Birch. * Mr. Rateliffe appeared for the defence, and at- gued the propriety of the Justice taking bail in this case. Justice Donn said that probably Mr. Ratcliffe would Ike to go to the Infirmary and hear a= han’s statement. The Justice recapitutated the statement of the injured man. From this state- ment and that of others it appeats that Lanaban met Hook af Dabant’s restaurant; that Hook, stating that he was a “ Plug,” expressed some feacs of being assailed om his way to bis board- ing-house. J.anaban thereupon said that he be- longed to the op ite party, and would protect him at the risk of bis own Ife. Hook and Lana- han then proceeded up the avenue together, in the direction of the Capitol. When between First and Second streets, in the neighborhood of Birch’s restauant, some person struck Hook, and as Lanahan turned he was hit in the face, and he saw Bireb with the pistol in his hand. Justice Donn said that the statement of Lana- han was made very reluctantly, but he finally as- sertéd, two or three times, that Birch shot him ; but he didn’t want Bisch prosecuted, because he had a wife and children. Mre Ratcliffe then introduced the timer of the ommnibuses at the Capitol: Joseph Codrick, who was sworn, was standing at the corner; saw two young gentlemen fees | down the street; saw one of them put his han down as if to pull out something from his clothes, and the other threw a brick; the other fired a pis- tol; don’t think I would know them again if I saw thent, saw them distinctly; one was ataller man than Birch, the other much smaller—a boy; am sure neither of them was Birch; it was only pistol fired; I strided off the distance I was from the spot, and it was about 75 feet. John Rrowers, special policeman, sworn.— Went from Third street around to Marylan1 ave- nue with by pune, Lomax; upon our return heard a pist: red; started to run in the direc- tion, and my partner sald ‘‘don’t run, it is only some one firing in the yard;” I kept on,and when 1 got on the avenue heard some one groan ; went over and saw it was Lanahan ; asked him who shot him; he said he knowed the san-of-a-b—h who did it, and he would have revenge; I asked him again, and he said Joe Birch; L Wirned and told Mr. Carter, one of the special police officers, that we had better arrest Birch on what Lanahan said; we went up to the restaurant and arrested bim at bis door. Messrs. Fenwick, Shekels and Thompson, who were put on the stand, knew nothing of the suoot- ing, but the two last were examined—Mr. Shek- els as to the conversation between Hook and Lan- ahan, previous to their starting for Hook’s board- ing house; and Mr. Thompson, in reference to Birch’s presence, a few seconds previous to the firing of the pistol, in his restaurant, and the im- probability of his ability to go to the scene of di-- order, and return in the time he was absent. This morning an officer was sent to bring Hook to the guard bouse. Upon his return he reported that Hook had left his bearding house about an hour before. Justice Donn decided, in view of all the cir- eurustances, that he would not be justified in taking bail, not knowing the condition of the wounded maa. As to the opportunity for obtaining other testi- mony, be was not at all disposed to oppress Mr. Birch. and in order to give Ohm an opportunity to produce other evidence, and to hear more of the condition of Lanahan, he would Postpone the hearing until this afternoon at the county jail. This being agreed upon, Mr. Birch was com- mitted fora further hearing. Up to noon to-day, the condition of Lanaban is considered to be very phonies with stro probabilities that he will not survive the wound. The ball eutered the right breast, about ove inch above the nipple, and probably lodged in the lung. The result cannot be determined at pres- ent It will be remembered that Lanahan and Birch had a difficulty on the race course some time since. Later—Lanahan is sinking rapidly, and, it is thought, cannot survive long. A QuaRReL azour 4 Brxom Wipow.—Two young men, working in the Navy Yard, have been paying their “devours” to a beautiful young widow in that neighborhood, but which was the favored one was hard to determine. Both of the young men were of the right sort; both good look- ing, Sober. and industrious, and each ph his ad- dresses with an ardor and determination which in many cases would have insured success com- plete. Of course the relations between the two competitors for the smiles of the fair idol were not of a fraternal character, and the mischief- loving boys about the Navy Yard hill getting wind of the affiir, in order to bring about a crisis, got =e a bogus challenge, which was directed to one of the parties, as if coming from his rival swain. The party receiving it rashly exhibited the document to a friend, who fearfal of a san- peti Pie pees between the rivals commtii- cated the dread intelligence to the constables that 2 mortal combat was about to be fought, which might result in the death of somebody on the field of honor. The otficers, as in duty bound, proceeded to investigate, and had the Principal parties summoned before a magistrate, when the whole affair was exploded, to the mutual gatis- faction of all concerned. The beautiful widow is of course overjoyed that no biood is to be shed on her account, and the joke is very much rel- ished by the entire population of the Navy Yard. Whenever that travel, in past times, hax been suspended by acts of Providence—such as flood and ice—it has been — and justly regarded too, as the greatest public calamity to the {nhabitants of the cireum- adjacent shores. Why, then, should man, orthe interests of half a dozen men, be allowed to in- flict se great a calamity upon thousands and tens of thousands suffering people at the beginning. or, who can tell, how long and how severe a win- er. when no public consideration is to be secur- ed by it? “sufficient uuto the day is the evil thereof.”’ Let the ( Spee temporary communi- cation stand until all the masonry is finished; no time could ever be more disastrous for town and conntry than the present, and for sixty days to come, to cut off communication, which, if jnter- rupted now, may not be restored fer months to come. Vikeinia. November 14. Circeit Covrt.—The arguments in demurrer of the plaintiffs’ counsel in the case of Statham, Smithson, & Co, rs. Wm. H. Mann, were con- tinued yesterday up to the time of adjournment. The several points in the demurrer were argued with Sipe abjlity by the connsel on both sides; and the Conrt decided to hold the matter over for consideration This morning the Court met. and the decision ot their hono-s in the above case was given. They overruted the demurrer, and Mr. Davidge, for the plaintiffs, announced that they were ready to go into the trial ef the case at once before a jury. The Court then took up the case of Dennis Connel rs. John Chrisman. This was an action in replevy, brought to recover a horse. It seems that Conoel proposed to trade horses with Chris- man a trade was — upon, and Connel was to pay Chrisinan the sum of $12 boot money. Connel wished to ride Chrisman’s horse home to get the boot money, and Chrisman refused, say- tng that he must take the horse as he stood in the stable. This was agreed to, and the horses were exchanged, the Loot money paid over, and the horse received by Connel proved to be worthless. Hence the suit to recover the damages. This case was pending when this report closed. Distaxces —It isa mile and a half from the northern end of the Navy Yard bridge te the Capitol, 2 mile and a half from_the Capitol to the Executive Mansion, and a’ mile and a half fom the Exeeutive Mansion to the corner of fligh and Bridye streets, Georgetown. New Breap Bitt —Mr. Jefferson, last night, in the Council, reported from the Police Com- mittee a substitate for Mr. Brown's bill regulat- ing the quality and weight of bread. Tr provides that bread shall be made into loaves of three sigesor weight: first size, between 16 and 18 ounces ; second, between 32 and 35 ounces; third, between 64 and 65 ounces.
