LOCAL INTELLIGENCE. Crrmrxat Court.—The Seventh Ward Riot Case —Mr. Key concluded his opening address to the jury, yesterday, at a quarter to one o'clock, m : John L. Smith, Esq., who appeared for War- noch and Wm. Williams, sere the agora ting that he would leave one of his pe poems, , to the tender mercies of the jury, the evidence being so strong at as to Jastity such course. In regard to Williams, he contended there was not a particle of evidence showing that he was implicated in creating dis- turbance on election day. It was true that Wil- liams went out under the flag-statf and cried out «Now, boys, let’s to the Fifth Ward polls!" but this afforded no evidence that he participated in the riotous acts charged in the indictment. . Mr. Carrington next addressed the Cou:t in be- balf of Jesse Williams, Isaac Stoddard, Wm. Wilson, and John Webster Taking up first the question, “« W hat constitutes a riot ?’* he claimed that three essential requisites were demanded : First, an assemblage of three or more persons with disorderly par, ; secondly, a concerted understanding to unite with such common pur- pose ; and thirdly, the actual accomplishment of such ed "Mr. Carin ies; na plea which may be ranked amongst his t efforts, proceeded to urge that the charge of such riot was not sustained by the evidence against bis clients; that the great ex- citement under which they labored was but a natural ebulition of feeling caused by the an- nouncement made by Webster that the Marines had been called out to shoot down American citi- zens; that the accused parties were men of re- spectable and honest lives, and in conclusion in- sisted that the series of acts which go to constitute a Tiot did not occur at any time during the day. Mr. Key, in closing for the United S@tes, in reviewing the arguments of the counsel for de- fence, said he was struck by the adroitness with which they smothered the evidence for Govern- ment in relation to the actual accomplishment of their concerted movements toward a disturbance of the peace; and in preventing legally qualified voters from exercising the right of sutfrage. He went on to show, with great clearness, that men may be engaged ‘at different points of the same scene of action, in driving away voters ; beating them and tting them in fear of their lives; and that tae leeds show concert of action. though the perpetrators may not even have known each other; that they were as guilty ax if they bad all been engaged in each individual deed of violence ; that the acts constituted a riot inevery sense of the word; and that these transactions were most infamous disturbances of the peace, ferences with the privileges of the legal and naturalized. n concluding, asked that the follow- ing instruction should be given tothe iy which was approved by the Court and readily acqui- esced in by the defence ; * If the jury believe from the evidence that the defendgnts were acting together, and that their common object was to exclude a certain class of citizens from the polls aforesaid by threats and intimidation, and by taking possexsion of the ground near the window where the ballots were deposited, and by threats and violence, did in- timidate and drive away certain citizens, they are guilty of a riot, although they had entered into no agreement so to do, and were unacquaint- ed one with the other.”? ‘The jury then retired to make up a verdict, and after and hour’s absence returned with a verdict of sew Gre indicted, in the cases of William Warnach, is iam Wilson, Isaac Meddard aad William Williams. Jesse Wil- liams was found not guilty. The defendants were called by name, and Wm Warnach and Wm. Wilson not answi i vecegnizances were declared forfeited. sureties are James H Birch and Jackson Pum- phrey. Judge Crawford proceeded to give the sentence ef the Conrt, which was, that all the parties con- victed be imprisoned in the county jail for one year, and each to pay a fine of 220. Judge Crawford, in delivering the sentence, commented upon the heinous nature of the offence of which they stood convicted. striking as it did at the very foundations of government. He re- gretted to see men, who had hitherto borne a good character, engaged in such acts; and especially Wes he sorry to know that, among them. was one who had been a cc officer of the county. He remarked upo®the paramount necessity of main- taining the freedom of our elections inviolat and of the intimidation of voters as even more of 4 public thana private wrong. Naturalized citi- zens had equal rights with native citizens, under our laws, and these rights must be maintained. The prisoners were then removed to jail. They had throughout the trial deported themselves as if anticipating an acquittal, or at most conviction with a light tine, and they were proportionately —— on being sentenced to imprisonment in jail. The Court then took up a case in which Thos. J. Thomas was charged with assault and battery on Charles W. Arnold on the 19th inst. Thomas was found guilty and fined $8 and costs. This merning the Court met at ten o'clock, and the first case taken uy was that of T. O'Leary, for assault and battery on Simon Richardson, a free wegro. Case submitted to Court. Simms first opened his eyes with wonder. and then started off to consult his neighbors. They advised him to inform the lice, and he made his way to Justice Row- ands to lay the case before him.
