Dacteion.—Judge Wylie hss delivered an opinion in the case of the United Statee agt. the property of Wm. Shields, seized under ¢ rovisions of the condscation act of July 1%, which presents eome interesting legal points. Shields, it appears, was a native of Virginia, and resided here up to about April, 1561, when he left the city for Richmond, Va, where he remained until Augnst, 1562, when he made his appearance in Battimore. His peerer iy. here being seized, he defends it, and alleges that as he hus done ne treasonabdle actsince the passage of me comfiecation act, his property should not be Fold, The opinion of Judge Wylie states that Shields was rvidentiy an enthusiast in the cangse of the rebellion, and in April, 1862, he abandoned his residence and fled with other traiters to join the enemies of his country at Richmond, leaving his dwelling in charge of his sisters. During bis residence in Richmond he kept up a correspondence with his friends in this city, through the mediuin of the British consulates there and in New York, when the covers were taken off and the letters forwarded to their addresses. In a letter to his brother in Vermont, dated Richmond, October 1°. 1861, Sbields usee the following language: “«@ur Army of the Potomac is in three col- umns. Gen. Jos. E. I. King, the Warden of ihe Penitenwary, started for the Albany Penitentiary with three prisoners, sentenced at the present term of the court: Thomas Bowie, convicted of the lar- ceny Of & coat, and sentenced to two be eabad Joseph Dean, convicted of & similar offense, and sentenced for three years: and Mary Haw- Kine, convicted of larceny, and sentenced to one year. Bowie and Dean are both colored, and about & week since &tiempted to escape from jail by Turning past the guard, who fired at them aad brought them up. The prisoners have heretofore been cent to Albany—since the penitentiary of this District has been taken poseession of by the Govern- ment—by the Marshal of the District, but the late law passed by Congress for the appoint- ment of & warden to the jail contains a clause providing thatthe prisoners convicted in the courts in this District, and sentenced to the penitentiary, shall be taken to Albany by tha warden of the penitentiary.
