Go and ——— THE HACKMEN AND METROPOLITAN RAIL- way.—Yesterday afternoon A. B. Keys, J. L. Smith, Ed Gray, aud Timothy Costello, who were arrested on Saturday at the Dapot, by Or- ficer Howard, for obstructing the cars of the Metropoli'an Raiiroad, were before Justice ‘Giberson, at the 4th Wardstation. Mr. Wilson appeering for the prosecution and Mr. Davidge for the defense Officer Howard, on duty at the Depot, testified that he had received orders to keep the busses and hacks from the Metropolitan Railroad, be. fore the Baltimore Lepot, and that U.S. Hotel, Seaton House, Willard’s and Metrepolitan coaches, and hack 149 having backed over the track he placed them under arrest. He had previously warned them off but they refused to move out, and prevented the street cars from coming in in tront of the Depot. Lloyd W. Emmart, (superintendent of the read,) testified that he went to the depot onone of the cars on Saturday night, and just as it ‘was going in the curve the coaches backed up reventing the further progress of the car—the Seaton House car being the first one. The in- ner rail of the road is about 11 feet from the curb, and a platform has been laid by the com- spany extending from the curb to the outer rail And the length of the front of the depot. There ‘was some cry at the time, that the train was in -or was coming in. David Lewis, (starter at the eastern end of the Toad,) ,testified that the track up the hill was not ready to be used on Saturday, and therefore the depot was made the starting point for the time being. Witness had made a compromise ‘with ‘he coachmen &c., thathe mould not stop the cars between the coaches and pavement, but that he would orderthe car tothe lower end of the platform and stop the car coming in beyond the curve (on Indiana avenue.) It, however, becoming muddy, making it incon- venient for passengers to get out, they were called wp in tront of the depot. When the train came in the coaches and hacka were back up over the track,and one car at the tower end of the platform and another on the curve were blocked. Witness did not know the names of the drivers. Some of the cars ‘were stopped as long as 20 minutes. Mr. Wilson read the act of incorporation of Metropolitan Company, which prescribes in the first section the route of the road, and says the road shall be Iaid along the east side of New Jersey avenue. The third section pre- scribes that the road shall be laid in the center of the streets and avenues named, except on New Jersey avenue, where it shall be laid as hereinbetore provided for, (on the east side). ‘The sixteenth section prescribes that the Com- pany shall have at all times free and unin- terrupted use of the roadway, and provides that any person willfully and unnecessarily obstructing or impeding the passage of the cars, or shall destroy or injure the cars or other property shall forfeit and pay a fine ot five dollars for each and every offense, and shall remain liable for any damage occasioned by the act, provided the suit be brought within sixty days. Mr. Wilson also read portions of the Corpo- ration Jaw in relation to hackney carriages, quoting the section providing for the Mayor to establish stands, in which is a clause that the carriages, if in front of any building, shall stand at least 15 feet from curbstone, and also rovides that the driver shall not leave his xX or reins except in the hands of some other person. He would content himself with call- ing the attention of the justice to the sections read, and he could determine the law. Mr. Davidge acknowledged that under the charter the company bad the right to run their track along the east side of New Jersey ave- nue, but did not they lay the track subject to the rights of the people? He was at a loss to know who had brought the suit, and if any transgression of the law had been committed it was not sgainst the corporation. The omni- busses and hacks were there, according to cus- toin; and in accordance with the regulstions adopted by the Board of Police Commission. ers, when the whistle of the approaching train blew, they were backed up to the curb. Mr. Davidge contended that it was ungra- cious for the company to attempt to destroy the business of these men. The company had Jaid the track subject to the ordinary travel and inconveniences, and by the charter they Were not obliged to invade the domain of these men. The track was laid within twelve feet of the curb, with the object of securing protits which would otherwise accrue to others. The company had no right to make a stand in front of the depot. They are allowed tostand just long enough to take in or putont passengers; but instead they had erected In front of the de- pot a barricade. He asked if these men had obstructed the street more than to take in or letout passengers. The grant to the company was simply a grant to occupy the strert in common with the public, and did not give them a monopoly. The case, he said, was bound to find its way in court.
