Wats, 1 Coxvicr.— Decision tn the Habsas Case.—We have heretofore published the petition of William Wells, to the bonor- able judges of the Cireult Court of the United for the District of Colambia. sstting forth that he was convicted of murder at the December term of the Criminal Conrt for the county of Washington, District of Columbia, (@ son of Mr. Mundell, of the marine corps. being the victim.) and was sentenced by said court to be hung on the 23d of April, 1852, on which day the President ot the United States _ bi pardon of the cffence of which @ was convicted, ‘ npon condition that he be imprisoned during bis natural life—that is, the sentence o! death is hereby commuted to imprisonment for life in the penitentiary at Wasbington ;” Wells, in the conclusion of bis Petition, seid, ‘- being duly informed by coun- sel learned in the law that the said pardon absolute, and the condition invalid, he prays the writ of Acbeas corpus may iseue to bring him before the court, and, if it is found thst his confinement is oy and contrary to law, he may be diecharged from bis imprisonment.” This case was ar; by Charles Lee Jones, Eeq:, for tho petitioner, and by P.B Key, Beq , for the United States, (ihe points of ‘whose remarks were given in the Star) This morning, the Circuit Court, through Justice Morsol!, pronounced ita decision. There- fore the application must be disosarged ; it coa'd not be ed; the Aabwus corpus mast be refused. According to this decision, Wells will remain in the penitentiary.
