Five Desperate Convicts Over- Power Guards and Make Escape—-Goyernor Aroused, Boise, Ida., June 21—Warden W. L. Cuddy has resigned as directing head of the Idaho state penitentiary, following the es- cape of five prisoners from that institution Wednesday evening, but the board of prison com- missioners refused to accept his resignation but relieved him of responsibility because of illness. He is now in the hospital there. George Roberts, one of the traveling guards and formerly of Lewiston has been placed in charge. Dan Ackley, deputy warden, also placed his resigna- tion in the hands of the commis- sion, but the commission declin- ed to accept it and he was pre- vailed on to remain at duty for the next 30 days. Five convicts escaped from the Idaho penitentiary early Wed- nesday evening, by sawing their way from cells, overpowering guards and scaling the wall. Insubordination Prevailes, It was the second break from the same cell house within a week. Two others sawed their way to liberty last Saturday night. This latest and almost wholesale escape has brought to light a condition which citizens declare calls for drastic action. Riots and insubordination on the part of prisoners, discoveries of hacksaws upon their persons aiid disquieting rumors of violence planned among them have been| told by guards and officials. Those who escaped were consid- ered incorribible and their past records both in and out of prison, were of the worst among the en- tire personnel of the peniten- tiary, authorities said. No trace had been found Thursday afternoon of any of the five who escaped. At dawn prison guards found tracks of the men and followed them from where they had jumped over the wall to a thicket of brush near the river, but here the trail was lost. Wednesday night’s escape is said to be the most sensational in the history of the Idaho pri- son. Working with hacksaws, smuggled to them by other pris- oners from one of the work shops in the prison, the convicts, who were in three different cells in cell house number one, gained entrance into the corridor about the same time. Once out of their cells they called Henry Workman, the guard on duty in the cell house. After a brief struggle they succeeded in bind- ing and gagging him. Not only a change of guards, but an additional emergency force is being installed at the penitentiary. D. P. District Engineer Perry Oxley with headquarters in Lewiston, Monday announced that at his office in that city on July 6 bids would be opened for the surfac- ing with crushed rock of 10.38 miles of the North and South highway. The stretch of road to be improved is within the Ever- green highway district, in Lew- is county. Last year this 10.38 miles was graded and surfaced all the way and the addtional surfacing now being considered will make the road a finished job. Approximately 10,000 cubic yards of broken stone will be used in the work. The Evergreen highway lies between Craigmont and Win- chester. When the road was constructed and graveled be- tween these two points only about half of the rock was placed on the roadbed at that time, the officials in charge wishing to give the new road time to settle. Everything to Eat and Wear ©: ELLLER GETS MONEY BACK After they had robbed Francis Nicholls, 84 years old, of a $20 bill while telling his fortune at Nicholls cabin, at Horseshoe bend on Salmon river, above Whitebird, Wednesday morning, three gypsies, a man and two women, were nabbed in Grange- ville Wednesday afternoon by Sheriff W. H. Eller, and were taken the the county jail where they refunded the $20 bill and $1 they had secured from Nichols for “revealing his fu- ture,” and paid $2 costs. They were alleged to have robbed Nicholls while telling his fortune but they firmly denied having taken any money, except $1, from the aged man.
