Mr. Sargent remarked that he introduced this resolution hecause the /ntelligencer had ever been considered the official medium for the promulgation of corporation acts. It was the organ of Councils for fifty years, and had always been looked to for official proceedings. &t was taken by many persons abroad merely that they might watch what was done in re- lation to their property and inter-sts. He un- di. rstood that the Tax Collector nad given the Advertisement tothe Ster. He hadno objection whatever tothe Star; but the proprietors of the dniriligenser had long been officially connected With this body. Mr. Gales had been Mayor of the city so long that it was said the National Intelligencer was Mayor. The present living proprietor had also been intimately connected ‘with the Councils. The Intelligencer, too, pub- |* lished the Council _ yen without pay- ment. When -we take this frct into consid- eretion, and remember aiso that so many files Of the Jnielligencer are kept here, he thought it nol improper for the members of the board to express their feelings on the subject. r. Richards said the resolution struck him 38 & novel mnovation, to ray the least. He would be among the iast to say anything de. Yogstory to the character of the /ntellizeacer, but this resolution savors a little of what was offered in Congress some time ago for the ben- efit of that paper. The J/atelligencer hid not ne reader where the Star had ten, and prod- ably twenty. Tax sales should be publish-d in papers having the largest circulation. He thought this resolution an interference with the powers of tv Collector, who was by law, given discretionary power in this matter. The board, by adopting this resolution, would be taking cousiderable responsibility, on account of the limited circulation of the Jalelligencrr. ‘We ought to legislate for the benefit of the people—the people who cannot afford to take 20 =p @ paper asthe Intelligencer. Al- though reference had been made to the gener- ousmanner in which the Intelligencer published the Conncil procerdings, he (Mr. Richards) ‘Would like to have a resolution of inquiry, as | to how much _was paid for publishing these ee It was not natural to suppose ie Intelligencer would publisn them if they were not eomewhat remunerative. He felt it bie duty to oppose the resolution. Mr. Clark also opposed the resolutien. He thought the Collector snould consult the good Of the corporation, and not of Gales & Seaton. He understood that the Star published the tax gales cheaper than the Intel » and that was the reason for the change. The resolution was referred to the finance committee. Adjourned. Crimivat Court, Jannary 5.—Trial of Joh Anderton, colored, charged with the murder of pees Cassidy. — Mr. Carrington opened yesterday tor the prosecution, an: explained the law to the jury, and stated the facts he would the Star at the time of the murder, some four ur five weeks sso) ing negro, abou! twenty-six years of age. He sppears im court very well dressed, and the risoner’s box is surrounded by & number of is colered friends, male and female. Dr. W.J. Newman was the first witnoss called. He testified to the factof making a post mortem examination of the body of deceased, Ho found # fracture on the left side of tho head, at the point where the back and side bones of the ead meet. The external and internal tables Were both fractured. The bones were fractured badly, and grated when rubbed together. It wasa Sg So daae fracture, and one blow had evidently done all, for if two blows had been struck there would have been two exterior wounds. The wound was evidently inflicted by a blunt instrument and death was caused by its infliction. Juha Cassidy, sister-in-law of deceased, was next sworn. i Jaasidy keeps a aod liquor steve on F street, between Eleventh and Twelfth. On the night of November 4th, three red men came to deponent’s house between seven and eight o'clock. They got some liquor and offered a one dollar bill, which witness said was counterfeit. As this party wasleaving, Anderson and a celored companion named Chase came in and got fifteen cents’ worth of ri ai [The particulars of this case were publis' od ta { The prisoner is a goo: look. | liquor, and offered in Eeyseens @ five dollar note, which witness refu: tochange. Ander- son then attempted to strike witness, and she called upon her brother-in-law, who was up stairs reading to a sick man, to come to her as- sistance. Deceased was always a quiet “man, and witness asked him if he was not ashamed to see negroes abuse her. Some of the men had locked the = door and thrown the key away, and she was therefore obliged to put them out the back way. Deceased followed them, and all he said was not to insult witness; and while he was standing under the door, Anderson struck him two blows with a club. Witness then took decrased into aroom and iaid him down, and he died the next morning between ten and eleven o'clock. After the prisoner struck deceased he went out the alley gate, and & short time afterwards came back and pitched Witness out of the door. On cross-examination by Mr. Norris, the | testimony as above was reiterated. Witness explained that she let. the negroes out the back wy because the key of the door could not ba fourd at the moment. Subsequently the key was found, and witness opened the door to attend npon & customer, and it was then that Anderson returned and pitched her ont. Wit- | ness had frequently seen the man that struck her brother-in-law standing abou: Willards’. Witness retained the five dollars, and said she would not give it up until the liquor the ne- groes bad purchased was paid for. Julius Wallace, colored, testified that Ander- son and Chase came into Stephen Talty’s, on E street, between & and 9 o'clock on the night Cassidy was murdered. Anderson carried a club in his hand. He asked for Aleck Moore. came down stairs and tha: he ( Anderson) struck him on the head and had killed the damned Irishman, and that he had thrown the woman William Delaney, colored, testifled that on the same night Anderson and Chase came into Kel- ley’s saloon. Aleck Moore was then getting his head dressed. Anderson remarked that he had knocked the Irishman down and that he had killed him, and onghtto haye killed the woman too. Chase replied that it was enough that they had put her out. Anderson said he struck the man twice. This was between Sand 9 o'clock. Richard Marshall, colored, sworn.