Spooner filed o Dill against hts partner, Augustus Warner, to wind up the affairs of. the firm of Spooner & Warner. It was charged that Warner bad aude gross misrepresentations as to the firm’s financial condition, had been overdrawing his necount, plilfering goods from the store, and was Ikely to become insolvent by specu- lntion on the Board of ‘Trade and In buckot- susps. Spooner therefore asked for the ap- politment of 2 Recelyer and fora dissolution + of the firm. Yesterday Warner fled his an- swer, which puts 2 “different nppearance on the matter, Hoe denies all the charges of fraud und misdealing, and clalins his con- duct ling been irreprehensible. Le admits that he refused _to go on .under the first agreement In 1878, and compelled Spooner to contribute half the capital stock, but denies that Spooner made any objections to giving & note to securo the same. - iu denies that the capital stock of the tirm was Hmited tv $6,000, or that, after his return from Japan, he ro} resented that he had used nll the capital In buying goods and-must have $3,000 to get them out-of the Custom-llouse; but clalins that ho ndvanced $3,500, besides $3,000, ils share of the eapital, and induced Spooner to gives judgment note to one J. IL. Beers to secure such advance, Warnor further denies that was not spent for the benefit of the firm, but admits that Beors did not advance any mdnoy, but that the note was given for his (Warner's) benefit. Hoe hag siuce pretended to repay Beers instaliments on the note, and indorsed tho same on tt, while in fact. such sums wero: ‘kept by Iimself.. Ho Insists that Spooner has always had frea aceess to the bouks, and has been consulted with reference to sales, purchases, oxpenses, ote. Fintlly, Warner dontes that he has over conspired with Bee or that he has falled to keep proper houks o1 BecnunE, or drawn any cash to which he was not entitled, or approprinted to his own use any money or property which did not belong e ne lo «charges, on the contrary, nat Spooner about ha sto ti prit, lust carried off all tho ‘firm’s ills, Invoices, nud other papers, and has re- fused to return thom. About the sane thine Spooner offered to leave the firm if he was released from the Beers note, nd if the $3,000 note given to secure lila share of the capital was returned to him, Warner re- fused to accede to this, and since then the ariners have not got on well together, 1t 3 also charged thut the firm hay not been qwaking large profits, but on the contrary has Jost money, partly by unsalable or dumaged goods, and partly by heavy expenses, Warn- er also clalins thet Spooner has been over- drawing his account so that it was neeessary: tw keep a sharp watch on the money-lrawer, an conclusion, he Judignantly denies that he over carried off surreptitiously any goods from the store, and asks to have the bill dismissed. Beers also filed an answer, denying any conspiracy, and averring that Aero ‘6 statements ag to tho $4,600 note are TUG. ITEMS. Tho hearing of the: barbed wiro patent eases Is] nearly concluded befure Judges Drummond and Blodgett, Mr, George Pay- son occupied most of the day yeaterday with Jils argument, and Mr, Thurston will make concluding specch to-day.
