ALASKA 5. 5. CO. OPENS TEST CASE ON INCOME TAX The first case testing the validity of the Alaska Net Income Tax law passed by the 19th Legislature opened this morning in District Court before Judge George W Folta. The Alaska Steamship Company, in the suit filed April 8, seeks a permanent injunction to enjoin the Tax Commissioner of Alaska from collecting income taxes withheld by the company in accordance with notice from the Tax Commissioner. A temporary injunction, covering quarter-payments due April 30, was issued last Thursday by Judge Folta. Besides challenging the validity of the statute, the suit involves ap- proximately held by the company in the first quarter of the year—some $8,000 from wages of vessel personnel and about $2,000 from salaries of other e¢mployees permanently or tempo- rarily in Alaska. Income tax payments are being kept in a special fund in line with instructions . from the District Court for the Western District of Washington State, in its temporary order enjoining the company from payment.
