“THE EVENING STAR. LOCAL NEWS. Aw Interesting Lanp Oase.—Judge Wy- lie, in chambers, has recently made a decision im the case of Levi H. Whitney agt. John B. Frisbie, granting an injunction to restrain Frisbie from accepting from the Government & patent for the quarter section of land known as the Soscal Ranche, on which is situated the city of Benecia, the town of Vallejo, the U.S. avy yard on Mare Island, and the depot of tbe Pacific Steamship Company. Lt is claimed by @risbie, who is ason-in-law of Vallejo, that the latter purchased it in 1844, and that Vallejo disposed of it to him in 1855, with other lands, The complainant Whitney, in October, 1262, entered this quarter section making the neces- sary improvementsand tendered himself ready to comply with all the other terms and condi- tions required by law to entitle him to obtain a patent forthe land. By the act of March 3d, 1563, Congress interfered in behaif of the bona fide purchasers under Vallejo, to take it away and sell to them. This act provided that it might be lawful for the purchasers from Wailejo or their assigns to entre the land at $1.25 per acre, and that all claims should be presented to the Register and Receiver within 12 months of the return of the surveys accom- panied by proot of the purchase from Vallejo. The officers (Register and Receiver) took the Proof &s required in regard to the claim of the defendant, and decided the case in his favor. This decision was reversed by the Com- missioner of the Land Office, on the ground that the settlers had obtained a valid title to the land prior to the act of March 3d, 1563. The case was then taken on appeal to the Secretary of the Interior, who reterred the legal ques- tions involved to the Attorney General, and he advised “that a settler under the pre-emption jaws acquires, and can acquire, no vested in- terest in the land he occupies by virtue simply of settlement, and that no vested interest is ob- tained until the settler bas taken all the legal steps necessary to perfect an entrance in the Land Office * Accepting this opinion, the Secretary re- versed the decision ot the Lagd Office, and, as it was alleged. a patent was about to issue to Frisbie. Judge Wylie cited the case of the United States against Fitzgerald, in 15th Peters, 47, in Which it was decided that no reservation or appropriation of public land can be made atter @ citizen has acquired the right of pre-emp- tion, and nolds to this opinion. citing other cases where similar decisions were made, and diseusses the case at considerable length, in the course ot which he says :—-I am of opin- ion that Mp degree shows a valid equitable imcboate right to the property in question, which he had acquired anterior to the passage of the act of Congress of March 3, 1563, under whicn defendant denies bis claim to hayea title granted to him by the Government: and that the decision of the Commissioner of the Land Office in favor of the settlers, which was reversed by the Secretary of the Interior, on the advice of the Attorney General, was clearly correct.” THe 1.0.0. They ar- rived at the grove near Brookeville, at o'clock a. m..and were met by a committee of Brookeville Lodge and escorted to their posi- ton in the line, which was soon on the march throvgh the village, in the following order. Chiet Marshal E. J. Hall, mounted; Clarks- burg cornet band: Brookeville Lodge, with banner, Rainbow Lodge, of Lisbon, with ban- ner; Etlicott’s Milis brass band; Centre Lodge, ott’s Mills, with banner; Heald’s brass band, the Washington Lodges under William Kettler. Grand Marshal, headed by Oriental Lodge, with banner, the Grand Lodge bring- | ing up the rear. The procession was a larze one, numbering about three hundred, and on the line of march received the chaplain and speaker of the day, and escorted thein to a beautiful grove where a stand had been erect- ed and arrangements made for seating the Isrge numbers of ladies and gentlemen pres- ent. The stand was tastefully decorated with wreaths, evergreens, &c., and forming the letters “1. O. O. F.” on the front, and the banners placed in a prominent position, mak- ing altogether a fine display. The exercises opened with music by the band, and followed by prayer by Rev. Bro. Wilson. Grand Sec- retary Escavaille, of Baltimore, atter some remarks concerning the celebration, intro- duced Josiah L. Baugher, Grand Master of Maryland, who, for about an hour, enchained the attention of the company with an address upon Odd Fellowship, defending the true tenets of the fraternity, and holding them up to the admiration of the brotherhood. after the address. an adjournment for dinner took place, and ample justice was done to the bountiful supply of good things spread upon the long lines of tables in the grove; the bands Tmeanwhile making the old grove resound With music. About 2 o'clock, the exercises at the stand were resumed, when Past Grand Master Gary, of Baltimore, delivered an elo- quent address. in which he gave a history of the rise and progress of Odd Fellowship in the United States, and especially in Maryland. Rey. Mr. Wilson, of Howard county, also de- livered an address; after which the exercises at the stand were conciuded, and the 1. 0. O. F. celebration at an end. The Washingtonians returned to the city during the evening, the iastof them reaching nome about midnight, and | expressed themselves as much pleased with their trip and the treatment they received at the hands of their Brookeville brethren and the citizens, and especially Chief Marshal Hall and family, for their attention to the com- forts and pleasure of the ladies and others f | the party. —° VAGRANCY.—Although there is now a de- mand for labor in various rural districts, the District of Columbia is plagued by a host of stout able-bodied men, who do nothing but loaf about low groggeries and sleap in the markets, fields, or unoccupied buildings, and subsist by petty larcenies, and tne eharity of the citizens. Few if any ot these drunken, | Worthless creatures belong to the District. but | are colonized from all sections ot the country, and even from the British Provinces. Of course & great majority of these are negroes, who will bot work, but there are many white vagran's who admit that their fare from distant cities to Washington was paid on condition that they Would leave those localities. The city of Washington for years past has been the win- ter residence of the vagrants of other cities, and the expense to our citizens has been heavy. This season they appear to be coming in larger bumbers than usual, and what to do with | them under existing laws will puzzle our mu- Dicipal suthorities.
