If it be not, no one will be injured; even the small sum of $10 is not required to be until the subscription be eompleted, and the partition shall be made by the trustee, assisted by two justices of the peace. In the mean time checks in favor of the trustee, or other eye ogee arrangement for the subscription may be made, not to be used til! the day of partition.
