Camminat Court —Trral of Benjamin Ogle, for the murder of John Webb —The Court was engaged during al! of yesterday in trying to em- pannel a jury in this case, and at the hout of ad- journment had obtained but nine. To-day,a jury was empanelled as follows :— Jobn Laurie, James W. Coombs, Richard Ab- bott, George W . Uttermuble, Hende:<on Fowler, George Burns, William H. Banm. Rob’t Coben, Benjamin F. Milstead, Henry A. Clarke, Lewis bag and James Crandell t. Fowler, one of the jurors, here stated to the court that the condition of his health would not admit of his being confined to the court in Se eee: and he begged to be excused from serving. The Court replied that it could not interfere in the matter, but if the unanimous consent of the counsel could be obtained to his plea, he could be eXeused on that ground, but on no other. The several counsel consented, and Mr Fowler ismissed, and wr. Richard Butt was taken in bis place. ‘The jury were here called, and the Clerk pro- to read the indictment, which had been found against the prisoner. The witnesses for the prosecution were then call d and sworn Mr. Maury, for the United States, proceeded to State the case to the jury, saying that it was one of gary importance, and one that shocked the senses of the entire community. He alluded to the sense of Legmesria§ for life and its pele @s that had see pega on Teg blic mind in c wence of the per; ion of this most atro- clous ‘murder The ore of the alleged crime was dweit upon at length ; and the extreme youth of the victim enia: upon, as well as his esay apes from bis tender age, to give provoca- tion for so dreadful and diabolical an execution of vengeance Mr. Maury then proceeded to state the law de- fining the crime of murder, and stated in brief what was expected tu be proved on the Part of tbe prosecution He allnded to the evil days upon which the community bad fallen, and the necessary impres- sion on the public mind, tbat the strong arm of the law should be put in severe requisition to ¥ at once this recklessness of the depraved and lawless, and thereby restore confidence and peace again ia community now outraged to an ex- treme ai ting almost to social disorganization. Mr. Maury closed, and was followed on the part of the defence by Mr. Ratcliffe, who con- +atulated the jury that thediticulty experienced . the outset of this ease, in floding a jury, had at length been overcome, and that they were now prepared to enter ye the trial. He compli- mented the jury on their good sense and judg- meut, and proceeded to enter into an explanation of the position which the defence occupied in the trial now pending He changed the jury to avoid, in this investi- tion, all thonghts which were calculated to axpire sympathy or invoke prejudice, and to en- ter upon the trial with calmness and deliberation Worthy of acase of so much magnitude. and in- volving so many deep interests. No one could deplore the commission of this crime more deep- ly than the unbappy and unfortunate prisoner when tn bis lucid momests He was in that con- dition that abundantly proved this hypothesis, as would be shown in ewdence; no man unless a devil incarnate could do so diabolical an act, un- Jess laboring under mental aberration. He alluded to the tac! that the prisoner, after the commission of the act which bad placed him im the cba acter of a murderer most villainous, had returned to Lis house and calmly sat down to a repast of oysters; he bad been ina state of intoxication since the month ef December, and Was on that day intoxicated, and his mind in a completely motbid state Dir. R. stated that tbe family of the prisoner Were all more or ess insane; hike mother and sis- y mad, and argued that in- ry with the prisoner Mr. R. closed, and after the Jury had taken a short recess, the examination was goue into by caliing, forthe United States, John Stanton, who was giving bis evidence when this report closed. These Sib- ley tents are tall, conical tents, twelve feet high, and twenty feet in diameter, open at the top, with a vane to prevent its smoking, which does not quite do. Witha stove or fire built in the middle,it is a great improvement in the com- fort of the soldier, but not us good as a wall tent, witb a stove, for an officer. { said we have abundance, but inasmuch as no one. from the Governor and civil officers to the private soldier, can obtain more than one ration, we have nothing to give in the way of hospitality, for if I invite my neighbor to dine, he would eee .o- if he ot staid at home, aang sl lamaged his eating my ration. The regular diner out would fare badly here. What genius and tact he must be endowed with if he could procure an invitation ' ‘The day before the reduction took gave a dinner to the Governor, Chief Justice, &c., on our surplus in the larder. Since then I do not think we could feed an extra rat at our mess, such is our health and so nicely is the quantity allowed adjusted to the measure of our wants. we, of course, find it irksome here, but time wil soon roll round, and