Spauiding and Wm. Rapley against E. J. Hall and Z. D. Waters, which is just now very important, as it defines the law oflandlord ani tenant. The case came up on @n appeal from the decision of Justice John. 50B, ADd was argued at length by Mr. Walter $. Cox for Messrs. Spaulding and Rapley and Mesers. Bradley and Bradley for the defend- cision. — Yesterday, The following are the facts in the case:— Messrs. Hall ind Waters held possession ct the the northeast corner of intersection of west 15th and north in’ Washington building situated at unexpired part of a term for tnree years, created by & lease under seal, and ending on the 30th cay of June or Ist day ot Jaly, A D. 1564. About the i6th day of June Mrs. Scott executed snd delivered to Messrs Spaulding and Rapley a lease under seal for the above premises for & term of five years, beginning upon the Ist day of July last. quit was served upon the genamts in posses- sion, nor any act done by them recognizing Spaulding and Rapley as their landlords; but jon after the expiration of their term until the 3d day of August next ensuing, when they were duly summoned, upon complaint of Messrs. The landlord might enter upon the premises and remove Bim and his goods therefrom, and no action of trespass could be maintained inst him for 80 doll It will be eeen at a giance, therefore, the di tinction between the tenancy mentioned in the first section and described as 8 “holding by con- tract or lease the terms of which have expired,” and & “holding over by wrong atter the determina- tion of the tenant’s interest.” The former, I think, means a holding over by the express or implied assent of the landlord, and would. in the absence of the present statute, constitute a tenancy from year to year. The latter is a mere wrongful holding in opposition toand in defiance ot the will of the landlord. The dif- ference between a holdingover and & wrong- ful holding over is too manifest to require il- lustration. This construction of the first section harmo- nizes the first and second sections, and makes o consistent with iteelf and with each other, The second section proceeds to enact, in sub- stance, that when a tenant holds possession without right, after the estate is determined by the terms of the lease by its own limitation, that is where, by the agreement of the parties, the tenancy is toend on a particular day, and the tenant hold over, the landlord may do what! grve notice? No. He may, on written complaint en oath to a justice of the peace, have a summons Issued, &c. This section also prowess that when the tenant holds overafter is estate has been determined by a notice to quit or other wise, the landlord may make com- plaint, &c. In other words, the manifest mean- ing and intent of the second eection is, that whenever the tenancy ends, if the tenant does not quit the premises, the landlord may insti- tute forthwith this summary proceeding before & justice to obtain possession. The tenancy ends when the period for which the premises are leased expires. If the parties make no agreement as to the length of time for which the premises are leased, the tenancy may be ended by @ notice of thirty days, if such tenancy was created subsequently to the 4th of July, 1564, If it was created before that time, and is still subsisting, it can be ended only in the manner prescribed by the law as it existed before the passage of the act last mentioned. One other question of some importance is raised in this case, as te what person or per- sons are entitled to resort to this sammary proceeding to recover the possession of real estate. The first section uses the words land- lord and tenant, but the second section drops the word landlord, and says “on written com- plaint on oath of the person entitled to the pr>m- zses,"’ application may be made, &c. If this language be understood in its broadest accep- tation it would seem to imply that any one * who had a legal title to the premises held by the tenant, might institute thissummary pro- ceeding to recover possession, whether that title was derived from the actual landlord or from some other source. Obviously, that can. not be the intent and meaning of this language; for if €0, it would at once subvert the common law action of ejectment, and substitute this summary proceeding in its place. The use of the words “person entitled to the premises,” instead of the word “landlord,” as in the first zection, evinces an intention on the part of the legislature fo extend this summary remedy beyond the actnal lessor or landlord, The true intent and meaning of the Legis- Jature was (I think) to extend this remedy to all persons, who, by the aet of the lessor or by operation of law, were placedin the same re- lations to the tenant as the original lessor, to wit: the grantees or assignees, devisees and heirs at law of the lessor. If this construction of the statute be the true one, it follows that these complainants cannot institute this summary proceeding against the defendants inthis case. They are not grantees, devisees or heirs at law of the lessor of the premises in dispute. They certainly are not the landlords of these defendants. Before the expiration of the term of the tenants now hold- ing over, the plaintiffs or complainants ob- tained from Mrs. Scott, the lessor of the de- fendapts, a lease of the premises forthe term of five years, to commence at the expiration of the defendant's tenancy. No relation, there- fore. of landlord and tenant ever sabsisted be- tween these parties by express contract or by implication of law. This exposition of the statate will confine its provisions to what is its declared purpose, viz: to regulate proceed. ings in cases between landlord and tenant. ee, A Novelty IN THE MARERT.—The first Oysters from the Sturgin Bar, Rappahannock River, since 1961.—T.
