such docket having been either lost or destroyed. Mr. Morgan claimed that such endorsement as te proposed to read had always, in this District, been regarded as sufficient evidence of judgment. he Court sustained the objection, thus overruling the offer of plaintiffs counsel.
