If it has not accomplished all that was | expecied, the reasons are well known to the army. It is sufficient to say that they were of | @ character not to be foreseen or prevented by human sagacity or resources. In withdrawing from the south side of the Rappahannock before delivering general battle | to our adversaries, the army has given renewed evidences of its confidence fm itself and its fidel- | ity to the principles it represents. Duvall of George, of Prince George's county, as his slave. S Cnef Justice Cartter said that it was impos- siblefor the Court to review the whole argu- ments in relation to the question of human freedom which have been elaborated for the last century, and it was not for the Court to review or pronounce upon the constitutionality of laws passed by Congress which haye here- tofore been decided upon in superior courts. He repudiated the doctrine that they (the Supreme Court) had the right to reverse the opinions on laws already pronounced by supe- rior courts. The Supreme Vourt had decided the laws for the rendition of fugitives from labor to be constitutional, and other branches of the Government—the executive aad lezisla- tive—had held to that doctrine. In the course ef bis remarks, Chief Justice Cartter said that one thing was certzin no man can be arrested and returned to a disloyal master. The institution of slavery involves a nation’s life struggle, and has sent some of Lae best men of the country to premature graves; but the law will be executed, because it is in the bonds. These men who own kind of property are apparently dead to thi of the country, and would give it for a To; al- though there are honorable exceptions. It was not to be disguised that the blood shed is on the altar of this institution. Justice Wylie stated that he issned the war- rant under which the party wus arrested and put into prisan, to await rendition to his mas- ter. A writ of habeas corpus had been sued out, and the questions in volved had been discussed. Although he had issued the warrant, he had come to the conclusion that he had no anthori- ty to cause the maa to be arrested, and thought e man ought to be discharged for want of ju- Yisdiction. He did not'think that the powers heretofore conferred on the Chief Justice of the Circuit Court were conferred on the Associute Justices of this Court. Justice Ulin said his conyiction was that all ywers: heretofore held by other courts had Boon transierred to this court. The Chief Jus- tice of the Circuit Court haa been the properiy designated party to execute the law, and it was to be decided whether the justices of this court possessed the same powers. He would prefer to hear these points further argued. The Court consented to hear further argu- ments on Wednesday next at 3 o'clock. Mr. bites walked away to.calla police- man, when Digney came up behind him, and turning him partially around, dealt him a blow in the face before Mr. Sykes could pre- pare to defend himself; Digney then started away as soon as possible, aided in his tempo- rary escape by Geo, Weaver, also a huckman. Digney and Weaver were arrested atter- wards, and placed in the Second Ward station, and this morning held to bail for further hear- ing this afternoon before Justice Clayton. it seems that Digney. took offence ip the fact that the hotel sends for hacks to the stables of S. C.& E. Wroe, when its guests ask at the office for them. The driver, Geo, Weaver, with whom Dig- ney left his coach, was arrested yesterday, and was carried before Justice Claytou, who jined him $2.58 for violating a city ordinance by running a hack without a number.
