SPIRIT OF THE MORNING Sore The Intelligencer replies to the Union's leading le of yesterday, on the postal question, d. it is in confidence with the Republican party, and saying that if those who labored in the House for the defeat of the Post Offiee appropriation bill, in the shape in which it was amended by the Senate, deserve to be styled as ‘Republicans,’ the members of that party were much more numerous in the last Congress than it had before imagined. It also denies having complained that the Presi- dent consulted his Cabinet, and quotes a letter of Mr. Jefferson to Wm. Short, in 1807, to show that it was the habit of that President to con- sult his Cabinet in writing on important meas- ures The Union treats of the singular manner in which the New York Herald “backs” its friends. He thinks the prospects for miners are better than ever ex- isted in California. —_———_____ Navat.—The U. 8. steamer San Jacinto hauled out of the dry dock at the Brookiyn Navy Yard on the morning of the 24th {nst., and was placed un- der the western shears, Preparatory to receiving her masts and rigging. Preparations are being made to float the U.S. steam frigate Niagara in dock, where her bottom will be overhauled, and such caulking as is required below watcr line will be attended to. eee I> The United States revenue cutter Henry Dodge, having ‘lately put into the Sabine Pass, Texas, during a heavy blow, the officers, at the request of the neighboring citizens, pursued in a boat and arrested a desperado named Bill MeCor- mick, who had been a terror for years to the ci zens on both sides of the river, and who had just murdered a negro boy and attempted to murder another. U7"In Cincinnati, lately, a man named Galt. married a dumb woman. Being asked why he did so. he answered that he had had two wives already, and they gave bim no rest by reason of their talk ceaselessly, and complaining and scold- ing from morning till night. Both had died, and now, as he was forty years old. and desirous of having a little peace for the remainder of his life, he had determined to select a dumb ‘woman for bis third connubial partner. Jeatousy axp Murver.—at Madison, Ind.. on the 17th instant, Stephen Lanciscas shota young man named Hollis dead with a pistol for dancing with a young lady to whom he had been paying attention. The young lady had refused to dance with Lanciscas on account of improprieties in his conduct, whereupon he declared that no one else Should dance with her. Hollis paid no heed to this, and was therefore subsequently murdered by the offended lover. U7 Another overfiow of the Mississippi would seem to be approaching—slow, but sure. The physicians. how- ever, pronounce his present condition as extreme- ly critical. and it is doubted whether he may sur- Vive the injuries sustained by the fall, Approacnine TriaL.—' v ter-writés who have persistently wii pens to prevent the trial of Daniel B- Sic! upon the real facts involved in the Gage of killing of Philip Barton Key, have of late sorted to the expedient of representing Chief Justice Taney, the uncle of Key, has expressed himself against the employment of additional counsel in the prosecution, and, in- deed, against any effort whatever on the part of the proseeation to show that the deceased was the seduced party, if the defence sot up be justification or momentary passion from al- leged wounded marital honor, Thousands of papers have published the false statement con- cerning Chief Justice Taney in this connection, and-unless contradicted, the aim of those writers bids fair to be achieved. That aim is to induce the general impression, that as a member of the Key family, the venerable Judge deems it best that nothing should be done iff the course of the trial to vindicate the eharacter of the late Mr. Key. Among those here who know Judge Taney well, the falsehood of that allegation is duly appeciated—as it should be everywhere. We have tosay that we are satisfied that noone takes a deeper interest than Judge Taney in having the trial of Sickles thoroughly conducted ; nor does any other of the friends of the late Philip Barton Key more earnestly desire that in case the defence set up be such as to require the prosecution to show that the deceased was a victim in more ways than in his death, and that there was no madness whatever in the killing, such a showing shall be conclusively made. We are satisfied that while Judge Taney and the rest of the relatives of Mr. Key have every gonfidence in the ability and professional in- tegrity of the District Attorney, they are anx- ious that he shall have an acceptable adjunct in the prosecution, because the physical ener- gies of no one man can be sufficient to cope with those of all the many counsel which the necessi- ties of their case have caused the defence to en- list in their behalf; four or five of them being, admittedly, among the most celebrated criminal defenders in the United States. We are further satisfied that Judge Taney, General Howard, and Chas. Key, Esq., the uncles and brother of the late Philip Barton Key, if they have not al- ready done so, are about applying to the (loy- ernment here to accord to the District Attorney professional aid in the trial acceptable to him.on the ground that the now existing cortainty that the unusual array of counsel for the defence will render 1t absolutely necessary that the District Attorney shall be enabled, by profes- sional assistance, to husband his physical power so that he may not fail to do entire justice to his case because his strength and endurance arc worn out by constantly recurring antagonism with fresh counsel of ability and zeal equal to his own. We are further satisfied that the District At- torney appreciates the kind feeling to himself involved in the desire of Key’s relatives that the powers of his fine mind and his so well professional ability may have full scope in the case; as they cannot have, if upon each point to be argued, and in examining each sncceed- ing witness, he is to find pitted against him for days, if not weeks, different counsel with such each recurring point or witness; gentle- men as eminent professionally, too, as Messrs. Stanton, Brady, Graham, Chilton and Phillips, all of whom, it will be remembered. are among those who are to appear for the defence. We know that the District Attorney would have been happy to have accepted such aid in the trial under such circumstances, as the rel- atives of the deceased might bring into it on consultation with himself. But they very properly appreciate the delicacy of their posi- tion in the matter. It is not for them, but for the Government, to see that the law shall be duly vindicated in the case; to take due care that the unusual array of counsel for the de- fence may not defeat the ends of law and jus- tice through the fact that the provision for the due enforcement of the law in criminal cases contemplates no such emergency as the present —one in which it is morally impossible that the physical energies of the public prosecutor ean cope against those of some seven or eight practised and competent antagonists. We can have no doubt that the Government will take the same view of the matter, und will promptly accord to the District Attorney, on the appli- cation of the relatives of the deceased. sueh professional assistance as he may designate + Arwy Orpers.—There has just issued from | the War Department a “General Order” con- cerning hospital stewards. As the object of the | set of Aug. 16, 1856, in providing for permanent appointments to these positions was to secure the services of more competent persons, the Sec- retary desires that no soldier nor citigen be recommended to him for appointment who is not in every way reliable, and sufficiently intel- ligent and skilled in pharmacy for the proper discharge of the duties. He will continue to employ soldiers for temporary positions of this kind at advanced pay, and use that as a means of placing them on probation, and in case they merit it, will appoint the permanent hospital stewards required from among these probation- ers. The order also provides that hospital stew- ards shall report monthly to the Adjutant (en- eral and Surgeon General of the Army. This Government has expressed itself ns having no objection te it, but at the same time has avowed itself de- termined to hold the visiting parties responsi- ble for any violation of maritime rights towards a vessel sailing under our flag. The Herald’s correspondent also says, in reference to Sir William Gore Ouseley’s opera- tions in Central America, that a distinguished foreigner here not long since received a letter from Sir William Gore Ouseley, in which he predicted that the Cass-Irisarri treaty would never receive the sanction of the Government of Nicaragua. acelin A Hvumave.—We place no faith whatever in the story of the Courrier des Etats Unis that another expedition to filibuster against Cuba has been organized. We keep our eyes steadily on the movements of the parties who for years past have been chronic filibusters, and have seen nothing in them to lead to the impression that any such scheme is being matured. Were any such scheme being organised, their fingers could not fail to be in the pie. Her machinery is being manufactured at the navy-yard in thiscity, and itis probable she will be brought hither to have her machi- nery put on board.
