These men shoulder the musket, and drill as good as soldiers, attend the reviews, &c. I have said previously that there were clergy- men in the Committce, probably twenty in number, mostly Methodists, but a few of other denominations. In nearly all our churches (Protestant,) pastors have spoken and preach- ed approvingly of the Committee and of their acts. I may enumerate the Right Rev. Bish- op Kip of the Episcopal Church, Rey. Messrs. Briggs and Thomas of the Methodist Churches, Rey Mr. Cutler, of the Unitarian, Rev. Mr. Willy of the New School Presbyterian, Rev. Mr. Lacy of the Congregational, and Rey. Dr. Anderson of the Presbyterian Old School, and many others whore names I do not now recol- lect. The Rey. Dr. Scott, I believe, is the only clergyman who has refrained from allu- ding to the subject in his pulpit. He is, how- ever, not friendly to the acts of the Commit- tee, and the Elders and Trustees of Calvary Church made a formal request that he should not bring the matter before the congregation, bu simply to preach Christ and Him Crueified to his hearers I have no doubt that had Dr. Scott been in the city at the time of the or- ganization of the Committee he would have spoken out boldly against it. Atall events, tho law and order men claim him as their friend and advocate. i In regard to the public press of the city, all in favor and strongly endorse the acts of the Committee, and except the Sun and Herald, whose circulation combined is not robably more than two-thirds of that of the Buttetin, while the Alta, Chronicle, True Californian, Town Talk, Globe, and some three French papers, and all dailies fully indorse the Committee So also do all the weeklies, not excepting the Christian Advocate, the organ of the Methodists, and the ‘ Pacific (new school ) The press throughout the State, and so also of the large majority vf the cite zens of the entire State, are ‘ vigilaates,”’ and in case of need are with us. I answer, to rid the city and State of the murderers, rowdies, ballot-box stuffers, and such like men, who have stolen our birth-right and made slaves and hirelings of those whom they by force have driven from the polls at the mouth of the pistol, shoulder, or knife; and who have controlled our elec. tions by the use of false bottomed ballot boxes, and thué foiled the known and express will of the people, I will, in passing, say that the strongest opponents of the Committee are Southern Democrats; but few of any other Party or section, except Irish Catholics, keep aloof, and some of those were kept out with the idea that the original movements was for political effect, and of a ‘ Know Nothing” stripe ; but this is not true in any respect. 7. fact, I know of leading party men who were inclined to talk loud, (with a leaning towards politics,) in the Committee rooms, who were politely notified to withdraw as members, and this for no other reason, than to prevent the introduction of politics into [the Committee’s gi n. Now, to come back to the all-absorbing and engrossing theme and topie of the day—the Terry trial. I beg, first, to remark, that if not mistaken, it is necessary for the Execu- tive Committee, acting as a jury, to give» majorify vote to decide a case; that done, their verdict, and the entire testimony taken on the trial, go to a board of delegates for concurrence. Theso latter are composed of the captains of each division, and two mon chosen from their respective companies; so that there are with the field officers (also del- egates) some 1i2delegates. A two-thirds vote (er majority) is necessary to carry a verdict of guilty or acquittal. It is generally under- stood that inthe Terry case there wasa tie in the executive body; or, if not so, a bare majority in favor of acquittal; while, on the otber hand, the delegates are almost to a man in favor of a verdict of guilty. If the two combined bodies cannot harmonize, of course a& nvon-suit wiil be the result, which will probably be the lastof the case. 1 think now that the chances are decidedly in favor of Terry's acquittal by the @ommittee. He may be sentenced to banishment from the State; but the difficultios in the way are so great in this case, that it would be almost an im- possibility to carry into execution any sen tence that might be pronounced against the Judge of the supreme court of California, with several years of his unexyired term yet to serve out. Bat any man guilty of even one- half of the acts charged and proven against D.S. Terry, should resign his high office and let the people of the State of California write guilty or not guilty upon his brow. The blow inflicted by Terry upon Hopkins, with his knife, passed directly through the velvet coat collar and neck handkerchief, and came witb- in about one inch of passing entirely through the neck of his victim; and yet Hopkins liver, and is riding about the streets. I trust an- other fortnight will decise the Terry case. His wife comes to seo him daily. It ischarged upon the Masonic fraternity, that they have been to work and influenced the vote of the Executive Committee iu this case. I hope he will at cast vacate his seat cn the bench Thus far I had written, and read to a friend in the secrets, when he penned and added the following remarks regarding the Committee and the Terry case, which I fully indorse : “Judge D.S Terry has been tried by the ple of the State, and found guilty. He has een tried by the Executive Committee with the same results. He has been fully and fairly tried by the Board of Delegates, and they find him guilty, not only of the assault upon Hopkins, but upon sundry other persons during his California life. Enough has been proven against him to condemn him forever in the eyes of the people of this State; and we predict that when he leaves the prison bouse of the Committee of Vigilance, he will n dare to aspire to his former position of Judge of the Supreme Court of Californie. The tec- timony will soon be published to the world. “Ten thousand rumors are afloat as to the finale of this ease, and predictions are abun- dant as to the disposal of Terry, and ite effect upon the people and the Committee. Some predict an immediate dissolution, and a gen- eral disbanding of the association. Some may doubt the power of the Committee to do as they lease with Terry. For six long weeks they toe held him captive, and his friends have canvassed the State, have made inflammatory speeches, have resorted to falsehood, and all other measures, to arouse the people and rally them to the relief of Judge Terry; to rescue him from the so-called ‘infuriated mob.’ But ‘Fort Vigilance’ still holds the Judge, as surely and as securely as on the day ot his assault and arrest. Some doubt the ability of this Committee to punish Terry, but rest sured, that simply because they have and hold that power, they will not abuse it, in this case, or in any other.’’ Thus writes wy friend. Now in conclusion let me add that this Vigilance Committee is composed of the poor as wellasthe rich.
