Carinat Cocrt —The jury in the case of Jc- seph Bulger, charged with larceny from Wm. Dawes, found a verdict of acquittal. The case of the United States against Henry Martin for assault and battery with intent to kill Augustus Norton, at the Seventh street toll gate, on the Ist day of March last, was next taken up Augustus Norton was first called, aod testified that he was at Moreland’s when two men came up tbe road; Mr. Heary Martin and Benj. Cross were the persons; was then infermed by More. land's son as follows: ‘ ‘Phere goes the fellows that beat you before;"? Cross then cried ont, “oh you Plug Witness replied ‘That’s ‘so! Cross then said, “Come up, yeu bull-headed son efab—b.’ When Cross came toward wi Martin said “Don't gothere.’ Cross th “Come on, let's get at the son of a b—h ness started to run. but Cross caught him: Mar- tin was then behind) Whea Cross caught wit- ness, he (Cross) struck him with a sluny-shot; Martia then said, “Ben, please stop.’ Joha Marron was along, and cried out to Martin to part them; don't know as Martin struck me; saw @ knife in Martia’s hand in the road previously: he was whittling; when witness run, Martin did hot parsue me, bat wheu Cross came up, Martin also came within about three feet of witness; ke (Martin) seemed to want to part Cross and wit- ness; Cross struck witness with a slung-shot; Witness was cut, but don’t know who did it; Martin was close to witness when Norton struck him (Norton) and he dro ped from the biow cf the siung-shot; witness thinks he was cut after he was knocked down; but repeats don't buow who did it; witness did not see Martin have a knife wh he stood beside him and Cross; Martin did come through the fence with a knife, whittling a stick; don't know whether it was a dirk-knife or pen-knife; had never seen Martin before that day Dr Fairfar testified to making an examina- tion of Norton after he was injured. Thos. Moreland, a boy, testified that he saw two men go up the road, and come back again ; they were Ben. Cross and Henry Martin; witness said to Norton, ** There goes the fellows that beat you before; Cross then said “0 you Pings !"? Norton replied ‘ That’s s>,’? Cross then hallooed oat, “Come on, you buliheaded son of a b—h;” when Cross came toward Norton, Martin said ** Don't go there; Cross said “ Let's take the son of a b—bh any how ” Cross then caught Nor- ton and str i ton the head with a siung shot se to the parties then; he struck at Norton; did not see knife in Mar hand; Norton was falling from Cross's ble When Martin struck; don’t know as Mar stabbed Norton; saw no blood; no koife; am certain that [ saw Martin strike at Norton; saw Cross kick Norton in the head. Cross-eramined —Martin begged Cross not to strike Norton. Enoch Moreland testified that he saw Cross strike Norton fiest in the head; Martin was be- hind the parties, aud hallooed to them to stop; Martin kicked Cross on the hand and broke his bold on Norte Mastin; dou s; saw that Norton wasent in the evening: know as Cross had a knife; Martin did try to pull Cross off; saw blood on the hand of Cross. John Brooks was sentenced to two mouths in the county jail. and pay a fine of $1. To-day, the Court met at thes, hour. The case of the United States Jas. Powers. for the murder of Edward A. Lutz—which was set for trial this morning—being called, Mr. Nor- ris, one of the counsel for the defence, stated to the Court thatthe Principal counsel (Mr. Morgan) was absent, from sickness, and that he did not desire to enter upon the trial in his absence, as Le was more intimately connected with it and all the circumstances surrounding it Mr. Key stated that the United States was ready to go tutu the trial at once, and proposed that the counsel for the defence must produce good and Sufficient reason for a continuance. The Jodge remarked that theusage of the court was. when more than one counsel was employed on a case, that the absence of one of them was no reason for a continuance, and must be sustained with a proper atfidavit, setting forth the reasons for putting the ease off. Mr. Norris bere olfered the attidavit of the de- fendant that be was nnabie to procure the pres- ence of an Important witness, one James Shot- Well, who was expected to prove that deceased, after receiving the shots which subsequently ter- minated his life, ebaiyed bim, Shotwell, with having tired those shots. Also, that Le had yood reason to believe that said Shotwell was now in the city and be procured by Thursday next, to which t he prayed the Court to con- tinge the case. City Councils met Friday night; present all the members except Messrs. Cropley and Thecker of the Council. In the Council, (Mr. Thomas in the chair.) 