__LOCAL_NEWS. _ {7 Though Tax Stax Is printed on the fastest sieom prevs In use south of Baltimore, its edition ts so large as to require it to be put to press at an early hout: Advertisements, therefore, should be sent in before 12 o’clock m_; otherwise they may may not appear until the next day. Tus agree let rere Attorney Brad- ley bas replied in brief but conclusive terms to the four-column “ Review” which Alderman Moore with paternal com y gave space to in the Intelligencer the day, in answer to the self- question : ‘« Has the citya legal Mayor?"’ exposing in caustic style some of the many bi: and misrepresentations of this amateur la criticizing bis \wyer bea Bradley's) legal opinion, fir. B. as follows : “Twill not permit myself to be drawn into an’ discussion of the principles of my opinion, whic! the reviewer was either incapable of — bending or bas chosen to evade Personally I feel very little interest in the matter, and this is neitber the mode nor forum for such disccasion. But, as it certainly is of interest to the public to know whether we have a Mayor or not, I will state briefly and distinctly the by which I bave arrived at the result, that we have a Mayor. A “ removal”’ the Mayor from the city, by the terms of the c! . Produces a “* vacancy”? in the office—a »‘ temporary absence’? does not Mr. Berret, being Mayor, was removed (did not voluntarily remove) from the city by superior force. This of itself did not necessarily produce & vacancy; but, es he did not depute the President of the Board of Aldermen to act in bis porary absence The Councils In their journal of the joint meet- ing, state that a ‘‘vacancy”’ has been produced by the arrest and “‘removai from the city of the late Mayor,”’ (Ido not give the whole quotation,) and procred to elect a Ma pro tempore, under the provisions of the cha If they were right in assuming that, under the cffcumstances, his removal from the city produced a vacancy, they of his term.”* as they could, elect Mr. Wallach for the remainder of the term, and thereby exhausted their power. I do not think they were right in this assump- ton. The question now is, was that act void, or onl voidabie? and, if voidable only, by whom an how could it be avoided? My opinion is their act was not void, but was voidable only, and that Mr. Berret alone could make !t vol If Mr. Berret had returned and claimed the office. as he might lawfully have done, he wouid thereby bave put an end to and po cnge Mr. Wallach’s tenure of office from that ime. If Mr. Berret bad continued absent during the remainder of bis term, that election not being void, but veidable only, Mr. Wallach necessarily would have remained in office during the whole time. Mr. Berret did not return to resume bis office, bat, being still absent from the city, resigned: that is, did an act which rendered bim incapable of avoiding that voldable election. He cannot reclaim the office No one doubts that if the Councils accept his resignation his power todo so is gone past recovery. | do not think any ac- — is necessary to make it irrevocable These are the substance of the views embodied in my opinion. Ihave neither heard nor read aes which tendsto shake them. They are at least intelligible and distinct But, as this isa questicn of public interest which cannot be settled in this mode, I venture to Suggest to the author of the review and bis sym- pathizers that there is a remedy for the evils they Pretend to disclose, and it is their duty to seek re- dress in the Court. If they shall do so, I have no pride of opinion to interpose whenever the public a is concerned, and it will give me pleasure in every mode in my power to facilitate and ex- Pedite that remedy. Jos. H. Brapiey, Attorney for Corporation. Cuancs or Lanceny.—Yesterday Mary McDon- d Caroline Reed were arrested by oiticer M. THREE OUR MILITARY BUDGET: ees NEW MEXICO Reports from New Mexico are of a gratifying character. 1 fs known that Col. Loring basely surrendered 750 troops to not more than half the number of Texant, in Arizona. That part of the Territory is therefore in possession of the rebels. As to the remainder of that country, it leeafe in the bands of Union loving who have raised three regiments for its defence, in the event of a raid to seize Government arms and mu- nitions, and otber kinds of property Besides, Col. Canby, who commanded the mil- itary department, bas a regular force of from twelve to fifteen hundred men. Mr. Steck, from whom this information Is derived, further says that just before he left that Territory the Navajoe Indians, through all thelr principal chiefs and braves, made @ treaty of peace. Hence, quiet everywhere prevails. There were no disturbances on the Plains when he passed over them. About two months ago, a trader sold some of the Indians whisky, which was the source of mis- chief. But the trader's wrong-dring recoiled upon bimeeif; the savages helping themselves to about a thousand dollars’ werth of his goods, net stopping to Inquire the price, ner saying anviting about pay. The trader, it was adjudged, was served right; and, accordingly, he failed of ob- taining indemnity. THEIR NEW RIVER BATTERIES, We learn that the batteries of the diftiniontets, the precise position of which down the river were indicated yesterday, are four in number, located over a space of three quarters of a mile, between Aquia Creek and Shipping Point, so as to command some four and a half miles of the channel for heavy ships. We have before noticed the labor of the enemy in their construction. Each of these batteries mounts four or five guns; eleven of them believed to be 9 inch Dabigrens. The portion of the flotilis—the Pawnee, Yankee, and Harriet Lane—tbat went down last night, Will doubtless at once test the capability of these works seriously to interfere with the aevigation of the Potomac.
