The jury then took a recess of a few minutes, after which Messrs. J. Batemen, George Ellis, J Elpole, C. P. Sengstack, Dr. Lauck, and George Wissinger were sworn and testified, their evi- dence being the same as heretofore published in ourcolumns with the exception of that of Mr. Wissinger, a new witness inthe case, who testi- fied that he was a resident of Frederick county, Md., had known the Oglefamily for a long time; the old man’s mental condition (that is the grand- father of Benjamin Ogte) was very good ; knew Horace Ogle, (the prisoner’s father;) there was nothing ¢ about him, except that be would sometimes leave his work without any canse, or when be had been drinking; bas known bim ever since he was a boy; he left witness or passed out of his immediate notice 35 years ayo, since which time be has seen him but three or four times. On the conclusion of the exam‘nation of Dr Lauck, the Court adjourned To-day, the trial of Benjamin Ogle was resu- med. Mr. Ratelitf> called— Mortimer Garrett testified to exami ing the wall of Mr. Slemimer’s bouse, at the corner of First and Frederick streets, and there found on the wall marks of bullets which had apparently struck the wall, witness examined the shot-marks on the wall the same evening the bey was shot.