we shall find ourselves again in the midst of those we love and admire. Until then we must be patient. We fear our friends will suffer from groundless apprehensions on our account. We have no reason to coinplain of any thing but absence from our families Some think the Mormons, when it necessary to make the issue with them, will submit tothe goveranee I do not agree with them. 1 think eir fanaticisin and villainy wili lead them to try one encounter at least; and I think our Gov- ernment ouyhbt to desire it, as affording a simple solution of a digjcult political qaestion. If they resist, a final settlement wonid be on the basix of aconqnest We could then dictate to them the terms of adjustment. Brigham Young wrote to me a few days since, sending, as a present, some 800 pounds of salt, or if preferred, we might bay it for the troops. Knowing they would enfertaina fiendish delight in the knowle ose that we would starve or freeze, neither of which we intend to do, although we have no salt, I sent it back to him with this mes- sage: “Brigham Young and bis associates are in rebellion against the government ; that until they return to their allegiance and obey the laws, will accept ne favor or courtesy from them, nor hold any correspondence with them ; that when J advance, the people who remain ut their homes or engage only in their private business, will be undisturbed. If! find them arrayed in arms I will attack them wherever | meet them; that if they entertained the deiusive hope that the army would retire from the Territory, they had better banish it; that the army will never iake one step back.” A. 8. Jounston. er MONO SEI tp The Overthrow of Comonfort. Pull details of the recent Mexican revolution show that the overthrow of the late government has been complete. On the 11th of January, Comonfort, closely besieged in the capital, issued a final appeal to the nation to come to his sup Port, and from that time until the 2ist, with oc- casional intervals for the purpose of negotiation, the belligerent forces were almost constantly en- lace, we On the morning of the 2ist the city was at the mercy of the reyolutionists. Comonfort had abandoned the Plan, and taken refuge in flight, accompanied by a few adherents. Gen. Zuloaga immediately nominated a House of Representa- tives to proceed to the election of a President ad interim, and the choice fell unanimously upon him, the chief of the “ Reformed Plan of Tacu- baya.”” Zuloaga took the oath before the House, and entered upon his duties on 22d January. Comonfort dictated his last dispatch from the roadside inn of San Antonio, on his way to Vera Cruz, placing at the disposal of the Guvernor of that State the troops who had remained faithful to the Government. He also Promised, on his arrival at Jalapa, to issue a manifesto detailing the recent events in the political history of the country, and explaining his own motives and conduct. The manifesto has not yet appeared. The ex-dictator will probably find leisure to write it in this country. A letter fram Mexico dated from the 25th says: ‘A new ministry has been formed, composed of Lonis Cuevas, for Foreign Relations; D. Hi- laro Heiguero, for Justice; D. John Hierro Mal- donado, for Fomento; aud per interim for Fi nances, and Parro for War One of the agents of Santa Ana, Geneial Cortes, was arrested at the Point San Francisco, and is now rigerously im- crernee in the barracks of the Defenders of Or- jer ‘The return of Santa Ana is, nevertheless, freely debated in political circles, and bts resumption of office, after the fourth or fifth exile, would Surpiise no one versed in the mutations of Mexi- can polities. That his downfall would come just as surely might be predicted with tolerable certainty. At present, such is the confusion and agitation among the several States of the confed- eracy, and such the ambition of a number of Prominent men to leap into Comonfort’s vacant seat, that a condition of things uot very far re- moved from anarchy may be said to exist UF The public meeting that did not take place in New York, called to opouse the admis-ioa of Kansay into the Union, was very large. His letteron the subject has been read in ail the churches, in which be calls atten- tion to two classes—the drunkards themselves, and the dealers in liquor. Leaving to the pastors the choice of the particular means to be used, he auggests that each should keep a list of thedrunk- ards and liquo:-dealers in bischurch. He says: “Lam determined to make use of the most se- vere measures against all who are addicted tothis scandalous vice; and if they continue in the prac. tice it, they must do it ax outcasts from the Catb- olic Church, who have no right to the name of Catholic while they live, nor to Curistian burial when they die.” Bae ee hy 11™ On Wednesday morning a negro woman, slave of Mr. Law ence Smith, of this city, gave birth to an anomaly, which hax set tho wits of the dootors ayog to comprehend “The child was perfect in its feet, legs, arms and the lower half of its body.
