Tus StaTuR ov FREEDOM.—The crowning i piece of the “Statue of Freedom,” which sur- mounts the tholus of the dome of the Capitol, will be put in place to-morrow, it is expected, at about fifteen minutes past twelve o’clock, when a figg will be displayed from astaff on the top of the scaffolding, and at the same a salute of thirty-five guns will be fired by a battery of artillery east of the Uapitol, which will be an- swered by salutes from the various forts around the city. Mr, Matchett argued in reply that the cases ! were entirely. different, the conspiracy and assault with intént to.killhaving been subse- } quently developed. 5 Mr. Drury suggested that the conspiracy was art and parcel of the act charged upon the former eximination by another Justice. Jus- tice Rowland ruled that the assault and bat- tery case having been tried,.it should not be considered, and the case now to be considered, is the charge of conspiracy. i Mr. Matchett being sworn, testified to the effect that for a long time the defendants, who occupy part of the house with his family, have ! been annoying him and assaulting his wite anc abusing his family with a view to drive them | from thehouse. Among the aunoyances which he charged lo them was the ty iag aA dead rat to his door-knob, the throwing crement upon his window, attempting to put 1 padtock on his door. He :lso stated that the detendant< came into his room and assaalted his wite, sue being in a delicate condition, and jammed her against a bedstend. Witness further stated that Miss Muhleg said that she would muke hie wife give birth before the time, would kick her out of the honse, throw hertrunks oul, &c , &c. Miss Mubieg a'so, on tie evening atter the Jast assault, met witness’ wile, and said to her, It’s you, isit! I'l give you another dig. Your evidence won't be taken.” Having made his statement, Mr. Matchett called Mr. Alex. Ayatt to testify, who stated that Mr. Matchett on one occasion called him to witness certain things in Mr. Matchett’s house. Witness saw onlya man anda woman, and saw them through a window. Saw nothing tending to aconspiracy to kill; overheard no conversation; can’t say what room they were in. Witness climbed up stairs at the request of Mr. Matchett, saw the man and woman; saw a bottle. Mr Drary. now asked the Justice what wit- nesses testified before him, and being informed who they were, asked a postponement of the case, that he might have the witnesses again brought forward, and have an rtunity to crcss-examine them.
