It came ent in evidence at the trial that Thomas bas been keeping up an unlawtal intimacy with fudian Jane, and that ea the night of the Sd_instant Thomas went to Jine’s house and found the door locked, whereat he swore very hard, and upon June coming to the door to let him in, be hauled off and struck ber a brutal blow which prostrated the girl in the yard, where she lay sometime insensible For tne swearing, Thomas was fined $3 and 91 crnts costs; and in default of bail in the assauit wad battery, he was committed to jail to await the action of the grand jury.
