After reciting the main points of the writ (which we published at length on Satur- day) @ said the question was, what power in this government could come between the sen- tence and itsexeeution? The power as thas conveyodto the President is absolute and unfettered. There is no necessity to consult any other branch of the Government. The Constitution, article 2d, sect 2d, says, “ and also have power to grant reprieves and pardon for offences agsinst the United States, except in cases of impeachment.’’ Then, in order to ascertain what is the limitation, and to what extent the President may use this power of | eer he (Mr. Jones) would first resort to the jaws of that nation whose langu: we speak and whose judicial system so nearly resembles ours, but whose Executive and ours widely differ. But the President of the United Sta:es exercises the ores is conferred on him a tution, and not as a prerogative. There is no analogy between them. Mr. Jones then glanced at the constitutions and the legislative and judicial acts of the various States of the Union, to show that in all of them the respective Governors (except- ing in South Carolina) have the power to grant pardon only in terms similar to those made use of in the Constitution of the United States respecting the President. In the course of his argument Mr. Jonesre- ferred to the only decision, as he said, given in the United States, going to show that the absolute power to on carries with it the right to pardon conditionally. It appeared that, in 1844, the Governor of Pennsylvania, David R Porter, pardoned a man named Wesley Flabell, who had been tried and con- vieted of murder, but who—it appearing that the prisoner was deprived of reason—was an- @onscious of the enormity of the act; and he was pardoned on condition that he be at once put on board a vessel, there to remain until ‘the vessel should sail fer Ireland. The power, it was decided in that case, was derived from the charter given to William Penn, and from common law. The President of the United States, however, is not governed by common law, but by the Constitution constitu tional statutes. And in support of this posi- tion he quoted various legal authorities, show- ing thas the Executive must be governed by positive law. There is no law in this District providing for imprisonment in the peniten- tiary for /ife ; but the President has not only oe this punishment, in the case of ells, but has performed the functions of the jadicial branch of the Government by sen- tencing and carrying into effect such an un- suthorized act of legislation. Mr. Jones spoke for more than two hours. Mr Key, for the United States, replied, say- ing that Mr. Jones had not cited more than one authority on which he could rely; and he (Mr. Key) maintained that from the year 1820 until 1852, when the sentence ot Wells was Commuted by the President, the whole series of decisions by the respective Attorney Generals shows that the President possesses such power— according to three decisions of Mr Wirt, one by Mr Grundy, one by Mr. Mason, and two La Mr. Crittenden; bese, Chief Justice rshall had decided the very point which the court was now called on to act. The readers of the Star will remember a poisoning case tried gt the last term of the Criminal Court, Cass Williams was one of the sufferers, and Delia Hazel was one of the suspected parties. The parties are near Se cca and no doubt the old case caused the last night, since we hear that one of the colored women ad mitted, by way of s bodst, that she had poi- soned the others Capt.
