SHARP FIGHT NEAR CUMBERLAND GAP The Rebels Repulsed With Heavy Loss. PowFtt’s RIVER Brroce, Feb.5.—On Friday of list week, three brigades of a cavalry corps about 1100 strong, (exclusive of 400 mounted men,) with no artillery, ander the command ot Colonel Love, of the 11th Kentucky, skir- mished with the rebels under Gen. Jones, on the Virginia road, 13 miles from Cumberland Gap, lasting three hours. We held our posi- oon until dark, althongh attacked by superior lorce, We withdrew to our camp three miles in the rear. Atsunrise on Saturday morning Love's pickets were attacked, when Love moved to the front te meet the enemy who was advanc- ing in line with four thousand infantry and cavalry, and three pieces of artillery. Colonel Love then fell back three miles skirmishing all the way, when the enemy ceased following. Colonel Love encamped three miles from the Gap. Next morning Colonel Love sent all his available force two miles in front, and had a lively skirmish with the enemy, charging the rebels and driving them back with heavy loss ; since which time, up tothe afternoon of the 5th, the rebels have not appearedin any force on our front. Our loss in these skirmishes were five killed, eight wounded, and three miss- ing. Captain Newport, of the Sth Tennessee, ‘was wounded in the unsuccessful rebel attempt to take Cumberland Gap. Slight demonstra- tions were simultaneously made from Jones- boro’ and Tazewell roads. All is quiet now in this neighborhood. General Garrard, the new commander at this post, is determined to hold the gap at all hazards. Nothing definite re- cently from Knoxville. The Danish Question. New York, Feb.7.—The following is the very latest intelligence by the steamer Arabia : BERLIN, Jan. 23.—The Danish government has demanded a delay in order to assemble the Rigtraud, and with its concurrence to with- draw the November censtitution, and subse- quently fulfill the engagements entered into towards Germany in 1551 and 1852. In case this delay shoeld be granted, which is proba- ble, the Austrian and Prussian troops will not cross the Elder. A month is necessary for the convention of the Rigsraud. LOCAL NEWS. Se ASS Circuit Court, Chief Justice Cartter—On Saturday the case of Thomas Thompson azt. Alice and Mary Pilling was heard according to argument—Mr. Drury appearing tor the plaintiff, and Messrs. Phillips and Mattingly for the respondents. The facts of the case are as follows: Thompson rented in the year 1559 the premises in question of the Misses Pilling, as a@ yearly tenant. During the past year a six months notice was served on him, to quit the premises at the sl gree of his year, and pre- vious to one month before the end of the year, they caused & one month’s notice to be served in addition to the other, but Thompson refu- sing to comply a jury was summoned under the landlord act of 1793, to try the question whether restitution should be given. At the trial the plaintiff, the Misses Pilling, stated that they were taken by surprise at the absence of & material witness and requested an adjourn. ment Tbis was objected to by Mr. Thompson’s counsel, but the magistrates (Goddard and Barnaclo) adjourned the case. The case was eubsequently tried when both parties appeared and entered fully into their respective cases, and the jury found a verdict in tayer of the Miss Pillings. A writ of certiorari was sued out by Thompson and the record was accordingly certitied by the magistrates to the court. On Saturday Messrs. Mattinglyand Phillips moved to dismiss the writ and Mr. Drury op- posed the motion. The Court decided that the case as presented by Mr. Drury, that it wasa monthly reating, was noteubstantiated by the record or the facts, To pay the rent monthly does not imply a monthly tenancy, but is often done as a conve- nience. It wasnot necessary to decide whether the magistrates had the right to adjourn the ease, as the acquiescence on the partof Thomp- fon in swearing the second jury, :nd the enter- ing into his defense fully on tbe final trial bad waived the irregularity if there was auy.
