IntrMINATION.—To-night, the illumination called for by the City Councils takes place. The City Hall, all of The hotels, and most of the business places will be brilliantly lighted up, 8nd judging from the active preparations on foot among our citizens very few private residences will remain dark. Postmaster Bowen has provided for lighting up the Post Office building, and itis understood that the government will accept the invitation of the eofporate authorities and illuminate all the departments. The lnsane Asylum on the h'ghts copes the Navy Yard will also be illumina and from its commanding elevation will no doubt present a magnificent sight. The Oxford Hail will be illuminated with five hundred candles, and an extra band has been secured for the occasion. eS Sas ImPoORTANT Orrnion.—The following opin- ion by the Corporation Attorney in regard to the powers of the corporation in regard to sewers is of so much general interest that we publish it in full: WASHINGTON, April 7, 1365. A, Lloyd, Esq., President Board Common Council. Ste: Lreturn herewith the resolution of the Board of Common Council transmitting for my opinion three several bills providing for the construction of a sewer along Lith street ‘West trom N street to the canal, and also the said bills. The power of the Corporation to construct sewers is expressly given in the charter. Its exercise isessential to the efficient discharge of the cbjects of a municipal corporation, one ot which is the preservation of the health of the citizens. It is, therefore, singular that no expressed exception in its favor is found in the charter of the Washington and Georgetown Railroad Company. Their powers are in terms subordinated to those existing in the Corpora- tion of altering and improving the streets and @yenues, and that company is required to change their said railroad so as to conform to such altered grade and pavements. It would seem to follow that it for proper sewerage the Corporation shall see fit to alter the grade of Lith street, the railroad company must conform to it, although that should in- terrupt the travel upon it. So that if this should become necessary in order to construct the proposed sewer no objection can be law- fully interposed by that company. It may admitof debate whether the Corporation has power in any other way to interrupt the travel on that road, especially if the object to be effected can be attained without doing so.j In the case proposed there must be ample room in that street to construct a sewer of tne dimensions named in the act without in any manner interfering with that travel. Each corporation has a2 common end in view, the public convenience and accommodation. They derive their authority from the same source. ‘The fact that one is a municipal corporation with large legislative powers and eharged with grave public interests, and the other a private corporation created for private advantage as Well as public convenience does not vary the construction of the rights and powers granted, and the duties and responsibilities imposed cn them by law. They musteach exercise their powers and authority so as not to interfere with cr injure the other, except in the cases ey pees out in their respective organic jaws. he rule applies equally wo corpora- tions and individuals, and we may safely refer the question to the rule which would govern individuals in like cases. It is not absolutely necessary that the power or authority shall be given in distinct and express terms. But the ianguage must be suck and the power and au- thority so clearly necessary to the exercise of some others distinctly giyen as to create it by necessary implication or intendment. Tam not prepared tosay that the Corpora- tion can, in the exercise of its undoubted power to make sewers, so construct them as to stop the travel on the road under any circumstances other than such as require &@ change in the grade. The question would admit of less doubt if Congress had not speciiied the case in which the raifroad company must conform tothe law of the Corporation. That yery exception renders it exceedingly doubtful whether they can in any other case so far interfere with that road. However that may be, my opinion is that the Corporation cannot for the purpose of sewer- Age so excavate a street in which that road is laid as to make the travel on it dangerous, or to stop it, whenever the same sewerage can be effected in some other way.
