Cuiminat Covrt.—Trial of James Powers for the murder of Edward A. Lutts —When our re- Port closed yesterday, Thomas C. Donn, Esq., (Magistrate,) was on the stand, testifying as to the dying declaration of the deceased Lutts. The examination bad reached a point in the declare - tion where the declarant hed alinded toa pre- vious quarrel between bimseif and Powers,when the counsel for the defence interposed with an objection to this part of the declaration ‘be District Attorney contended, at length, that he had an undoubted right to produce any testimony bearing on the death of the deceased. in any manner, and to show a long-continued matice on the part of the prisoner towards the de- ceased Some time was consumed by the counsel in argament upon this point; and upon its conclu- sion aod final submission to the Court, bis honor, the Judge, decided that the dying declaration Must be confined to the circumstances of the death, and that the statements in question could not relate to the death, but to events which trans- pired between the prisoner and the deceased a long time anterior to the death, and were there- fore inaamissibie. Mr. Donn was then recalled and repeated the statements which be had previously given in re- lation to the Saturday previous to the shooting of the deceased. Cross-eramined —Witness stated to the de ceased that he had come to take bis dying decla- ration, and asked bim if he was willing to make a statement; he said he was willing, and would g ve it; every word in the declaration was given freely, and without prompting from any one: sev. eral persons were present, and witnessed and beard it all; the deceased said nothing but what is jw the declaration; he did not seein to be aware of how he bad got out of MeColyan’s house; saw no evidence of intoxication on the part of deceased; did not smell his breath; sat beside him on the bed . Wm. P. Smith, sworn —Had a conversation with the prisoner in Baltimore last summer; wi- ness asked Powers if he had settled that old dif- fienlty with Lutts; he said no, but that he would have satisfaction some time or other; witness af- terwards told Lutts of this conversation, and Ie said be was not afraid of Powers and there ‘was no danger from bim; witness knew of this old difficulty from the public journals; witness being intimate with Powers, has several times spoken to him in relation to this old fracas, Lutt® Wax about twenty-three years of age. The United States rested its case here. Mr Norri or the defence, called John Wade, sworn —Was at MeColgan’s on the nigbt in question; went there with several com- panions, and three gentlemen to whom witness nad been introduced; these were Adamson, Gorm- ley and Powers; this was between 9 and Io'clock at night; in the room was Daniel Smith, Mr. Wi- hey and Dennis McCarty; was there when Lutts came in, did pot see him come; but he was there aud stood opposite to witness; all persons present were conversing and drinki there were three shots fired; one shot first, and then witness looked. up and saw Lutts standing against the counter; saw the smoke of the pistol, and apparently it came from the back door, but witness does not know who fired it; was standing Opposite to wil- ness; several persons were standing between witness and the man who was firing; the persors who were in conversation were near the centre of tbe room; when the shot was fired witness fell back against the wall to get out of the way; did not know at the time that any ene was shot; some one walked out with Lutts, bnt witness could not say who he was; he was a larger man than Jatts; they went out of the front door; Lutts cried ont, Ob’ as soon as the firing ceased; witness was nearly the last one out of the house. and when he went out be saw several of those who had been within walking across the alley; when the firing began, the crowd present re- treated towards the back part of the room; saw McAleese with a pistol in his hand while in the oom; after the firing ceased, McAleese went to the middle of the room and leveled a Pistol, a horse pistol, and said if there was another shot fired he would «boot; some one then said,‘ Ob! McAleese, don’t!*’ there are three doors to the room; the smoke of the first pistal came from the back door; could not tell who fired the pistol; Adamson acted likea drunken man on that night; Daniel Smith was under the influence of Hquor, as well as was himself (the witness ) Cross-examined —Did not see Lutts drink; think Lutts was fired at by the way he acted; be was doing nothing, and witness heard him ex- claim **Ob!