But in response to tthe law shag Pe to the point it emb aces willbe stated. Ifa man shoots another, and in- tends to kill him or do him some great bedily barm, without any or considerable provocation, it is murder, aed malice is implied in law from the act—‘Ifa man disebarce a gun among a mul- titude of people, and death is the consequence of such aet, it will be murder.’—Russ. on er. Granted without comment, by the court ‘The case was then put to argument, and Mr. Maury, on the part of the piosecation, address. ed the jury at some length He was followed on the part of the defence by Rateliffe, who began at half-past 2. p. m., and spoke to the jury till quarter past 5 o'clock, and then closed ‘The court then adjourned Te-day, the argument for the defence was con- tinued by Mr. Norris, who addressed an able lezal peroration to the jury, embracing all the facts which bad been elicited during the trial. the prisoner ard upon which be comunented with great force of reasoning guiment, neuce, and fail and reasoning. Tuer Concert at the Sunithsonian, last night, Was a complete triumph for our Washington vocalists, and a high compliment to the talented gentlemen, Messrs. Root and Bradbury, under whose conduct it had been gotten up. There was a much larger attendance of the citizens than at the previous one, and though the performers were iu a manner exhausted with the excessive labor of the long rehersais which preceded the convert, the affiir passed off in a most satisfacto- ty style, as was demonstrated by the frequent and hearty applause of theaudience. Aboutone hundred and seventy singers were engaved in the exercises of the evening. All the pieces were sung well, and some of them exceedingly so. The Frost Chorus, The Arab Steed, Freedom and Union, Escape from the City, a langhing chorus; Blessed are the People, all went off in a supesor style of excel- lence. The Jubilate quartette and chorus was sang with great effect, ws was also that tine old chorus “Here in Cool Erot,”’ &c., the perform- ance of which was received with rapturous ap- piause. Messrs. Bradbury and Root again dis- tinguished themselves in the performance or sev- eral beantifal solos. A great variety of fancy dances was introduced, and the children’s portion of the exercises was terminated with the beautiful **Flower Dance’’ of the Viennoise children, to which was added a mag nificeat coronation scene. The Queen was Miss Martha Bridgett, and she was crowned by Master Frank Coyle, attired in the costume of Lonis XIV. The finale tableanr was formed by flag dancers in connection with the above scene General dancing, in which the older folks took part, was then introduced, and kept up till a late hour. he attendance was very large, many having left because they could not gain admission. The Savvutes To Kansas.—The passage of the Conference bill for the admission of Kansas, and the final removal of the exciting matter from the councils of the nation, was hailed yesterday With acclamation wherever the news spread. As soon as the bill passed the Senate, a salute of thirty-two guns from Capitol Hill anticipated with its thunder the glistening of a new star in the constellation of the free ; guns at Centre Mar- ket awoke echoes from both ends of the avenue; and then the artillerymen, proceeding to the front of the Executive Mansion, gave voice again to their dogs of war, as though they echoed the mil- lien voices that through ail the land were Breet- ing with rejoicing shouts the final adjustment of the vexed question and the promise oF peace toa distracted country. The universal acclamation ith which the nnited Democracy hailed the aanre was no more disturbed oy the petty alice of a few “ perturbed spirits” in Washing- ton, than were the harmonious rejoicings of the victors at Yorktown by the hoarse voice of John Hook crying through the American camp, ‘Beef!
