Ladies fond of good singing now have an ex- cellent opportunity to gratify themselves, as Bome of the best singers in the protession ac- company this troupe. oo Aw Important Decision.—The caso of M- ‘Thompson, agt. Thomas F. Bowie, was before the District Supreme Conrt, sitting in banc re- cently, on a bill of exceptions, from the raling of Ohief Justice Oartter, who held the term of the Circuit Court, at which the jury returned a verdict for the defendant. This suit was brought to recover the amountof three promis- ory notes made by Bowie on the Ist of January, 1557, tor $1,000 each, payable to the order ofone Frank Steers, frem whom the plaintiff pur- chased the notes. The defense was, that each of these notes ‘were given for & gaming consideration, and they were therefore voidinthehands of even bona fide boider fcr value. To make good : this defense, the counsel for Bowie were able only to introduce circumstantial evidence, which was in effect that Sieers, the payee ofthe notes was & common gambler, and at the time the notes were given was the keeper of a gam- bling house on Pennsylvania avenue, and that de bad no other business and was possessed of mo property. They also showed that the body of the notes were in the handwriting ot John R. James, another common gambler, and a habitue of Steer’s establishment, and that there ‘was another note made by Bowie of a like Amount and date, made payable to the order of John Campbell, another gambler and em- ployee of Steer, to dealfaro. They also proved | thaton the day of the date of the notes that | Bowie was grossly intoxicated and entirely unfit for any business whatever, and that when | ‘under the influence of liquor he had a propen- sity and habit which he could not control, to habituate gaming establishments and play at thelr games. The plaintiff objected to the ruling of Chief Justice Cartier in admitting this evidence, and by bilis of exception the case came before the court in banc, where it was argued by Mr. R. J. Brent for Co!. Thompson, and Messrs. Wal. ter S. Cox and S. L. Phillips tor Gen. Bowie. The opin:on of the Court was delivered py | Qhief Justice Cartter, as follows~ | The proofs in reference to the defendant in | this case, Bowie, being intoxicated, was that he | ‘Was irrational under the influence of it. In the case of insanity, it would be pertectly compe- tent to prove the idiosyncracies of the in ane person when he was in that condition. Why not when reduced to the eondition of tempo- rary inebriety! In reference to the action of the court below, in refusing to take the case away from the jury, the members of that court had no doubt that the circumstances were amply sufficient to justify court in so doing: and as Tegards the verdict, he would say that from the character of the evidence it would have been a Tefiection upon their intelligence and honesty had they not rendered just the verdict they did. As to the pciot taken that the plainuff in this Action stood in 4 different position from the payee ofthe note, that court could not per- ceive the distinction. These notes were con- demned by the law and had no yirtuein the hands of the endorsee. ‘What would have been the proof if this man Steers had been in court instead of Thompson, and he wished for the credit of the bar that it bad been. This case, he said would then be presented. Bowie, a member of Vongress,a Member of the bar, apd @ man in repatable atanding is reduced on a festa! occasion to in- ebriety so as to deprive him of all reason and judgment. He is seen going through the streets in this condition at two o’clock in the morning and that is the Jast heard of him, until the next day, when three gamblers are found in pos- session of his notes to the amoant of 24,000. It had been argued that the law presumed they were given for a valid consideration. That was true, but that presamption was un- der the rule of the circumstances. Thecircum- stantial evidence in this case, if it went no further, went far enough to pat the plaintiff upon explanation, and the fact that this case bad been pending five years, with all the facil- ities of a member of the bar to secure the proof requisile to illustrate the true consideration of this transaction, his failure to do so,in the opinion of the Court, authorized the conclusion that the notes were given fora gambling con- sideration, and Thompson knew it. These were the convictions of the Court on the subject, and be would say, as tar ashe was concerned, that he never did a judicial act ‘Witk greater cheerfulness than to affirm the | judgment of the Court below.