8 communication was received from the guardians of the public schools, giving a synopsis of the children of the town of suitable age to attend school, what number is now attending the public and private schools of the town, &c., and asking that the Councils place to the credit of the guar- dians the balance of the revenue arising from the poll tax for the purpose of establishing another school ; referred. Mr. Tenny presented several bills of Dr. Sny- der for medical attendance on paupers ; referred. Mr. Muncaster presented the petition of J. J. Bogue, as«ing that free access be allowed him to bis premises during market hours; referred. Mr. Simms presented the account of W. H. Tenney; read and referred. Mr. Simmes Sp Het from ways and means committee, a re olntion in favor of John Popkins, $22 WO; paxsed both Boards. The same gentleman reported from the streets committee an ordinance ordering the collection of a farther front foot tax on a part of Fourth street, for the further improvement of the same ; passed both Boards. Mr. Tenney of the ways and means committee, reported adversely to the petition of Mr, McCub- bin, in relation to certain transactions of bis with the President and Directors of the Metropolitan Railroad, and asked that the committee be dis- ebarged from the further consideration of the subject aud that the communication be referred to the Mayor, which was granted. Mr. Muncaster reported, from claims commit- tee, resolution in favor of the porter of the Or- phans’ Court; which passed both Boards. The same gentleman reported a resolution ap- Propriating $675 for the benetit of H. Reaver; which passed both Boards. Mr. Myers asked that the police committee be discharged from the further consideration of the complaint or communication of Benj. Howard; granted Mr. M also asked that the police comn discharged from the further considera’ resolution to resttain hawkers and peddlers; which request was withdrawn, and the resolu- tion recotamitted A communication from Captain Meigs to the Mayor, in relation to the laying out and opening of Aqueduct street, and the erection of a brids ec Rock creek, was read and referred to streets com.- mittee. Also, a message from the the same subject. In connection with this subject, Mr. Simmes, chairman of the streets’ committee, made quite an elabovate verbal report, detailing the plan of the proposed bridge, the cost of condemnation of property, the improvement of the streets, &c. After some diseussion upon the subject, Mr Simms reported from streets’ commi men's ordinance authorizing the laying ow di opening of a street from a point on Rock creck, opposite Pennsylvania avenue, to intersect Bridge street at the no:theast corner of the dwelling of George Giay, to be named Aqueduct street, which passed. Mr. Muncaster reported resolutions providing for the indexing of the laws of the Corporation, appointing E Hughes to execute the work, and $100 to meet the expense of the same, which ssed both boards. The Aldermen passed Council bill providing for certain repairs on the street west of the mar- ket. Mr. Ritter reported, from the market house committee, a resolation Prohibiting the sale of fuits, vegetables, &c., upon any street or foot way, Inor about the market, except those now occupied by renters; also, one directing the clerk of the market to cause the fish benches to be removed from their present position to the east and west sides of the market. and inimedi- ately novth of the canal, with the consent of the Peescnt occupants. A communication was received from the Clerk in relation to anexpended appropriations, and referred A resolution passed both Boards, placing the unexpended portion of the school tax to the credit of the Board of Guardians of the Public Schools, for the establishment of another school Mr. Simimes offered a resolution directing the Mayor to notify the citizens of the town to cause all ashes, dirt, &c., to be removed from their cellars and placed in the streets, between the present time and the Ist of May, to be taken away by the scavenger; passed. A resolution passed both Boards, adding H Addison to the committee to represent the inter- est of the Corporation before Congress. Coroner Weodward held an inquest yesterday over the body of a white man by the name of An- drew Kyle, who drowned himself in the canal, near the stop lock It 4 eared from the evidence that he bad been drinking quite freely, and was on his way to the Little Falls on a fishing excur- sion. On the way, however, he fell in company with a sharper, with whom he got to gam- bling, and lost what money he had with him: after which he committed the fatal deed. It ap peared from letters found upon Lis person that he was origivally from Roekport, near Cleveland, Ohio, where his parents still reside, but for years has been employed in Washington. He was by trade a printer, and had for some time past been employed in the Union ottice. The letters found Upon him were trom his father.
