AN ORDINANCE REPEALING ORDINANCE NO, 100, PASSED AND APPROVED AUGUSY 21, 1918 AND REPEALING OkD- INANCE NO, 101, PASSED AND APPROVED SEPTEMBEK 23, 1918 WHEREAS, the Chairman and Board of 'l'rustees of tne Village of Cottonwood by Ordinance No. {v0, passed and approved August 21, 1918 and Ordinance No. W1, passed and approved September 23, 1918, createa an improvement district by number} and said improvement district was named and designated “LOCAL IM- PROVEMENT DISTRICT and, WHEREAS, the creation of such improvement district was to grade the streets therein and to build concrete curbs and gutters and concrete side- walks and provide drainage system for storm water and macadamize the streets for the full width between the curbs; and, WHEREAS, since the creation of such Local Improvement District, it has been deemed advisable and for the best interests of the owners of property in said improvement district, that a portion of said streets be ime proved by the construction of a hard | surface pavement and, WHEREAS, the assessment for the construction of such hard | surface pavement is insufficient to! pay for the cost thereof; and, WHEREAS, it will be necessary to | pass new ordinances and establish a time for the hearing of protests and do such other things as may be deem- ed necessary in order to create such new improvement district and con- struct the improvement therein con-}| templated. | NOW, THEREFORE, BE IT OR- DAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE} VILLAGE OF COTTONWOOD: SECTION 1. That Ordinance No. 100 declaring the intention of the Chairman and Board of Trustees of the Village of Cottonwood to create a local improve- ment district, passed and approved August 21st, 1918 ‘be and the same hereby is repealed, SECTION 2, That Ordinance No. 101 creating a local improvement district by number and providing for the making of an assessment roll, passed and approved September 23rd, 1918 be and the same hereby is repealed. SECTION 8. That the assessmenf roll hereto- fore approved for the making of the improvements in said local improve- ment district No. 2, be and the same hereby is vacated and set aside. WHEREAS, it is necessary for the comfort, convenience, health and | safety of the residents end. inhabi-| tomt- of the Village of Cottonwood ond the owners of property within the local improvement district herein- after described and to provide the same with concrete curbs and side- walks or any portion or part or all of | the improvements herein mentioned! and to construct a Macadam _ pay- ment upon a portion of the streets hereinafter described and a hard sur- face payment upon a portion of such streets in accordance with the plans and sepcifications hereinafter ap- proved and adopted; and WHEREAS, such improvements will especially benefit the property included in such assessment district and abutting, fronting and tributary to the streets proposed to be improv- ed; and, WHEREAS, the village engineer, at the reauest of and in accordance with the specific directions of the chairman and board, has prepared and returned and filed with the vil- lage clerk, and designated, “LOCAL IMPROVEMENT DISTRICT NO. 38, EXHIBITS 1 TO 10, INCLUSIVE”, detailed plans, specifications, blue prints, estimate of costs and other data relative to the proposed im- provements; and, uiKHAS, it is of especial benefit to the property and lots and parcels of land included within such local improvement district and to tne owners thereof, that such improve- ments be made at the time and in the manner and form herein contemplat- ed; and, WHEREAS, it is necessary thac a local improvement district be created by name and numbered, and that all resolutions and ordinances and instruments relating to the mak- ing of such improvements be re- ferred to by the name of such im- provement district: NOW, THEREFORE, BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF THE VILLAGE OF COTTONWOOD: SECTION 1. All streets to be provided with storms sewers, inlet basins, culverts, et cetra, as provided in the plans and specifications therefor on file with the Village Clerk, reference to which is hereby made SEC. 4. That the improvement provided for herein is an original im- provement. That plans and specifi- cations, blue-prints, estimates of costs and other data for the making of the proposed improvements pre- pared by the village engineer and filed with the village clerk (designat- ed “Local Improvement District No. 3 Exhibits 1 to 10, inclusive) and submitted to the chairman and Board of Trustees for their approval, be and | t’e same hereby are adopted, ap- proved and confirmed. SEC. 6. That it is the intention of the Chairman and Board of Trust-- ees to issue negotiable local improve- ment bonds of said Local Improve- ment District No 8 to pay for thé costs and expenses of making such improvements (less the portion paid by the village at large); that such local improvement bonds will be issued in anticipation of the collec- tion of installments of special assess- ments and will be issued as obliga- tions of the said Local Improvement District, by the village as agent for said district, and the same shall not be a charge or obligation against the village at large; that such local im- provement bonds shall be payable in ten equal annual installments: and shall bear interest at the rate of seven per cent per annuni from the date of issuance until paid; that such bonds shall contain such recitals as are authorized by law. SEC. 7. That the total estimated cost of such proposed improvement is $153,286.14, SEC. 8. That for convenience in making such special assessments and pps the benefits received by the several tracts of land, it is the in- tention of the Board of Trustees to apportion the assessments on the lots and parcels of land immediately abutting, contiguous and approxi- mate to the streets and portions thereof to be improved, by frontage, but in making such assessments upon lots and parcels of land included in such improvement district, and esp- ecially upon tributary lots, and in all cases where the portion of front+ age is inequitable or unfair, th and will apportion such assessménts in such manner, under all of the cir- cumstances of each particular case, as may be fair, just and equitable, and ‘will apportion such asse: n in accordance with the benefits re- ceived. SEC. 9 That the chairman and board of trustees will meet in the council chamber in the Simon Bro- thers’ Building in the Village of Cot- tonwood in Idaho County, State of Idaho, at ten o’clock A. M. on the 1ith day of November, A.
