Wallach, Esq., Moyor, ¢c.— Sir: I bave to report toyou the resultof the case of Henry Turner against the Corporation, for injury received by hin in pasting along the south side of E street north, etveen 17th and 15h streets west, in Octover, 1863. 1t appears that that portion of F. street war graded and gravelled, and the sidewalk erad+d about 15 years ago; that for several years past the water coming down the east Side of Ikth street has been turned down the borch side of b until itmeets with the water draining trom thesquare on the north side of ¥ etreet, aud near the middie of the squire where it turns and runs across E street ob- liquely, and thence through the next square to the low ground. In its course it has rendered the ttreet almost impassable, and cut the side- walk on the south side so as to forma gulley ber ween 4 and 5 feet deep. There was no light or auything to gnideor protect persons passing there in the pigbt time. Turner was passing on acark vight, fell in, broke his leg, aud oth. erwise injured himself, and for this the jury bas given bim $5,750 damages with the vosts of tresuit. The case of Stansbury, decided at this court in tavor of the Corporation, was of a similiar character, but there was room in that case to insist betore the jury that Mr. Stansbury was chargeable with negligence, and the jury took tbat view of it. In Turner's case there was no such detense, I cunuot too earnestly press upon the atten- lick of the corporate authorities the necessity of some ljegisiation, and the enforvementof it, to provide guards wherever there is au open- ing of any kind either in the sidewalk or the cui riage way of a street, however apparently triviel it may be. There are now penaingtwo (ther suits for the same causes,and I have alreacy been notified of athird In passing along many of the s'reets, especially those in which the Metropolitan Railroad Company is now laying the track of its road, we constantly meet with horse and carriage and man traps, wi:hout the sjightest guard or any sort of warning in the day-time and without a light al night. Itis true the corporation may have its rem- edy over againet the person or company cre- ating the nuisance, but that remedy ts remote and uncertain, while the reproach and dis- credit falls upon the corporate authorities. It is obvious, too, that the existing police regula- tions on this subject are disregarded and most imperfectly entorced. And this cannot be ex- cused by the conflict of authorities and the police board, for each has large powers to pre- Ventand remove nulsences, which may be ex- ercised wholly independent of the other. These powers are already large enough, if energeti- cally exercised, to abate many of the evils ansing from laying pipes aud sewers and digging cellars, areas, &c. But there is alarge cluss of cases con ing wonder the building regu- lations for which bo provision :s made, such as the roods or curbs for cellar windows, en- trances into basements, cellars and areas, erec- tions of sce ffoldings, the placivg and transpor- tation of builcing materials, the grading and paving of eidewalks, &c., Which requires prompt legislation and vigorous execution of the Jaws when passed. The duties of the commissioners of the wards embrace muny of these subjects, and they haye powers which iegitimalely and firmly exer- cised will remedy tome ot the evils. Jsut they do not reach the extensive and nu- Irerous nuisances created by the railroad co:m- pany, by which the streets are made not only Gargerous and almost impassable by reason of the excavations they make and the dangerous carriage traps they eet, but also by their de- posits of soit mud taken from one street and dumped into apother. To return to the first purpose of my letter, I ~oyeat that l hope the Councils will on Mon- day tuke some siepin respect to Henry Tar- ner’s case, aud remain yery respectfully, Jos. H. SINGULAR CRIMS.—A_ curious case before the United Ststes District Court, which was in session in Anburn, New York, last week, was that of Lyman North, a Postmaster of Allegbany county, convicted of removing eslamps from letters dropped in his office and then destroying the letters. The remarkable thing about this petty theiving is, that North is about 60 years of age, is worth $21,000, and previous to bis detecuion has borne a gool character. He pleaded guilty and was sen- tene+d to s'ay inthe Rochester penitentary one year beside paying a fine of $2,000.—Altamy Argur.
