Mr. Marbury appeared for the pros- ecution and Mr. G. E H. Day tor the defense, There was quite a large crowd of persons resent, among them a number of triends cf emas. The first witness called was Mr. Charles Han- cock, (cond uctor,) who testified that Lemas and his panion got on the car between Green aud Washington streets, Georgetown, and he told them thet there wasa colored car behind, when they asked if they couldride on the front platform, and witness told tzem they could, when they got off and went to the front. The car was stopped at 2ist street, and witness thought the driver had stopped fora passenzer. ‘The driver met witness inside ths car and in- formed him of the bad conduct of the colored men. Witness went forward, when the negroes got off, and one of them threw a stone and the o her fired a pistol and ran. Witness pursued them, and while doing so the pistol was fired again. The driver called to him to come back, cs the parties were armed, and he went back to the car. Question by Mr. Day.—Did you order these men cff the piatform {| Mr Marbury oijected that the question was irrel- vant, and the quesiion was overruled. The crcss-examination was continued, when Witness stated that he did not tell them to get off the bind platform, but told them to get on the front platform, and that there was acolored ear bebind in which they could ride if they wished. Witness did not say that they could ride inside his car. Mr. Day asked if there was nota rule ef the raiboad company probibiting colored people from riding inside of certain cars. Mr. Marbury objected that the railroad com- pany was not on trial. ‘The objection was sustained by the justice, and the question overruled. Mr. Hancock resumed.— Witness stopped the ear for them to get off and go to the front plat- form, and he subsequently went throngh the ear and collected their tare. At Yist street, when tne driver stopped the car and informed him cf the trouble, witness went forward and asked who was cursing him. One or two of the passengers said + put them off,” and when the negroes saw that the passengers were ex- cited, they got off, and owe of them threw a stone. Atthis time the car was stopped, and the parties were getting off as witness was | going throughthecar. Witness had nothing in his hand, but threw a stone at the parties after he got off. The stone he threw weighed enough toxnock amen cown it it struck bim on the head, but | witness did not throw it until after he was thrown al aad fir . The shot was fired by the man between the car and curbstone. Wit- ness hes been on road five or six months, but has been a cond Janes Stenton, (driver of car No. 2, that these men got on the resr platform of the car at the Union Hotel, and on the front plat- form atGreen st. The Ww man (Bailey, will have an exam: mn this evening) t Lemus, + rley,3ou went backon me.” Le m: asked «+ Why so !?? when the other replied, ou ought to bave staid on the hind part of the car, and not Ist the s—n ota b—nh pul us off. Lemas said “let’s get off and t tor the next car, and have some fun,” and theother answered that “this is thecar we onght to fun on; we ought not to have got off for s—nofab—h.” Lemas said «I’ve gota bull dog here in my pocket,” and the other replied «I’ve gotone and know how to use it.’ The man said he + knew how to useir, (the pistol) and will use it till I have my rights.” Wit. ness stood this conversation for some time, and when near IT wenty-first street, he stopped the Garand weutin and told the conductor what had passed. Hancock came around on the left hurd side of the car and asked “ Which one.” The accused were cn the right hand, and ancther man on the left. Hancock graboed at the innocent man, and witness said + Don't touch him, he is not the one: he has nothing to do with it, but these are the two,” pointing io the accused. As witness was making these remarks, the parties got off, and Lemas pu: his band ‘to his side pocket, as if take something out. The other one (Bally) picked up aston? and threw at the car, striking it, (objected to by Mr. Day, on the ground that the act of tae latter have nothing to do with the case.) Han- cock started towards them, when Baily athim. Witness noticed Baily particil but dia not see Lemas either fire a pis! throw 2 stone. Two soldiers started ia pur- snit of the negroes, and Baily fired again, 2s he stumbled against the fence; and as they both ran, Baily fired a third time. By Mr. Day.— Witness is certain that three shots were fired. By Mr. Morbury.—The negroes were noisy on the car; cursing at the conductor. Henry Burgoyne, colored, testified that he got on the car ait Washington street, about 10:4 o’clock, and in a few moments the two colored gentlemen got on the rear plattorm. When they got on, the conductor was taking witness’ fare, and after he received it he went back, Tang the bell, and the cur was stopped, when they got off and went to the frout. As they | came up they passed remarks on the conduc- | tor, and witness understood Baily to say to | Lemas, “Do you see the Ampude: ot that | man, he rang the bell before I could get on; he ought to have his d—d head knocked off. I'm ahellof afellow tor my rights. Lemas, I’m down on you.” The latter asked what for! To which Kailey mumbled something in reply which the witness could not understand; put heard bim say, + Never mind, G—d d—n ain, it will all be right.” By tbis time the car neared 2ist street, when the driver stopped, and opening the front door said, “Obariey, taese niggers are out here abusing you, and calling you everything.” The conductor rushed through the door and