Oxrnans’ Court, YEsTERDAY.—Tuz Barney Casz, acats.—During the examination of wit- pesses in the Barney case before the Orphans’ Court (Judge Purcell), it will be recollected that Mr. Roach, then Register of Wills, was fll, and unable to attend the sittings of the court, which was thus without aclerk. This being the case, it wag agreed that the counsel should pa rec- ord of theevidence in thecase. The testimony of each witness was accordingly written down by Mr. Fendall, of counsel for petitioner, and Mr. Davidge, of counsel for respondent. The record kept by Mr. Davidge was read over to each wit- for correction, and was thus considered the al record. When the evidence was closed and the arguments concluded in November last, the Court — counsel to furnish for its ex- amination a of the authorities cited, and a certified copy of the record. The record was not —— into court until yesterday. Yesterday morning there appeared in court Messrs. Fendall and Blount, counsel for petition- er, and Messrs. Davidge and Winder, counsel for it. Judge Purcell stated that he had been called on by counsel several times, to know if he had made @ decision in the case; but it was impossible for him to decide without an examination of the ev!- dence, and a certtfied copy of the record had not been furnished him, according to agreement. He ‘was anxious to close the case, but the Court was not ible for the delay. Mr. Fendall stated that ne had examined a cop of the original record = by Mr Davidge, whic! copy was prepared for the court by Mr. Winder, and that he found therein several omissions. He found that the evidence of one witness (Dr. John- son) was omitted entirely. He could not there- fore certify to the copy. He had interlined the omissions, and if the corrections were made would certify to it. After some discussion, in which the counsel on each side disclaimed any intention to delay the case, it was agreed to compare the records at once and come toan und jing 1f possible. Coun- sel then engaged in the work of correction, and after some time an agreement wasfirrived at. No objection was of course made tothe addition of the evidence of Dr. Johnson inadvertently leftout. Messrs. Davidge and Winder then certi tothe correctness of the copy with the addition, and ‘without other corrections. Mr. Fendall certified to its correctness with Ais interlineations. [The discrepancies, it is stated, are merely verbal, and do not materially effect the evidence.) Mr. Fendall then stated that he had received from France, and now presented for the conside- ration of the Court, the French record, properly “Cris is the record of the proceed! sepa- is is the o! ngs fora ral of Mr. and Mrs Barn before the French ea — ay out during the progress of case use it was not proper): aM Devt ; ob; to ue r. fe objected re-open! the case, sien tab Wok ts toe eee ee he would call to the stand Dr. Bigelow, of Paris, Mr. Barney's family physician, who was now here to discredit the evidence of Alexandrine Parfait.
