SATURDAY, JANUARY 8, DRAFTEES & VETERANS 1949 GUIDE By MAJOR THOMAS M. NIAL Almost $175,000 worth of over- ayments from the VA to veterans was waived completely in October. Chat money (for subsistence allow- ance, compensation, etc.) does not fi®ave to be paid back, not a dollar of it. How come this happens? What do lyou have to do if you are a veteran who ot an overpayment to release “ourself from the obligation of pay- in: the money back to VA? The VA sends out millions of checks every month. Some of these gre pension and compensation eck me are for subsistence al- \gwance. Every once in a while the regional office making the pay- ments makes a typographical erroi or gets one name confused with an- other. Then a veteran is likely to et an overpayment. Or (and ths joften happens) the VA is not noti- fied that a veteran has left school and keeps right on sending subsis- tence allowance checks. ! » Well, if an overpayment is made don't you have to pay it back? Not # you can prove that the overpay- | ot ment was abeolutely not your fault, and that you didn’t realive your ° check was, in fact, an overpayment. In that case you stand a good ¢hance to be released from the ob- igation. An overpayment might go for weeks or months before the VA found out it had been made. As Péoon as it does though, your re- gional office sends you a statement, & rather a till, explaninz what happened and asking you please to refund the money. The letter also explains that you can appeal to the Committee of Waivers and Forfei- ftures at your VA branch office against repayinz the overpayment. If you don't appeal, you don't ave a chance to get out of making ghe refund. If you do appeal, and the com- ttee decides either of these two rings, then you have a good chance of keepiny the overpayment: 1. That, as stated before, it was not your fault the overpavment was enade. Y 2. Supposing you'd been going to school for two years full time, and had been getting your monthly al- lowance of $75. You had no de- pendents. Then one month your check is made out for $105. You know that $105 is the allowance for a stu- dent with one dependent and you know you have no dependents. You also know, then, that the VA made a mistake and you should have a very good idea that you owe VA the difference between $75 and $105. That's a case in which you would have a tough time proving the over- payment was not your fault. Be- cause all you have to do is notify .o VA and waitt for their bill ask- ne you to refund the balance.
