The case of Dennis Cronan os. the United States was next called. Thisis a claim for com- pensation under a contract for hauling a/! the materials for the custom house at Ni ew Oriente. The Ground taken by the claimant is, that the commissioners were changed during the continuance of the contract, and thata second contract was made with another person to haul & portion of the materials; while it iscontend- by government that the contract with Cro- nan was terminated by the exhaustion of the appropriation under which it was made, and that, therefore, the commissioners had good — to make a contract with another person. ho argument was opened for the claimant by Hon.
