Cuatces Barnert’s SENTENCE COMMUTED BY THe Presipext oy Tur Usitap Sratzs.—The President, last evening, commuted the sentence of death against Charles Barrett convicted of the murder of Reeve Lewis, into imprisonment for life. The following isa copy of the reasons as- signed for the commutation : Whereas the jury which convicted Charles Barrett, now under sentence of death for the murder of Reeve have earnestly besought me to commute his punishment to imprisonment for the term of life. They represent that ‘‘the said Charles Barrett is a young man; that the evidence adduced on his trial showed conclusively that the crime with which he was chai ‘was not com mitted with premeditation or deliberate design, but, on the contrary, was the work of a moment, perpetrated under the maddening effects of intoxi cating liqaor, of which the unfortunate man had freely partaken the night of the fatal decd; that there was no acquaintance or relation of hostility between the the unfortunate man and the said de- ceased, and the occurrence was characterized by an entire absence of the motives which usually impel to crime.”” And whereas the acting District Attorney, who Preseeuted for the United State on the t ial, fir several reasons, since brought to his knowledge, has expressed 2 doubt whether Barrett actnally fired the shot which caused the death of Reeve Lewi ind after a careful examination of ali the facts and e}rcumstances, | myself entertain a serious doubt upon this subject. And, although according to the law of this District, he would still be guilty of murder, yet if bis associate fired the shot which killed Lewis, thi circum. stance which, in some degree, mi mates the crime of Barrett, especially ax in the opinion of the jury it * was not committed with premedit: tation or deliberate design ”° And whereas the one party was convicted onl: ofthe crime of manslaughter, and, foi is feuce, has been sentenced toeight years’ confine- ment in the penitentiary; and it would seem to be an unequal measure of justice to execute a capital sentence = the other. d although, in a clear case, this would not be sufficient canse to arrest the execution of Barrett, yet under all circumstances of the present case, this isa fact which deserves consideration. And whereasdivers bigbly-respectable persons bave strongly urged me to commute the sentence of death aga’ Charles Barrett into imprison- ment for Life. tiem og that, by this mode Cd gi istment, the ends of public justice would be subserved and eee 4 sufficiently protected : Now, therefore, &c., &c.
