Mr. Kiddie offered the letters in evideace, and proceeded to read a letter from Colonel Rutherford, in which he states that explana tory statements had been made in behalf of Mr. McGhan, and mforming him that an opportunity was then offered for him to fur- nish additional proof to show that Mc(+han should not receive Government 6 Mr. Clephane also read his reply, dated in February following, in which he declines to furnish any proof, stating that he hed sup- posed such & communication us he had made Was to have been treated as confidential, and he wac much s' ised that a fall copy of bis letter had been furnished Mr. McGhan. He further stated that he had no ill-feel ing against Mr. McGhban, and that an indict- ment for libel had been found.
