Birch was continued by the defence calling Charles Thompson, sworn —Was a pattner Birch at the time mentioned as the nigne of the shooting; after Lanaban and Book had the room and gone ont, the crowd, some twelve or fifteen in number, followed; at that time Birch was in the back-room with bis wife; Birch then came in the bar-room and went out at the front- door; ina few seconds after that Witness heard the report of a pistol; Birch could not have been more than twenty steps from the house at that in- stant of time; he was Perfectly sober; in another minute be returned into the house; he was dressed in a ligbt-drab coat and black hat; there was no Teon in the bar-room when the pistol was red—that is to say, no frequenters of the place; witness thought something was brewing when he saw all the crowd go out; Birch returned — upstairs and took his coat and bat John Cunningham, sworn —Was barkee at Birch’s at the time of the shooting: went out of the bouse at thetime Birch did, and both walked together as far as the arch. when, hearing a pistol discharged, Birch remarked that the place was getting too hot for him, and he was going home; he did so, and witness followed him, and on en- tering the house Birch went into the hack room. John Normile, was arrested under Suspicious circumstances by officer Daw bf the first district police. ‘Phe dwelling of the Hon. H. F. Clark, having been robbed, and also the dwelling of Hon. John Slidell, by burglars, the suspicious conduct of this man caused his arrest. but there being no certainty as to his being oue of the burglars he was released. Last evening he was again suspected and arrested, and lodged in the west lock-up. And Captain Klopfer ob- tained a search warrant to seareh for the stolen goods, but being unable to find anything belong- ing to either of the gentlemen n ed, the pris- oner was ayain released this morning. ‘The articles taken from the residence of Mr. Clark were principally silver ware. The resi- dence of Mr. Slidell was entered by boring out the door panel next the lock. ew pie were seen at Mr. Stidell’s, and chased, and they threw away the stolen goods as they ran. Harrington, Mr. G. Kirk and ‘Mr. C. Edelin—be appointed to obtain a suitable room for the celebration of the Sth of January, and that the said committee be authorized to em- ploy a band of music, furnish a collation and all the necessary fixtures for the occasion. Resolved, That Mr. G. Kitk be a pointed to Procure three hundred tickets, and that they be distributed among the members of the Associa- tion, for sale at not more than one dollar each.
