Local INTELLIGENCE. {ax Hersent Case.—Shortly after twelve o'clock, to-day, the jury in the Herbert case were, by consent of counsel, discharged, there p nee ln t of their being to agree upon & ve! We learn that the jury stood seven for ac- quittal to five for a verdict of manslaughter, and, though there were variations from these figures in the course of their deliberations, there was at no-time less than three for a ver- dict of manslaughter. I The commencement of a new trial is as- for to-morrow, when we me there will be another protracted task to secure a 27; It is rumored that new evidence is to adduced on this new trial. When we left the room to-day, the court was engaged with the case of the negroes charged with firing Shreve’s stables. Various council bills were referred to ap- propiate committees The Board receded from its amendment to the bill furnishing copies of the Corporation Laws to new members, and which amendment supplied the police officers of the city with copies also. Mr. Ruff introduced a bill in relation to the salaries of teachers of the public schools; re- ferred to schools committee. The tax bill was received from the other Board with an amendment striking out 65 cents and inserting 60. Mr Houston said that to him it looked like child’s play sending the same bill back to the Mayor that he had just vetoed. ‘he question of concurring io the Council amendment being taken it was not agreed to— ayes 7, noes 7. On motion, the nomination of Dr. A. H. Young, a physician of the Fourth Ward, was taken up and confirmed The nomination of Joseph P. Hough, as Police constable, was taken up and rejected. Mr. Bayly called up the nomination of Jobn Waters as Market Master. He had made inquiry in regard to the complaint brought against him by Mr Richardson, of abusing bim at bis stand in the market, and was sat- isfied that it was a very trifling affair. Mr. Waters was a most efficient officer, and had _— general satisfaction under different ‘ayors by whom he had been appointed. . Evans proceeded to detail the circum- stances of the affair upon which the com- plaint was founded. r. Richardson, while speaking of the disturbance at the City Hall meeting, was approached by Mr. Waters who called bim an infernal liar. Mr. Bayly thought thisa very trifling mat- ter to bring there Complaints had been Drought there in regard to Storm while Mar- ket Master, but they had never influenced bis action, and he had never thought it worth his while to pay attention to them. Mr Busey said here were two entirely dif- ferent statements, and he would like to get at the truth of the matter. For his part he thought a little swearing about that market- bouse would not do any Cara He su; ited that a committee be appointed to look into the matter. Mr Miller inquired if they were to enter into personalities occurring on the street? Mr. Waters was one of the best market mas- ters they had ever had, and was universally Ls fter some further debate the question of confirming the nomination of Mr. Waters was taken, and it was rejected—ayes 6, noes 8. r Busey moved to reconsider, and to post- — the motion to reconsider until next Mon- ; carried. r Riggs. from finance committee, reported back the biil accepting the bequest of Stephen € Ober, and autiozizing the Mayer to invest it in Corporation stocks for the benefit of the poor of Washington, with au amendment au- thorizing the Mayor to receive and give re- ceipt for the same; laid upon the table. _ Mr. Busey called up the Mayor’s nomina- tions. Mr. Evans called up the nomination of R. B. Owens. Mr. Moore read some correspondence, ex- culpating Mr. Owens from the charge of hav- ng ameeacted the Fourth Ward transfer lists, .» de Mr. Evans said be knew nothing of the pa- = The oaly objection he had to Mr. wens was communicated to him by a gen- tlema, a political friend of the nominee, who represented to him that Owens waz too vio- lent a partisan to do a political opponent jus- tise Mr. Bayly and Dove inquired the gentle- man’sname, which Mr Evans declined giving. Messrs Moore, Dove, Miller and Bayly testified to the ability of Mr. Owens to per- form the duties of the office satisfactorily. The vote being taken the nomination was rejected—ayes 4, noes 10. Mr. Bayly gave notice of reconsideration. Geo Fulmer was rejected as Commis- sioner of the Washington Asylum—ayes 4, noes 10. Mr. Dove inguired of the gentleman from the Fifth Ward if there were any other objec- tions to Mr. Fuimer aside from his religion Mr. Busey denied the right of the gentle- man from the Second Ward to catechise him Mr. Dove said he questioned him because be had awnounced his platfurm, and announced the reasons which would govern his votes. Mr. Evans thought they had fallen upon times when the vote by ballot fad beenchanged for a viva voce vote, and an ex- lanation of the reasons influencing each vote. Mr. Smith said he was a party man and his rule cf action was to vote as a party man. Mr. Houston warmly repudiated an: rule of action to govern his votes. carded any such ides as voting against a man merely because the Mayor who appointed him ‘was a political opponent. A motion to reconsider was lost. The nomination of John R. Queen, as Inten- dant of the Washington Asylum, coming UP, Mr. Busey said if the Board would indemni: him for a suit of slander he would state his reasons for opposing the nomination. — The nomination was rejected—ayes 5, noes 9. Wa. P. Locke was rejected as Messenger ; also the following Police Constables: John W. Reynolds, Henry Yeatman, Hugh Dough- erty, and Jos. Mitchell. Michael Connor was confirmed as Clerk of Eastern market - D. Spencer was rejected as Clerk of Western market Richard Wimsatt and Jos. Z Williams were Tejected as Wood and Coal Measurers ; Jos. Z. Williams was rejected also as Measurer of Grain and Bran. A.N. Clements and Ernst Loeiiler were con- firmed as scavengers. Martin P. King was rejected as Apothecary in the Fifth Wari, on the ground that he re- sides at the extremity of the Ward. _ The nomination of Dr. W. B. Batt, as Phy- Melan of the Fifth Ward, was objected t» by Mr. Busey on the nd that Dr. B. was not a resident of the Ward. The nomination was i a Ba 5, noes 9. r. J. M. Grymes was confirmed as Com- ponies of the Board of Health for the Fifth ‘ard. Mr Smith introduced a bill providing for the election of police magistrates; which was laid on the table. A bill introduced by Mr. Smith in relation to the inspection of lumber; referred to police committee. : [Some disturbance was created in the cham- ber at al ages by the falling of one of the heavy blinds of a window, which in falling struck the head of the venerable messenger, Mr. Kleiber, cutting it severely. | Mr. Bayly, from the claims committee, pre- sented a bill for the relief of Morris Holloran, which was passed. The conference committee on the tax bill did not report prior to the adjournment, but it is unders that the Council amendment was receded from Ficutine in tas Market—The Centre Market, when not occupied by dealers, has been the lounging place, during the hot weather, for many lazy and worthless per- sons, who will not work and have no other abiding place. They frequently quarrel and fight among themselves, and yesterday one of the last mentioned exhibitions came off parte a number of colored individuals assembl there The officers have taken this matter in hand, and are determined that these disor- derly gangs shall be broken up. Tus Granp Jury resumes its sittings to- day. Although a very large number of wit- nesses have been examined in various impor- tant cases, a great many remain to be exam- ined, and other important cases are fo be dis- posed of, — which are those growing out of the escape of John Essex and the recent mur- der of Captain Bell, which may occupy the attention of the jury for sometime. The wit- nesses in the cases named are to appear to-day.