raised his hand to strike Witness, when he (witness) said “dont bit me, I’ve got nothing to do with it,” and the driver spoke up, + No,that man is notin fault, these are ie two uiggers” (alluding to the others on op- posite side,) Bailey then jumped off and Lemas remained on the car, when the conauctor stracx him (l.emas) aud bis bat feil of. Lemas then jumped cif and ran towurds the tence, he con- ductor and three or four others following him, saying kill the black s—ofab—h. One of them threw petome which missed Lemas. Lemas gtumbied pear the fence but did not fall, and at | the seme fime a pistol went oif, but in the di- rection towards which Lemas was going. The men mapped periectly still when tne pistol went off, and Lemas on recovering fired towards them, and botu parties run gown 2ist street. | The pariies came back to the carand they wouid Dave knocked Rim in the head if it had not have been for the driver. Witness only saw one s'one picked up and that was by one of the pursuing } arty. f By Mr. bay.—There Were but two pistol shots fred. The prosecution here closed, and— M. Fh was sworn for the defense. Mr. Day asked witness to state whether Mr. Hancock had not driven other persons from abe car on which he is conductor, + Mr. Marbury objeetedio the question as ir- televart. Mr. Day stated that he wished to show that the con ductor (Hanceck) is 2 quarrelsome man. and that he bas freqaently dnven people from the car withour just cuuse, rt The Justice sustained the objection, and the question was overrdicd. ” Mr. Day asked witness if he knew the rales of the company in to colored. people Tidipg im the cars, | Mr. Tay contendéd‘that it was not shown by the evidence that the seeused fired the shot, and reterred to the charter ot the company, stating tnat the company had no right to refusg | classes of persons to separate cars. | Applied by all Bair Drosrer to carry any person on account of color. The Senate committee, through Senator Willey from a siave State), had decided this question. fhe conduetor alleges that he was carrying out the rules of the company; buthe was not bouad to do anything he knew to be wrong or against the charter of the company. The conductor had po right to put them off, and they had a right to ride; and, in conclusion, he argued that the acsauit, if any had been made, was com- TMitted in self-defense, and therefore the accused shouid not be held. Mr. Marbury said that the question of ex- cluding negroes from the cars had ngthing to do with the case, but if the gentleman wished to argue that question he would meet himany- where, and would prove that the railroad com- pany has power to confine the travel of certain It wasa custom here thatthe colors should not mix, and that custom was law. Even in Boston, the very nest of abolitionism, the ratiroads rua cars expressly for colored people to keep tha colors separate; and the 7ribune, a short time since, had 8 Jong article about the ejectment of a colored seldier from a car in New York city. Mr. Day.—Every day you may seetwo white men in a colgred car in this city where you wiil see one black. Mr. Marbury had no objection to white men riding in colored cars, if they chose so to do. It Mr. Day is willing to sit between two buck éarkies he had nothing to say about it. Mr. Day replied that he would sooner ride between two colored men than two whisky bloats. Mr. Marbury continued, contending that the | evidence in the case showed at least that Les mas wis an accessory. Justice Kinsey announced that he would hold the accused to bail in $1,000 to appear at court. R.H. Booker became his bondman. eg A STEAMED SOLDIER !—On Saturday a sole dier, who was perambulating the streets of the Sixth Ward, espied the patrol making towards him, and not having a pass, he undertook to dodge them by entering the cellar of Middle- ton’s popular restaurant. Here he found him- self amongst the apparatus used for steaming oysters, and seeing the box in which the oysters are prepared, he jumped into it and pulled down the lid, which, fastened with a spring. The guard followed, and tailing, after a“ close search, to find him, they proceeded on their reunds. About this time the colored man who attends the steamer came down and turned a full head of steam on, which, of course, put the soldier into a sweat, 9nd as soon as he comprehended the position of affairs he yelled and kicked lustily for help, and, as the heat | increased, made such a pother inside the box that the darkey, nearly frightened out of his wits, leaped out of the cellar at a bound, shonting that “the d—1l was in the steamer!” Some other employees of the establishment, summoned by tle vigorous yells of the soldier, persvaded the negro to open the box, but he could only be persnaded to make the attempt by the aid of a long pole, with which he lifted the catch; and“the moment this was effected the soldier bounced out, dripping with steam and perspiration, and, without pausing to render thanks for his deliverance, he sprang up the steps and was off with the speed of a scared rabbit. He will probably think twice before jumping into an oyster steamer again to dodge the patrol! ee CENTER MARKET.—The prices this morning were :—For Beef, best cuts, prlb.20925] Canvasbacks, pair next Sa18} Blue wing d salt... 10) Widgeon dried - 18820) Mallard veal + .-18a20 | Broadb Mutton, best chops. .20a25 | Sweet potatoes, pk Lamb, perar..... 1 : 0 Celery, per bunch, Pork, fresh. ner is.. 16a18 Onions, per peck. 75: 3 corned. «+ 15] Turnip: Seacon.hams,uncut,.l7als| Carrots... hams, ed .20n25| Beets. . 