CrimrmaL Court —Yesterday the Court, upon the conclusion of Mr. Ould’s argument for Gov- ernment, in reply to Mr. Carlisle’s demurrer to the indictment against Peter S. Duvall, charged with perjury, delivered a decision quashing the indict- ment John Rawlings alias “Wit” Rawlings, was then placed on trial on a charge of assanit and battery on Joseph Bell; also, on a second tndict- ment for an assault and battery on Julius Weible. Verdict guilty, and $10 fine in the first case, and guilty of assanit only and a fine of $5 in the second one. William Thomas alies Wm. Wallace was then tried for stealing a pair of boots worth $5 from A B Jones Verdict not Fabytag Chee consequence of the prisoner being proved to be a slave. Trial of John Foley (Soldier) for the Murder of Michael Murphy —This morning John Foley was brought over from the jail to be tried for killing Corperal Michael Murphy of the U.S. Infantry corps, Major Haskins, now quartered on Capitol Hill. Mr. T. J. Page assisted the District At- torney on behalf of the Government, and Messrs. Norris and Thrift appeared for the defendant The jurors were called severally and questioned as usual on their coir dere as to their competency to sit as jorors in a case of murder. The following juro:s having passed the usual examination without objection weresworn : Wm. Harper, F. A. Tucker, James Espy, Orlando H. Donn. H.C. Addison, J. T. Clark, John T. Cas- sell, Micbael Green’ Martin P. King Thos. J. Wilson. Joseph N- ing, mas Ga an. Mr. Page, for the United States, then addressed the opening to the Jury, first stating the history of the homicide, and afterwards defining the law of murder as laid down in the books, and 2s rec- ognized in criminal jurisprudence. Mr. Norris stated that the defence would re- serve their opening until the close of the evidence for the prosecution. Robert Langdon, (private) sworn. —Stated that he knows Foley; saw him on the re! of the mur- der. Witness was on guard, and a little before 6 o'clock the corporal told him to take off bis uni- form and put on bis fatigue dress. When witness came down be was placed tn the hall to keep people from going in and outthe room where Foley was confined. Walked upand down about five minutes, when Murpby came in and opened the door about a foot, and witness saw Foley with agunin bis band, and he charged bayonet on Murphy. Murphy closed the door, and Foley pulled ft open again. Murphy strove to get his et, and Foley raised his gun to bis shoulder red at Murphy. Murphy turned half round, exclaimed, “Oh, my God, I’m shot,”’ and fell to the floor. He lived about two minutes, but never spoke agein. Foley after shooting talked as though he cared nothing about whst he had done. Corporal Nolan ran down stairs as as soon as the yun was fired, but witness thinks no one but himself was in the ball when the shot was fired. When Murphy opened the door Foley called him by name w itness was in the room at the time Foley was tied. and about half an hour before the shooting. Foley abused Murphy about tieing him, and said he might tie his feet as well as his bands. He told Foley to be quiet, and Feley told him he was digging bisown 5 He called Murpby many names, and abu i Murpty was there this time about two minutes. W itness wes eating his supper in the room where Foley wasatthe time. Before Murpby came in Fo- ley did not speak of him atall. Murphy wasa cor- poral. Witness thinks Corp’! Nolan put Foley in the room, but was outside when he was first put in; was on guard outside. Aftershooting Murphy, Foley came out to the door, where he stayed a moment till Major Haskinscame in. When the Major came tn, be told him be was ready to be taken. When witness went in there first, he did not see the musket. Don’t know how it came there for a certainty, but remembersa musket was brought Inte that room about a week before. At this time witness didn’t look for it. It might have been there and witness not have seen it. As Murphy opened the door Foley called to bim, as if he wanted him to goto him. ‘Murphy wasshotin the right breast. Cross Examined.—Don’t know why Foley was coufined on this occasion, except what witness has beard. Foley had been out on leave a part of the day. Saw him come in about 4 o'clock p.m. Witness was on pest at that time. He was under the influence of liquor then; not very much, apparently; he could walk straight. He didn’t speak to witness when he passed the He had a citizen with him. it was when witness was relieved at 5 o'clock that witness aw we Fa ers He was then in confinement. Corporal Noland and Corporal Murpby had charge of the guard there. The door of Foley’s room was shat, but not locked. [tcould be opened from either side. About 6 o’clock witness was placed at thisdoor. W itness believes Foley. had been making a dusturbance, and that waa the reason be was taken to this room and tied. After shooting Murphy he danced about the room, and didn’t seem to care for what be had done After shooting Murphy he laid the gun over by the side of the