By Mr. Ewing:—'Witnees “lives near his father-in-law’s on the cut between the Sur- Tattsville road and the Marlboro road. Wit- ress saw Dr, Mudd on the 3d of March near Ridgeway’s Hril. Witness noticed Mudd until he got to the bridge, And witness thinks he saw Mudd last on the bridge. Witness put up his horse at Pope’s stavle. Witness ts certain that Mudd had two horeces in his yehicle, which ts arockaway. Witness did not mention we fact of haying seen Mudd on the 3d of March to any other than his wite, to the Judge Advocate and to Mr. Robey. Witness since the assassi- nation mentioned the fact of seaing Mudd and others going to Mrs. Surratt’s to. bis father-in- law, Judson C. Pamphrey, and possibly to some of the clerks in his office. Wituess knew Surratt by sight; saw the face of the man going into Mrs. Surratt’s; when this man was going to the door Jarboe was taking leave of a Indy. Witness does notrecollect when he saw Dr. Mudd’s father, who is an old gentleman of patel 60 or 65; medium sized. Witness saw r. Mudd in Bryantown in December, 1550. At the time witness saw Mudd in March he did not see any other persons on the road: did not see Mr. Dlartin: met @ baker on the bridge. Witnees couid not say when he saw Mudd last before March. Mudd passed up and down the road sevéfal times during the winter; saw him once abouta year ago with Herold. Witness thinks it was a Cloudy day when he passed Mudd on the road. By Mr. Clampitt:— Witness did not say thet Jarboe was in company with Mudd at Mrs. Surratt’s, bnt that Jarboe was in the act of coming out. Witness could pot say how far it ia trom the house he saw Mudd go into from Mr. Butler's church.. It was in the winter, about eix months ago. By Mr. Aiken:—It was Judson G. Jarboe witness saw come out of Mrs. Surratt’s. Mr. Aiken:—When did you !ay aside your your clerical robes to enter on detective du- Witness:—I have not laid off my clerical robes. I hold a eecret commission to arrest deserters and disloyal parties wherever I flud them. Mr. Aiken:—Were you mad. Acynainted then with the code of morals recogmized amongst certain detectives ? Judge Holt said the Court had allowed the counsel for defense considerable latitude, but when a studied attempt was made by the counsel to break down. the rreputation of the witness, he thought .that the Gourt sbould interfere to protect the wiiness. Mr. Aiken said the counsel for defense had on some occasions had reason to cen- sure themselves that they had not more closely questioned witnesses -while within their reach. In the case.of this witness, knowing what they did of him, they had treated him with more tendernees and consideration than be conld expect. He would not, however, press the question. Friday, March 3d, he was at her sis- ter’s house; on the ith of March he was at the house, a8 also on the ‘Sth, The houses are about balf g mile apart, ard they ate abont 32 miles from this city. Witness did not see him on the ist of March, but is sure he was at home; saw. him on the 2d, when he took break- fast at his father’s. Witness has frequently yisit- ed lier brother's house; never heard of Sorratt being at the house, Dut heard that Booth was there in November. Witness knows that in 1-61 three gentlemen—Ben Gwinn, Andrew Gwinn, and Jerry Dyer—slept in the woods near Dr. Mudd’s. Witness has not seen An- drew Gwinn since: never héard ot Capt. White, Capt. Perry, or any other Confederates being at the house.
