After a patient trial you have been copwicted, and it only remains for me to pro- * nounce that sentence which the law has pre- scribed as the punishment of the crime of which yon have been pronounced guilty. Have you aught to say why the sentence of the law should not now be pronounced upon - out Hendricks, with a tolerably firm voice, re- pie thet on the occasion he was drunk, and new nothing of the murder till ne was told of ’ it the following morning. The tria: ed, was an unfsir one, and he alleged that seme of the witnesses perjured themselves. He commented pretty freely on the character of some of the witnesses; some of whom, he saic, would swear a man's life away for a drink ot whitky. He said that he had had a > good character, which was more than some of , his accusers could say. The Court —I regret to hear, Kendrick, from ae ee = sa Pesition you do, the” abuse which you have hea: upon Shanahan, , his wife, and that utile imag me a Prisoner.—It is nojhing but the truth, sir. The Conrt—!t would seem that you had brought czlamity enongh upon that little house. hold to restrain you from any exhibition of temper towards that family. I do not know in what respect you claim that you have not’ | had a fair trial. The jury was the jury of» your choice. Every man called or drawn on the jary, whom you or your counsel was dis. pesed nctto have onthe jury, was set aside. A patient examination was had ot all the wit- nesses, and the evidence appeared so clear, so entirely satisfactory, that there was no pos- sible escape from the conciusion at which the jury arrived. You say yourself that you were unconscious of what you were doing even- ing. How, then, can you impute any want of truthfulness to the facts ‘testified 18 by Mrs. Sbarahan and the little girl. Do not, I be- seech you, harbor that feeling any longer im your breast. Few murdersin the annals of crime, so far as my observation has extended, equal in brutal terocity the one of which you have been clearly proven guilty The only provocation we know or could learn for this most foul and cruel murder was the controversy in the early part of the evening between you and the deceased, in which some avery werds passed between you. You haying purchased a stove of Mrs. Connor, the tehant ef the deceased, and who was owing rent to deceased, the latter claimed the sale to yon was void by reason of his iien or claim upon the stove as a security for the payment of his rent. Shanahan threatens to follow the stove and compel you to bring it back upon the premices whence you had removed it in pursuance of | your purchase. Some other words foilewed, indicating @ purpose in shanahan to follow (he stove the next day, and en your part of inflict- ing vepgeance upor him if he did so. This conversation and mre‘ing be:ween you and Shanshan appears to have ‘aken place be- tween § and 9 o'clock in the evening. The next we hear of you is bet ween the hours of li and iZo’clock at night prowling abont the bouse of the deceased und threatening his life, You are there met by Owen Sullivan, who urges yon to accompany bim to his room and go tobed. You follow Sutiivan to his room, and within @ short time thereafter draw from its Scabbard the knife with which it seems you had armed yourself atter leaving Mrs. Gon- nor’s, 4nd then to Sullivan avowed your mur- derous purpose of plunging that knife through Shan- ahan's tody that night, You have since, doubtless, often thought of | the prophetic reply that Sullivan made to that | threat of yours, «It you do you will hang for | it Do youremember your bratal reply to his Teenay, admonition! «I don’tcare 4 damn if ; 0.” Heediess of the admonition of your friend Sullivan, you leave bis room and r. pair to the house ot your victim: you call him to his door, | Gare bim into the street to fighsyou. Such in brief is a history of the awful trace. dy which is soon to consign yor toan igno- minovs death—a death upon the gallows. The lnw that demands your life tor the offense of which ycu have been convicted, doubtless seems toyou harsh end cruel. But it is le: bareb and cruel to than you were to your fel- Jowman. The law will give you some brief ~ cays to live, which may be employed by you in preparing for that great change which awaits you. You, on the contrary, sent your victim ont of this world in a moment, without notice or warning. Do not, 1 beseech you, spend those few brief d«ys in the vain hope of reprieve or pardon. ifever there was @ case in which the divine or the buman law which declares that «whoso sheddeth man’s blood, by man shall his blood be shed,” should be executed, yours is that case. I repeat, do not waste the few precicus moments of your remaining lite in the delusive hope that through theimportunities or exertions of your friends the iguominious death which awai's you can either be averted or delayed. Ereparey then, as best you can, to meet that ath. The sentence of the Court is, that on Friday, the ist day of April, between the hours of [2 and 1 o’clock of that day, you, in the jail or in the court yard of the jail, be hanged by the neck until you are dead; and may you meet that mercy which the laws of your country so justly deny to you. Hendricks then remarked that they coul@ ‘take away his life, but not his soul,” that “God’s body was put to death.” During the remarks o! the Court the prisoner was seen ta shed a few tears, but at the conciusion he walked briskly back to his seat, coolly took a quid of tobacco, and engaged in conversation with those prisoners near him, and with his rie, who was standing at the back of the cok. Emanuel Pollard, a tall, good-looking col- ored man, convicted of the murder of George Butler, was then called ont, and took his stu- ticn Im the center of the room, as Hendricks had cone, and on being asked if hé had any- thing to sey why sentence of death should ~ot _be passed, he reptied that he was not guilty of the crime, having been in bed at the time of the murder; and strenuously aseerted that he was innocent. Judge Olin addressed him, after reviewing the testimony, all of which was circursstan. tial, but which pointed unerringly to the pris- oner, on the enormity of his crime, aud im feel. ing terms advised him to prepare for the fate which awaits him, and not build up hopes for an interposition of the Executive clemency; closing by passing on him the sentence 0; death, naining the same day for the execution as that for Hendricks.
