SEA DEMOCRACY UPHELD IN HIGH ! COURT’S RULING WASHINGTON, vessel, because she is big, has no superior rights on the sea, and must stand away from an humble lumber carrier when the maritime rules require. If she fails to do s0, and collision results, a claim; of mutual fault will not be per-| mitted. April 18—A big High Court Rules This is the ruling of the United States Supreme Court in the case of the passenger steamship New- port of the Pacific Mail Line, which ran into the lumber schoon. er Svea, twelve miles off the Cali. fornia coast in 1922. It was a clear day. The vessels were long in sight of each other, and their courses crossed. Each one kept straight ahead. Svea Upheld The Svea, although much small- er, had the right of way, and the court holds that her master prop- erly relied upon the Newport mak- ing a turn in time. Twenty min-| ter of the Newport, Captain Mc- utes before they struck, the mas- Kinnon, left the bridge and the) third officer, who was on his first voyage, was left in charge. The son requiring his absence, the court observes. “Big vessels may not in.mlm\(l)I disregard smaller omes,” says the; opinion. “Supersize gives no right to domineer.” The California District Court found in favor of the Svea. The| Ninth Circuit Court of Appeals held both vessels should share the blame. The high court sus- tains the District Court. | —at—— ADMIRAL EVANS IS i NOW ON WAY NORTH SEATTLE, April 18. —Steamer!
