Payne, Dr. J. W. Finks, Charles F. Wood; Andrew Sessford, and —— O'Dwyer were suc- cessively examined for the Prosecution, and their testimony was substantially the same as pub- shed tn our columns at the previous trial. With the testimony of Mr. O'Dwyer the United States closed Mr. Beadley. for the defence, then called Dan’! McCarty and Mark Mankin, who testified to the same facts as were stated before by then Dr. Hall, sworn —Was passing down the street and saw a crowd standing; went and looked over their shoniders and saw a man lying; was told he bad been knocked down; he was not dead; the crowd said be was dronk, and had been knocked down. Dr H. was questioned as to the effect of blows inflicted by stamping on soft portions of the human system. Hisevidence did not ditfer materially from the other medical evidence which bad been otfered. Capt. Goddard and Col. Randolph were sworn as to the previons character of the prisoner. 4. G. Naylor testified to having witnessed a Portion of the affray. Mr. Bradiey then called to the stand Mr. G. W. Appleby, who was sworn. Mr. B. stated that be wished to show by this Witness the state of the deceased (Quigley) for some time previous fo the affray that ended in his death. He expected this witness wonld state that at or about tweive o’clock on that day, as he was passing up Third «treet, he met the deceased, who endeavorrd to provoke him intoa street broil, and drew a loaded pistol on him, threatening to shoot him, The District Attorney objected tosnch evidence being given, as it was clearly irrelevant to the pending matter. Wherenpon considerable debate ensued, and finally the Court decided in substance that the evidence proposed to be elicited clearly related to a separate und distinct matter having no bear- ing on the inquiry now goluy forward, and was therefore inadmixsable. ‘The Court the adjourned. To-day, Mr. James H. Shreeve was called to the stand. He testified that he hed known the Prisoner since he was a boy, and believed him to be a man of excellent character. The witness knew nothing of the uffair for which the pris- oner is being tried. The evidence for the defence closed with this witness, Mc. Wasuineton HorticuLturat Socrety.—Most of the leading horticuliurists of the District were present at the monthly meeting last night, ax the preliminaries were to be arranged for holding the Society's second annual Spring exhibition. A magnificeat bonquet, contributed by Mr. Jno. Watt, graced the chairman’s wmbie. Mr. AVatt also exhibited some fine specimens of early vege- tables—caulitlowers, cabbages, cucumbers, and some mammoth leeks. Mr. George Rigas, the newly-elected President of the Society, in taking the chair, made a modest disclaimer of having anything but a theoreticu! xnowledve of horticulture, but expressed his earnest disposition todo what lay in his power to advance the intesests of the Association. Mr. John Watt, from the committee appointed. reported a schedule of premiuzns for the coming exuibition. This schedule, waich was accepted and ordered to be distributed, designates some thirty-one premiums for plant’ eleven for cut flowers; twenty-seven for vegetables; thirteeu for fruits, and discretionary premiums to be allowed Tor all articles offered for exhibition. After some discussion, the second and third days of June were tixed upon for the exhibition, with the understanding that it might becontinued a day longer if desirable. Tue PRorosep SpxctaL Portce —We have every reason to believe that those who are fearing that the Mayor will make partisan appointments of the proposed special police, to serve on the election day, are giving themselves unnecessary Uneasiness, indeed. Mayor Magruder ix well aware that to do so or to permit any others than well-known and generaily respected citizens to interfere ax special police on that day, mit be to invite rioting and the infraction of the Mgbts of the citizen. Small-beer politicians on either side—men bent on securing the election to ottice of their own favorites—are most unfit men to wield such responsibilities on such occasions. Experience teaches they always set out under the impression that their fauctions are devoived on them to subserve partisan ends. ARRESTED —Yesterday, the colored boy John Nagent, who was charged with being one of the party who attacked the police near the Park on Mouday, was arrested by Otticer Zimmerman and sent to jail by Jastice Doan. ‘There ix an- other warrant out for him, in which he is charged with shooting at Captain Bright while on his way home. Noyent has grown to be perfectly intimate with the police of Wasbingten ina very short time. He has been freguently mentioned on the guard-heuse docket, sometimes for serious offences. Vacrants —It has been usual for vagrants of other cities to make Washington their home and impose upon the charity of onr citizens during the winter season. This has been a cause of complaint, many believing, and with reason too, that the vagrants were sent hese fiom other cities. Bat why they should be so numerous this spring, when they usually depart at the approach of Pleasant weather, is a question that requires some consideration.
