Criminal Cocrt —Trial of John Foley for the Murder of Michael Murphy —After our report closed yesterday— Private McGlone was sworn, and testified that Foley was exceedingly abusive in the guardroom prior to the homicide. Witness tried all he could to pacify him, without any effect. Witness never saw bim so bad when under the influence of liquor before as on that occasion. He was restless, Violent, struck the wall with his fist, all without ny apparent cause. He wanted to fight witness, Witness believed Lim to be under a fit of insanity at the time. Cross-examined —W !tnees never saw a drunken man act in the way Foley did. Witness thought proper to keep an eye on Foley all the time he was in there with bim Privates McFarland and Kean testified to the anme state of facts, after which the evidence for the defence closed. Mr Ould called, to rebut— Pet-r Eagan. (Sergeant) sworn —Testified that he saw Foley before he was confined that day; talked to bim on the back apa about ten min- utes before be was put in the guard-room. Ad- vised him to go up stairs to bed. F. was anxious to see Ma; askins. Witness finally induced him to vo up stairs, but he came almost immediately down again; 28 witness thought to yetsome milk for bissupper Witness saw bim in the back quard-room shortly efter. He was not very violent thes—appered to be perfectly sane. Next time witness saw bim was after Mur- phy waashot. Wit- news never told any one that he meant to put the accented through at bis trial Private Langdon recalied. —Testified that he also saw Foley, and be looked intoxicated Sergeant McCourt —Had seen Foley at 4 o'clock p.m He was very merry, but there was nothing unusual about bis eyes ‘The evidence closed here, and Mr. Norris, for defense, submitted a prayer for instructions to the jury, as follows: 1 The Court tnstruct the jury that, toconstitute the crime of murder, the killing must be with malice aforethougbt, eitber express or implied by jaw, and that although they sbould believe that *he death of the deeeased (Michael Murphy) was € ned by the discharge of the load from the musket In the bands of the prisoner, without any provocation, yet, if they further believe that the szid musket wentoff accidentally, or that the prisoner was no! ‘are that ft was loaded, he can be guilty of manslaughter only; and if they have any doubt as to either of these questions, the Prisoner is entitled to the benefit of the doubt. 2. If the jury believe that the prisoner was in- texicated from the use of ardent Spirits at the time of the commission of the offense charged in the indictment, whilst drunkenness, of iwelf, does vet relieve bim from weet responsibility, yet it is afietto be considered by them in connection with atl the evidence in thecase, as to the question of Intent 3. If the jury believe from the evidence that the pr'soner, at the time of committing the homicide in the indictment mentioned, was in a deranged state of mind, from whatever canse, so as to have been incapeb!e of understanding the legal conse- quences of his act, or of bis social and moral re- lations to others, or of distinguishing sight from wrong in relation to the particular ‘acl of which he stands charged. he ought to be acquitted. 4. If the jury believe from the evidence afore- said, at the time that be committed the homicide charged in the indictment, he was laboring under some mental delusion, which for the time being entirely centrolied bis will, be is not accountable in law on the said charge, and ought to be ac- quitted 5. If the jury have any doubt as to the case, either fo the bomicide or the question of sanity, he defendant should be ‘acquitted. 6. If the jary believe from the evidence that the Prisoner, without provocation, and by means of @ deadly weapon, tptenticnally killed the de- ceased. and that such kililng was the immediate result of intoxication on the part of the prisoner, and occurred while sucb intoxication lasted, then the prisoner is guilty of murder. 3. If the Sury believe, from the evidence afore- said, thatthe lsoser Without provocation and by means of 2 deadly weapon killed the deceased, ther from antecedent malice or from malice springing up atthe time of the use of the said deadly weapon, then he ts guilty of murder. 4. In order to acquit the prisoner on the ground of insanity, it must be ved to the satisfaction of the jury that at the time of the killing of the the prisoner was insane, and it is not sufficient to sustain the defense of insanity that the jury from the evidence aforesaid are in deubt whetber the prisoner at the time of such killing ‘was jnsane or not S. In order to acquit the prisoner on the ground of insanity, it must be clearly to the satis- a of the jury that at the time of the killing the prisoner was laboring under such a defect of reason, from disease of the mind, as not to know the nature and quality of the act be wns doing; or if he did know it, that he did not know be was doing what was wrong.