** when the shot was fired; witness was conscious of what was passing around bim M. Gormley, sworn —Thiuks be was at McCol- gen’s on the night in question; was in some house where a man was «| ot; was with Adam- son all that evening; went in that house with him and McAleese and Powers; beard sbooting, bot there was no row, but all were drunk; wit- ness was so drunk he could not walk; so was Adamson; at any rate Adamson drank witness drunk, but don’t know how drunk Adamson was; Adamson was half drunk when witness wax int.oduced im by Lutts, at il o'clock that morning; introduced to Adamson on the Avenue, between Third and Four-and-a-half streets, at some house; don’t know Daniel Smith; witness has lived in Washington five months Cross-eramined —Don’t know what took place at McColgan’s house that night; thinks Adamson was as drunk as he, witness, was; don’t know whether he was carried in that honse or walked; heard shooting and that was all John Powers, sworn.—Saw John Adamson on the night in qnestion about 11 o’elock; be was beastly drunk; it was at Mr. Kelly's. on the ave- nue, above Sixth street; he staggered very inuch end was drinking whisky al the time; most all the parties which have been named in this case were then present; this was after the shooting. Crost-eramined —Saw the crowd go in Kelly's house and followed them in; James Powers was not there; Adamson acted like a drunken man, saw bim drink whissey; all the rest of the crowd were dronk; witness was sober at that time; knew it was whiskey that Adamson drank, be- eanse he knew the bottle; knew or heard then that a man had been shot Re-eramined by Mr. Norris —Wasarrested for his brother, and was taken to the Infirmary hand cuffed, together with Mr. Shotwell; when they went into the Infirmary ts said to him (wit- ness) youain't the one, but pointed to Shotwell, saying. “but vou are; he said, point- ing to Shotwell, three ‘ are the man.’? Kelly, sworn —Saw John Adamson on the night in question: it was directly after the shooting; also about fifteen minutes before the shooting. he was pretty drunk, so much so that his companions told him not to talk so much Cross-+ramine’ —It was at Mr. Downing’s house that witness saw Adamson; don’t know that Powers was at that hous: at ail that night; was there all night; didn’t see Pow at the house, but he might been there and witness not see him; the offietr came there after him, but witness would not let him in; knows Powers was not there then; some ove who was there that night handed witness a pistol John M-Kewen, sworn.—Lives in Baltimore: bus seen Lutts; knows James Powers; knows nothing of the steamboat ditticulty, which has heen mentioned. except by hearsay; bas talked with Powers about it Mr. Norris Lere proposed to bring evidence to <how that the prisoner, instead of baving har- bored malice avainst the deceased for the injuries received by him on the steamboat excursion, had ducing the sickness which wax the result of said jes, severe! times expressed forgiveness towards the deceased ; and that it was at the re- quest of the prisoner himself that no legal action bed been taken in tha! matter To this proposition the District. Riley, sworn'—Was on the steamboat ex- carsion when Lutts stabbed Powers; saw the dif- ficulty between them. The Court here adjourned. To-day, the Court met at the usual hour, and the trial of James Powers was res: 2 Mr. Norris stated tothe Court that be under- stood there was a deposition in the bands of the Government, of one Archibald McAleese; if so— and he did not know of the fact except infor- mation received—be wished to know what use ‘was to be made of it. Mr. Key stated that such was not the fact; he knew of no deposition such as had been alluded to. Ofcourse, such evidence would be inadmis- sible Mr. N. announced that he had no further evi- dence to offer on the part of the defence. “ Mr Key then called, as rebutting evidence for the prosecation— John Carr, sworn —[{Pending the examination of this witness, Mr. Key presented some notes which were taken at the coroner's inquest on the occasion of the death of McAleese, which had been taken on that occasion, and he offered them to the counsel for the defence to resd to the jury if he thought proper] Testified : that he was at the Infirmary when John Powers and Shotwell we:e brought the-e; Lutts said first that Shotwell had shot him; but afterwards, when Shotwell came nearer, he said «No, you did not do it; it was James Powers;"’ the room was lighted by one lamp; Wm. Horner called at the Infirmary; took J. Powers and Shotwell to the room where Lutts was; Lutts, on seeing Shotwell, exclaimed, “You're the man;’’ Shotwell then said « O, my God. don’t say that; Lam not James Powers; i am Shotwell;’? Lutts then turned towards some one present and said, “It was James Powers who shot me.