Together with the water rights of Gold Creek, which are used by the Alaska - Perseverance Mining Company, which waetr rights can- not be patented but are owned by continuous use and occupancy. For a fuller and more particular de- scription of these water rights, re- ference is made to location notice with owners claims to have a valid right to the occupation, possession and enjoyment of that tract or parcel of land, lying and being on the east side of Silver Bow Basin, in Harris Mining District, District of Alaska, for the exclusive right of way for the purpose of con- structing a flume or water ditch from the east branch of Gold Creek to the ten stamp mill, owned by the Eastern Alaska Mining & Mill- ing Company. The location notice was posted on the ground December 1, 1891, and recorded December 8, 1891, in book 4 of placers and waters, page 251, and in deed dated June 1, 1891, recorded July 5, 1891 in book of deeds, page 149. Also that particular water right known as the Lurvey Creek water right, which cannot be patented, but is owned by continuous use and oceupancy. For description of this water right, reference is made to location notice with owauers claim to have a valid right to the occus pation, possession and enjoyment of that tract or parcel or land lying and being in the Harris Mining District, District of Alaska, for the exclusive right of way for the pur- pose of constructing a ditch, flume or pipe line from Lurvey Creek to the Perseverance mill site, U. 8. Survey No. 68 B. Location was made by Joseph T. Gilbert, on the 2nd day of July, 1897, and duly recorded on July 6, 1897, in book 5 of placers and waters, page 199, Silver Harris Alaska, fuller description, to the deed dat- ed April 22, 1902, by Joseph T. Gil- bert, to the Alaska-Perseverance Mining Compnay, which deed is re- corded May 3, 1902, in book 16A, page 395, to which reference is made, describing the water rights of Gold and Lurvey Creeks, and Silver Bow Basin, whence U. S. lo- cation Monument No. 3 bears No. 82 deg. 00 min. W. 1520 feet dis- tant, thenee on line of said tun- nel S. 2 deg. 30 min. W. 3000 feet to a point vertically under the in- tersection of the north crosscut in the Perseverance tunnel, about 275 feet from the mouth of said tunnel. “Size of tunnel 7 feet wide by 7 feet high in the clear. “And said Alaska - Perseverance Mining Co. claim a line of tunnel seven hundred and fifty feet on each side of the center of the bore or course of the tunnel, and the right to all the lodes which may be discovered in the due prosecution of said tunnel, within seven hun- dred and fifty feet on each side of the center of said line. “Together with all and singular the hereditaments and appurten- ances thereunto belonging or in any wise appertaining, and all the rights granted to the locator as tunnel rights, under the terms of section 2323 of the Revised Statutes of the United States. “This is an amended notice made for the purpose of more clearly defining the notice of location of tunnel site, made August, 1901. “Said company also claims a square tract of land 150 feet on each side of the mouth of tunnel and extending 300 feet immediate- ly below the mouth of the tunnel, as staked upon the ground, for dumping purposes. “ALASKA-PESEVERANCE MIN- ING CO., “By C. This claim is situated on Gold Creek, Harris Mining District in Silver Bow Basin, Juneau, Al- aska. The Avon claim, located for the Alaska-Perseverane Mining Com- pany, by John R. Mitchell, agent, on October 6, 1905, and recorded on October 25, 1905, in Book 18 of Lodes on page 161 of the records of the District of Alaska, at Ju- neau. This claim is situated on Gold Creek, Harris Mining Dis- trict, in Silver Bow Basin, Juneau, Alaska. The Perseverance - Alpha lode claim which was conveyed to the Alaska-Perseverance Mining Com- pany by Hubert Powell Crowther and Christine Putnam Crowther, by deed dated June 9, 1910, re- corded July 2, 1910, in Book 22 of Deeds, on page 399. For more par- ticular description reference is made to amended location notice, dated July 2, 1910, recorded July 2, 1910, in Book 19 of Lodes, on page 551 of records of the District of Alaska, at Juneau. This claim is situated on the northeast side of Gastineau Channel, near Juneau, and nearly opposite to Juneau Island in said Channel. Jumno Exrension Lode claim, lo- cated for the Alaska-Perseverance Mining Company, by John R. Mit- chell, agent, September 26, 1910, recorded on October 1, 1910, in book 19 of Lodes, on page 574 of the records of the District of Al- aska, at Juneau. This claim is sit= uated on the summit of the moun= tains between Sheep Creek and Silver Bow Basin. Together with the following lode claims known as the Sheep Creek or Gastineau Group of the Alaska- Perseverance Mining Company which are as follows: Perseverance Major lode claim, located for the company, Decems= ber 14, 1907, recorded March 13, 1906, in Book 19 of Lodes, on page 574 of the records of the District of Alaska, at Juneau. This claim is situated on the summit of the mountains between Sheep Creek and Silver Bow Basin. Perseverance No. 7 lode claim lo- cated for. the Alaska-Perseverance Mining Company by R. F. Laffoon, on December 14, 1907, recorded on the 13th day of March, 1908, on page 237 in Book 19 of Lodes, rec- ords of the District of Alaska, at Juneau. This claim is situated on the summit of the mountain be- tween Sheéep Creek and Silver Bow Basin. Pescrverance No. 8 lode claim lo- cated for the Alaska-Perseverance Mining Company by R. F. Laffoon, on December 14, 1907, recorded on the 13th day of March, 1908, on page 238 in Book 19 of Lodes, rec- ords of the District of Alaska, at Juneau. The Martin lode mining claim, more fully described in U. S. Pat- ent No. 409026, survey No. 754, is- sued May 28, 1914, which patent is recorded in the office of the re- corder for the Juneau Recording District, Juneau, Alaska, in Book 25 of Deeds, pages 471 to 473 in- clusive, to which record reference is hereby made for a complete de- seription of said claim. The McKinley, Hanna, Winn, Fisher Fraction, Watts, Rae, Ro- land, Sweden, Norway and O. M. Gillette lode mining claims, as de- scribed in U. S. patent No. 489,690, issued to John R. Winn and L. R.
