SS CHANCERY CourT or THE DisTRIcT oF Uo- RIA—REGULAR TERM—Beiore Juige |Wylie.— United Staves vs. the interest of A. Y. P. Gar- nett in certain real estate. Confiscation Bill in ehancery of a mortgage against the proeeeds. In this case, of which we took note some time ago, a report has been made by the auditor of the Court of Chancery, W. Redin, Esq, in obedience to a reference of the 14th ultinro. The defendant in the present proceeding is the Surgeon General of the rebel army, Dr. Garnett, a well-known physician, formerly of tbis city. In 1846 he contracted a debt to Eliaa ¥F. Seymour, of €1,500, to secure which, he executed a deed of trustof his property situ- ated on Ninth street, and then occupied by him asa residence. The debt and interest now smounts to $2,25375 It has never been paid. Meantime, Mrs. Seymour has died and the pcre are being conducted by her execu- Dr. Garnett having adhered tothe rebellion, this property was seized, libelled, and prose- cuted under the confiseation act, and default having been made,a decree was passed p-o eonfesso, and the property was sold ‘on the 9th ot September, 1563, Alexander R. Shepherd becoming purchaser. But the confiscation. by express terms in the sentence, as weil as in the joint resolution of 17th of July, 1862, ex- planatory of the confiscation law of the same date, was confined to the “right title, interest, and estate of said A. Y.P. Garnett for and during his life,” &c. The proceedings of con- fiscation were conducted without reference to this mortgage or debt. The object of the complainant now is to have this debtand deed of trust satisfied out of the estate which was conveyed for the purpose of securing such payment. Several important questions are inyolyed— ist. How far the estate which has passed in entirety to the trustees, is divisible, so as to ap- propriate exclusively either the fee or the life interest to the payment of this mortgage. 2d. It divisible, which part of the estata should be exclusively, or in preterence, charged With this incumbrance ? 3d. By what rule shall the relative value of the life interest and the inheritance be dis- criminated ? In view of such questions, the court, on the 14th ult., directed the auditor toreport what incumbrances were on the property at the time of the sale of the life interest of Garnett, who were the holders of such incumbrances, and what, at the time of the said sale, was the value of said life estate as compared with the inberitance. The report of the learned anditor is replete with interest and instruction. It appears that the first step toward a solu- tion of such @ question is to commute the net income arising from the estate, for a period corresponding with the life of the holder, such an aggregate sum being the proper measure of value ofa lifeestate. Butthe question is, By whatrule of calculation shall the length of a lite be estimated? It is obvious that the cli- Mate, condition and all constant causes, oper- ative in ® country or district, would require to be taken into account; but as these differ, so ougbt the rule. Under the Maryland rule, ‘which was framed by the Cuencery Court sixty years ago, and affirmed by the Court of ap- eals of that State, the tenant for life is al- jowed three times the proportion of the dower interest of the widow. In the Districtof Co- Inmbia this rule has always prevailed, mod- ified, in some degree, by the discretion of the court: applied to the particular circumstances ofesch case, The full estate in this case the Auditor estimates as worth $12,000.of which the life interest, under the Maryland rule, should be %4.560. This sold to Shepherd, as beretotore mentioned, for #3,200 out of which atter commissions, &c , deducted, thereremains about $2,631 13. Dr. Garnett is about 45 years old, of good health and constitution, as tar as known. Twenty years of life is usually allotted a person thus circumstanced. But the audilor, after citing all the rules of estimation touehing the point, with great patience and learning, sufficiently indicates the great ne- giect of this subject while the resources of modern statistical record are comparatively so ample and so useful in the adjustment of Averages in most of the departments where they are necessary. The case will come up shortly for a hearing. SS THE TREASURY HoMIcIpE.—Mary Harris, the young woman whoshot A.J. There seems to be a great deal of sympathy fer herin the community, and numbers visit MEETING OF THE INAUGURATION Finanoa OomMMITTEE.—The gentlemen representing the Various State and other organizations on the Finance Committee for te inauguration cere- monies, held a meeting last night at the Union League Rooms, with Mr. Plant in the chair. S Watson was placed upon the committee in place of S. P. Morrill, of Maine, and A. P. Fardin in place of J. L. McLean of New Jer- Bey. The Chair announced that it was necessary to raise at least $300, to defray the expenses of the procession, &c., and the members of the cemmittee were each furnished with a blank book and directed to commence their coliec- tions at once. In order to give the committee confidence in prosecuting their work, and to prevent the public from being imposed upon by parties not authorized to make collections, it was ordered that the names of the duly authorized collect- ors be published. Mr. Brown, of Rhode Island, offered:a reso- lution proposing & change of programme for the inaugural ceremonies, and moyed that a paenees, concert be sudstituted for the ball. @ was of the opinion thatin view ot the pres- ent state of the country, it would be much more acceptable to the pubiic, and be attended with a larger income for the benevolent object to which the receipts are to be appropriated. Mr. H. M. Slade, of Ohio, and Dr. Bangs, of Illinois, fayored the amendment, while Mr. Clements, of Va, thonght the committee had p. Ogressed too far in their plansto change the programme. Shultze, in November last, on the Rappahannock.
