A communication was received from the Mayor enclosing the bank aceount of the Cor- poration ' Mr. Emery, from improvemen's committee, reported a bill for the construction of lateral sewers in the Fourth Ward; passed. The police committee asked to be discharged from the consideration of the petitions of Mary Savoy and Robert Devereaux ; committee dis- charged. . The bill from the Council providing for the cleaning of Centre Market grounds was passed. And the bill from the same Board for the relief of the Franklin Fire Company was re- ferred to the fire department committee. The same Board insisted on their amend- ment to the Surveyor’s bill, and asked a cor- ference committee Messrs Busey, Moore and Smith were ap- ited the committee. "lace was received from the Sec- retary of the Trustees of Public Schools; re- ferred to public schools committee. r A long debate ensued on the joint resolation relative to municipal advertising, in which Messre. Moore, Riggs, Houston, Tretler, Bu- sey, Dove, Evans and Smith participated Mir Riggs offered a substitute for the joint resolution, giving the tax list to the paper having the largest number of annual subscri- bers. Mr Miller further debated the resolution. {The conference committee reported that the Common Council agreed to the amendment of this Board to the bill prescribing the duties of the Surveyor and Assistant Surveyor of the Corporation. | - Miller proposed to amend the substitute #0 as to give it to the National Intelligencer Mr. Houston moved to postpone the subject indefinitely; passed—ayes 9, noes 4. Mr Moore offered a joint resolution relative to the municipal printing. Mr. Busey moved to amend by inserting that the amount appropriated be sufficient to complete the work - passed. Case Diswissen —Last night, Mr. J. W. Barneclo appeared at the office of Justice Donn to answer the charge of obtaining goods amounting in value to over $1,100, under falze retences, from a Baltimore merchant named ich Mr. Carrington appesred as counsel for the provecution, and Mr. Ratcliffe for the defence The examination of witnesses and the arguments of the counsel occupied much time, after which Justice Donn dismissed the ease, giving the following reasons for his de- cision: A case of false pretences was oot made out; it was the duty of the merchant to use proper caution, and if defendant bad made a false statement it was very eazy to controvert it. Barneclo, it sppeared, offered no induce- ment to the merchant to give him credit, but made a bare statement of what he considered his condition at the time. The subsequent acts of the prosecuting witness and the de- fendant showed clearly the absence of any fe- loniousiatent. Plaintiff had eent a stock of goods to defeniant who found there was more tent him than he wanted, and he immediately returned them to the merchant.
