Witness knew Ar- nold, who was in witness’ employ from April 2d tothe 17th. Witness received @ letter from Arnold. Mr. Ewing asked the nature of the letter, to which Judge Advocate Bingham objected, and the objection was sustained. Mr. Ewing moved that the cipher letter, of- fered in evidence June Sth, 1565, be stricken from the record. He stated that he was not present when.the letter was offered in evi- dence, or he would have objected at the time. His reasons were two fold for this motton; one that he believed it to be fictitious, and the other that it was wholly inadmissable, as the hand ‘writing was not proved, nor that it was ad- dressed to any one of the prisoners on trial, nor that It was written by any oneon trial. Judge Bingham stated that the introduction of the letter did not affeot the counsel, Mr. Ewing, and he argued that it was admissable as aconnecting link. PHILADELPHIA, June 7.—The Nationat Typographical Union to-day decided upon their next convention at Chicago. of a fabrication—not having been blurred by tne water—perhaps it had beer dropped in the water that it might be picked up by a Goy- ernment official, and be used as evidence. The counsel for defence further commented upon the nature of the letter contending that there was internal evidence that it was not writen at the time or place it was dated or by any of the prisoners. Judge Bingham said that there was no rule of evidence by which this letter was to be thrown,out, because the handwriting was not proven. It wagno matter who wrote it, it ‘wus not a very fine literary production, but it was sufficient to show the purposes of the par- ties concerned; and the fact of having such a letter in one’s possession, would be sufficient to implicate the party as one of the conspir- ators. Judge Bingham proceeded to analyze the letter, sentence by sentence, showing that all the internal evidence sustained the as. sumption that it was a genuine letter, written atthe time indicated (April 15) by one of the conspirators. Mr. Gox contended that the letter had ap- parently been dropped in the water a short lime after 1t was written by some person hay- ing knowledge of the facts in the case. It was not shown to have ever been in the hands of any of the prisoners.