50 breasts.....2° 15|Beans, butter, pr at.259%0 shoulder 13 white a2 oles... 10| Lettuce ... + 5al5 5 ard Is Cabbage, per head _. 5025 Chickens. pr pair.$1.50a2 Raddishes, bunch... 5a10 Eggs, prdoz . 25030) Lareerock,each.... $3 Butter. prib 40245) Small rock, pr beh 50 40a50| Halibut, 1b’. 20 80a. gecombers. kra, per Chesnuta> Cranber 5, Lobster, per Ib 12 Wildturkeys, each. .@2a4 Catfish, bunch 25 Grey squirrels 15 Rye, pr bushel $1.60 Prairiechiekens pr, €1 Cora meal bal 35 Hominy, perat 10. The first sensation is nsually a feeling of dryness and heat in the. nose, and a frequent inclination to sneezing: There is am inability to breathe freely, as the nose becomes stopped up, femetimes on one side, sometimes on the other, Soon a clear watery, acrid discharge makes its appearance, excoristing the nostrils, and edges of the lips, which becomes red and some- what swollen. Aftera few days the discharge becomes thick, yellowish, extremely frequent, and continues to be # marked feature of he dis- ease, and a source of much danger and the greatest annoyance. After more or less time, it becomes purulent, highly offensive, and as- sumes an extremely fetid odor. It is usually 80 profusé as to require, when confined to the nose, the frequent application of the handker- chief, or if it drops into the throat, which is more particularly the case while the body is in ® horizontal position, constant expectoration, and sometimes both. Sleep is frequently disturbed by a sensation of choking, caused by the presence of the dis- charge in the throat. Owing to the heat in the head, the watery portion of the discharge often evaporates, and assuming a condition of solid- ity, is deposited upon the membrane of the nose and upper part of the throat, in the shape of crrsts or hardened lumps. The accumula- tion of these incrustations producesa feeling of discomfort, and narrows the nasal passages so as to embarrass respiration. Therefore, fre- quent efforts have to be made to remove them, either by forcibly blowing the nose, or by per- sistent hawking—a practice as disagreeable to the one affected as it is to those around him. After the removal, that side of the incrustation which adhered to the mucous membrane wiil fometimes be found bloody, a fact which ex- plains the force required for its dislodgment During sleep there incrustations accumulate more rapidly, and the feeling is therefore most uncomfortable in the morning. Sometimes all efforts to clear the thront are futile until after breakfast or after something warm is swal- lowed. Some patients state that they are not successful until they have swallowed some whisky or brandy. The discharge, which is at first without smell assumes in the progress of the complaint an excessively fetid color, the breath participates in this, and becomes occasionally so revolting- ly offensive as to render the patient an object of disgust to himself as well as to others. Ul- ceration of the mucous membrane of the nose takes place frequently, sometimes even attack- ing the bones, when small particles of that substance will occasionally be found mixed with the discharge. ‘bhe accumulation of the discharge, together with the thickened condi- tion of the mucous membrane, renders respira- tion through the nasal passages very difficult, and oftentimes impossible, necessitating res- piration principally through the mouth—a methed very deleterious to the general health, but more particularly so to the lungs, as will be shown hereafter. The unpleasant noise produced during sleep, known as snoring, originates from the same cause. The voice loses its musical quality, and assumes a dis- oordant, harsh and nasal character; the sense of smell becomes much impaired or entirely lost, and the same effect, though less frequent, is produced on thesenseot taste. Occasionally, while blowing the nose, a crackling or bubbling eound will be heard in the ear, and hearing will be found quite thick and stopped up, but returns suddenly with something like a snap- ping sound. This phenomenon is usually repeated until at one time, hearmg does not return, and remains permanently injured. Noises im the head of every conceivable description will make their appearance and add to he distress of the suffe’er, and hearing may be lost so gradually that a considerable ee of deaf. neas muy exist before the person is really aware of the fact. The eyes are apt to become weak, irritable, and disposed to water on ex- posure to cold and wind, or after the slightest exertion. A pain, more or less acute, or a dis- tressing feeling of pressure, is experienced over the eyes, and sometimes on the top or back of the head, and also pain in the face, closely resembling neuralgia, for which it is very often Mistaken. The distress in the head weakens the memory and produces irritability and moroseness of disposition. The stomach gen- erally suffers more or less, is weak and irri- table; the appetite is capricious, and is nearly always bad in the morning. In severe cases the system becomes feeble and prostrated, and there is an aversion or inability to either phys ical or mental exertion. Not unfrequently catarrh proves fatal, either by debilitating the system and weering ont the patient, or by traveling downward and producing throat affections, bronchitis, and finally consumption It may be safely asserted that after hereditary predisporition, catarrh is the most frequent and important cause of this fatal complaint, Dr. LIGHTHILL can be consulted at the Exsitt Hovsr, Washington, from Monday morning, February 29. until Saturday evening, March 5, on Catarrh, Deafness, and alld of the Ear, Th LOST AND FOUND.