*? Mr. Key here announced that he was Mr. Norris then called— Join Powers, sworn,—Saw a policeman whis- per to Lutts when he (witness) and Shotwell were at the Infirmary, had not ha@ his hair eut that da-; sawno change in Shotwell’s appear- ance either. Mr. Norris then offered the following instrue- tions, which he piayed the Court to give the jury: ist The Court instrnets the jury that if they believe from the evidence that after the difficulty betvreen the deceased, Ed. A. Lutts, and the prisoner at the bar, James Powers, in the month of July, 1456, the said prisoner had entertained and expressed kind feelings towards the deceased. during his iliness occasioned by the wounds shown to have been tuflicted upon by the de- ceased at the time aforesaid, and also, in the fali of I-57, and that the deceased and the prisoner at the bar on the Saturday night next preceding the Monday on which the deceased was wounded h.d become reconciled and fully made friends, it is not competent for them to infer malice on part of the prisoner against the deceased by rea- sou of any threats of violence inade in the interim by the said prisoner 2d. The Court farther instructs the jury that if they entertain a reasonable debut that Lhe wound which caused the death of the deceased, Ed. A Lutts, was infitcted by the prisoner at the bar or by some other person in the bar-room of McCol- gan or froma leading to said bar-room, then the prisoner is entitled to an acquittal dd. The Court instructs the jury that if they believe from the evidence aforesaid that the pis- tol or other firearm which caused the wound to the deceased Ed A. Lutts, whereof he died at the time and place charged in the indictment, was discharged from the back part or back-door of the bar-rooin of said —— McColyan, and not from the persons sianding in the centre or middle of the floor of said bar-room at the time of tbe firing or discharge of the same, the prisouer is entitled to an arqnittal, uuless they believe that the said prisoner, at the time of the said firing or discharge of the said pistol or other firearm, was at the said back-door or outside of the same 4th. If the jury believe, from the evidence afore- said. that any other person besides the prisoner at the bar discharged a pistol or other firearm inthe bar-room of McColzan, at the time that Edward A. Lutts was wounded, and that the same was discharged in the direction of said Edward A. Lutts, that, it matters not that said Jas. Powers did discharge a pistol or fire-arm, as charged in the indictment, thessaid prisoner is nevertheless entitled to an acquittal None of the above instructions were granted by the Court, except the second one. ‘The Court re- marked at some length upon the other three, but decided that, as drawn up, they were inconsist- ent with the tone of the evidence which had been given in the case Mr. Norris took an exception to the ruling of the Court The District Attorney then addressed the jury in a brief. but powerfully telling argument. which was most cogently put, and consistent every way with the evidence which had been: elicited on the part of the prosecution. Mr. Norris followed for the defence, and ad- dressed the jury at considerable length, summin; up all the evidence in the case with great lega’ power, and expressing much high-toned senti- ment for the unfortunate prisoner at the bar. He was speaking when this report closed. through. Scrreme Court—Monday.—Edward J. Prin- gle, Esq , of California, and Brinton Coxe, Esq , of Pennsylvania, were admitted attorneys and counsellors of this Court. Mr. Chief Justice Taney announced to the bar that, as atoken of respect to the nu ry of the late Col. Adjourned Tux Inox Pavement .—-Last night, after the Common Council adjourned, the members re- paired to the Mayor's ottice, where Mr Robin- son, agent of the company owning the patent for the iron pavement. proceeded to explain to them the medel. He said an application would be made to Congzie>s for an appropriation to pave Pennsylvania avenue but the Company thougbt it best, as a matter of lexy, to let the Council know their intention. The durability of the pavement may be inferred from the fact that the sections of which it is composed are made of chilled iron. and the one was hollow; the agent thought that, with a twenty- pound sledge,a man could make no impression upon it. ‘The cost of this pavement would be from $6 00 to 35 50 per square yard; but it woald proveeconomica! ulti- mately, as it is averred it would last at least fifty years. There are in the pavement grooves for a Fallroad for horse power. The proposition is that the company shall have the Fight to :on cars on this road for twenty-one years, upon con- dition that the a 2 the road in repair, and pay such other reasouable tax as the Corporation re- quires. The grooves are set in the centre of the pavement and so incorporated with it as not to injure it. A similar pavement has been in use six or seven years in New York and Boston; but not on the scale proposed ATTEMPT AT Sricip vastnight, Jno. Lynch, an Inmate of the Soldiers’ Home, was arrested for an outrageous assault on a lady, near the northern boundary of the city. He was taken to the gnard- house by the bushand of the lady and Ofticer King. During the night. the guard on duty heard a noise, as of some on- strangling, and going to the cell, be found Lynch had taken a piece of rope into the cell, and with it had hung himself to a hinge of the small trap of the cell door. The guard cut him down; but Lynch afterwards be- came so furious that it was found necessary to secure his hands and feet, in order to prevent his doing injury to himself. He bad been drinking.