door. Foley appeared to be glad that he had shot Murphy. Witness never messed with eitherof them, and never knew of enmity between them. ‘Witness don’t know how the gun came in the room, nor who loaded !t. He remarked be was not able to fight the officer bimeelf, but in balf an hour he would produce a man who would wae the party. One of the ofictals turned toa Mr. King, a quiet, good-na- tered man, and asked if he was the one. Mr K answered that he was no fightingman. The officer said, ‘Ob! Theard you were good man'” and took Mr. K. by the whiskers, and “butted” him in the face. Mr King instantly dealt him a blow that knocked himdown. The largest and tallest of the three then advanced to assist his partner, and also received a wipe from Mr. K. that knocked him so far that he didn’t come back again. Police- man No 1 was better game, and irned to the fight, and was soon in the Ce #5 Mr. K., who gave him meettler this time. Policeman No. 3 attempted to aid bis partners, but King’s fist met him as headvanced and sent him staggering to the rear in double quick time ‘Two respectable and influential citizens who witnessed the sffair, urged Mr. K. to have the party arrested for assault and battery. When the “ comes off we shall have the statements under oath. Tus Concent or Tux Mozart Socirry at Wil- lards’ Concert Hall, last night, was attended by a fair audience, though not sufficiently numerous to be remunerative, which ts to retted. The Programme was judiciously selected, embracing some of the finest gems of the best German and ftallan authors, and containing a pleasing variety of style and sentiment. We were unfortunate enough not to reach the Hall till the close of the first of the programme. and therefore can only speak of the last half. Prof Musgrif took the house by storm, by his performance upon the vio- lincello. Throughout the entire performance of the beautiful Souvenir de Spa of Servais, he held the whole audience, as it were, enchanted. A repetition was persistently demanded and ac- corded. Dawson sang the Wanderer of Schubert with bis usual excellent taste, and was vigorously applauded. The oo Potpourl, from Meyer- beer’s Mugenots, by the Mozart Society, brought out their musical abilities finely, and was asa whole, exceedingly well rendered, the instru- mentation throughout being carefully and har- monlously sustained. It was a matter of uni- versal regret that the length of the pro- gramme, (eked out by numerous encores,) and the fatigue consequent upon a performance necessarily laboriously sustained, prevented the Mozart So- ciety from performing the very best piece on it, ¥iz: the finale from the first act of Don Giovanni. We trust they will vive us that at their next con- cert, which the public will hope for soon. TuraTER.—The spectacle play of the Naiad Queen continues to be the card at the theater, and drew another immense house last night. Jeffer- Son was the very incarnation of fun, and the au- dience got so in the habit of laughing “ to kill’? when he was about that the very sound of his voice behind the scenes, as he made his entrances, induced a ripple of premonitory te-he’s through the house. Capitaliy did Miss Mary Shaw sec- ond him, the part of *‘ Idex”? being well adapted to exhibit her varied capabilities in song, senti- mentand burlesque It is but the merest justice to a meritorious performer to say tbat in a role of this description she has few equals upon the American stage. Bartholomew's ‘“ Amphibeo” was noticeably good, and Mr. Roy’s “Sir Ru- pert’ fair Mrs. Mann, we hardly need say, was the right performer in the right place as ‘* Mrs. Bridget.’ Miss Mann looked every incha queen and her subjects were as graceful and beautifu as possible. The beauty of the tableaux was so striking that the green curtain was raised again and again to afford the audience another look. In fact, the whole performance went off in a blaze of glory. The sale of tickets to-day indicates an- other crowded house to-night. Derattere or Troops. —T’ Be A, 2d artillery, Captain Ba: , Captain Allen, latel stationed on £ st, left this city in the 6-o’clock train. Yesterday, orders were leftat the Receiver’s office at the Capitol to have ready twenty carpenters, by 4 o’clock this morning, to accompany the troops, but their des- ‘ination was not made known to them. The car- penters were told they might have some pretty rough work, and were advised to go well, pre- pared with tools, &c. Some, not being satisfied with the pro; trip, on arriving at the depot backed out; but their places were immediately filled by others, who were on the look-out for such cases. None of the troops are aware of their destination; and although it was stated that they were bound for Fort Hamilton, N.Y , yet as car- Peters can be easily obtained there, the party hought something else was in the wind. The carpenters were not even informed as to the time for which their services would be required, but were told they might be returned in three weeks, and perhaps not in six months.
