Saw Ogden when he was being brought out of the building, ond saw him afterwards at the watchhouse. Thinks witness milled ont his pistol when be first went towards tee crowd. Judged there wes from 130 to 200 wen present Officer King, by request of Justice Donn, re- capitulated bis evidence. He stated that he went out into the street tostop the throwing; saw John- son have bold of Lieut. McHenry, and saw the latter sefze bold of Johnson. Recognised Thos. Haggerty, with a stone in bis hand. Saw that Johnson was very drunk; McHenry told him to go away; Johnson made ne reply, but continued very nolsy, and was arrested. ‘The evidence having been concluded, Mr. Berry wished to know if the simple fact of the parties arrested being found in the building con- stitnted’a riot; tumultuous essembly, {n his opin fon, being necessary to make a riot. He admi that a charge poh Mx building had been made; that windews bad been broken, and other damage done; but be contended that no testimony had been presented showing that the parties charged bed participated therein; and that the mere fact ef thelr being found in the building was no proof that they were rioters. Mr. Betry also referred to what he considered to be an erroneous report of his remarks, ts re- cently ee hed in the Star. Hedid not remem- her, fo have said that the District Attorney was bound to send any person as counsel, but he did say, or meant to say, that no one not deputised by the District Attorney had the right to appear for ‘the presecation in this case. [The reporter would state that the remarks of Mr. Berry in this connection were transcribed literally frem the notes taken verbatim on that eecasion. It is proper to add, however, in justice to Mr. Berry and Justice Donn, that a typograpb- ical error in another portion of the report - him object to +‘ legal’ questions being put toa witness.