—He saw Anderson on the night of the murder at the house where witness kept bar. Anderson said he had a fuss on F street; that some one locked the dooron him, «nd aman came down and struck at Chase, when he ero ea knocked the man down tor dead. He said he went bick afterwards and put the woman on the pave- ment. He said be went in there, and soma other persons were there quarreling about a dollar note, and he asked that some one let him out, when they called the gentieman who was struck down stairs Anderson's excuse was that he had te doitto get out. The prisoner bad the stick in his hands at the tims—a common walking stick. Chase was with Anderson at the ume of this eqn yersation, and both appeared ae il they had been drinking. This conversation eccurred in Steve Talty’s, near Grover’s Theater, where tie witness was employed. Wallace was present and heard the conversa- tion. Prisoner said Aleck Moore was with them and run awny. A. H. Voss, patroimen, sworn.— Witness as- sisted in arresting Anderson on the étfi of No- vember. When he was taking him to jail Andersor said he didn’t care a d—n; that the woman couldn’t swear to him. Taree pulice- men went after him, and Keating arrested him. ‘When Mrs. Cassiday tirst came in the magis- trate’s office, at the examination, she said Uhase was the man, but when she saw Anderson she said he was the man. She said two of the m+n at her house were black, and the rest yefo w. The prosecution here closed. Mr. Norris asked that Arthur Uhase, who is jointly indicted, be examined for the defeace, and it was decided that he was a competent witness. The defence expected to prove that the offence was a justifiable humicide, commit- ted while a riot was then going on, ia which the woman was engaged. Arthur Chase sworn.—Witness went with An- derson about candielight to Mrs. Cassidy's bouse and gota drink, but did not see any one there but the woman. After they had drank he wentto his employer’s, near the market, and Anderson went up Eleventh street. Witness con't know nothing about the fuss when Cas- sidy was struck Did not see Anderson until the following mornirg, nor was he in Kelly's or Talty’s that night, and did not see Dulaney, Marshall or Wallace. The latter came tho next morning with a policeman to the place where he was at work and pointed him out, and be was arrested. Mrs. Cassidy, at the ex- amination, said that he (witness) was the one who struck Cassidy, and afterwards said An- derson was the one. Mrs. Julia Cassidy recalled, (for the defence.) Witness does not know Aleck Moore. Three black men came in her house first, and one of them insulted her, when she threw a weight at him. At that time the door was wide open. John Goss and John H. Stewart testified to the good character of the accused. Ann Shipley, colored, sworn.—Witness saw | the accused on the night before he was arrest- ed at his home, on I street, between Ninth and eee he came home between 9 and 10 o'clock. 3s Stewart, colored, sworn.— Witness lives on the Island, on G street, between Third and Four-and-a-balf street, and the accused, with @& man called Chase, came there aboot six o’clock the night before he was arrested, and staid there until nine or balf-past nine o'clock. A white lady was at the house ai the same time. Mis: Emma Wilton (the “white lady” referred to above) corroborated the preceding witness's testimony. This witness, when closely quos- tioned as to her business, declined to teil. Sho stated that che had lived in the city about ten but had no particular residence. ‘be caze was then, at 20 minutes past 3 o'clock, given tothe jury, without argument. The Instructions offered by the defendant wore acne by the court, and as follows, were anted: wr the jury find from the evidence that there wi in affray at the place deposed to by the Witnesses in this case, and that the deceawd and the prixoner were engaged in that affray, and that during such affray the prisoner struck the deceased with a walking-stick which he had in his hand, without eat previously formod purpore to kill him, the kiliing will amount to manslaughter and not murder. If the jury upon the whole evidence doubt whether the wound whereof the deceased died Was inflicted by the prisoner, they must ac- uit. * If the jury upon the whole evidence haye a reasonable doubt whether the homicide charged in the indictment was committed with malice aforethought, they can convict of manslaughter only. Heydon, in carriages, and escorted the remains to the Congressional Cometery, where they were interred, the impressive cere- monial of the Templars being conducted by E. G. C. B. B. French and Prelate E. L. Stevens. Mr. Heydon was an old citizen, aud leayes a large number of friends to mourn his loss, ae GRAND LARCENY.—Yesterday morning, Jas. Fitzgerald was brought from Georgetown by the Metropolitan police, and consigned to the county jail for trial at court, in two cases of grand larceny. His face was considered a proper one to photograph, to ornament the Togue’s gallery of the police department; and he was taken to the fifth precinct, where tha photographer, Patrolman Rick y, is stationed, and a very good likeness of Fitzzerald was ob- tained for the gallery.
